REQUESTED ACTION: Council consider approving the purchase of a used tractor-
loader-backhoe for use by the Streets and Drainage
Division.
RECOMMENDATION
The administration recommends approval of the purchase from Landmark Equipment Co., of
Irving, Texas, in the amount of$69,895.
BACKGROUND
Pricing for this purchase is obtained through the Houston-Galveston Area Council(H-GAC)
Cooperative Purchasing Program. H-GAC is a cooperative purchasing association providing
cities and political subdivisions with the means to purchase specialized equipment at volume
pricing. H-GAC complies with the State of Texas procurement statutes.
The Streets and Drainage Division has assumed responsibility for concrete and asphalt repairs
related to repairs and improvements to the water and sewer system made by the Water Utilities
Department. As the infrastructure has aged, such repairs have increased to an estimated fifty(50)
to seventy(70)per month. To meet this workload,two work crews have been created and
dedicated to this work. Additional equipment is also needed in order to execute the work in a
timely nu mm. The backhoe will be used for braking up concrete, removing debris and
bacUl ing new material in excavated areas, amounting to an estimated five hundred(500)service
hours per year.
The backhoe has approximately thirty-five(3 5)service hours and is available for approximately
$14,000 below the cost of a new model. The backhoe will have a full factory warranty of twelve
months or two thousand(2,000)hours. Warranty service is available locally from Oil City
Tractor.
BUDGETARY 11"ACT
Funk are available in the Water Fund.

THAT the City Manager be, and he is hereby, authorized to approve the purchase of a

REQUESTED ACTION: Council consider authorizing the purchase of traffic signal
cabinets and controllers.
RECOMMENDATION
The Administration recommends the purchase of traffic signal cabinets and controllers from
Naztec, Inc., in the estimated amount of$66,600.
BACKGROUND
Traffic signal controllers have a normal life span of approximately 10 years. The City currently
maintains controllers which are in excess of twenty(20)years old, and for which components
and parts are no longer available.
There are approximately one-hundred seventy(170)traffic signals within the City. Over the past
two years,the City has replaced 62 units with a combination of Capital Program funds and grant
funding. This additional purchase of four(4) complete cabinets and seven(7) controllers
represents the balance of City funds projected for this project in this fiscal year.
Naztec, Inc., is the sole vendor for this equipment, which is utilized throughout the City and is
the only equipment which is fully compatible with the City's existing traffic signal infrastructure.
BUDGETARYIMPACT
Funds are available in the Capital Program.

THAT the City Manager be and he is hereby authorized to purchase four (4) traffic signal
cabinets with controllers and seven (7) controllers in the amount of$66,600 from Naztec,
Inc., the sole vendor of equipment that is completely compatible with the City's existing
traffic signal infrastructure.

by the Police Department.
RECOMMENDATION
The administration recommends approval of a lease for five (5) solo enforcement police package
motorcycles from Cowboy Harley-Davidson, Inc., of Beaumont, in the annual amount of
approximately $22,156.
BACKGROUND
The Beaumont Police Department currently maintains five (5)motorcycles with six(6)officers
certified to operate them. Initial cost, operational, fuel and maintenance costs are all lower for
motorcycles than for traditional police vehicles. The size and maneuverability of the motorcycle
allow it to move through traffic quickly, reducing response time to traffic incidents. The
motorcycles also discourage traffic violations by providing a visible presence on patrol. The
motorcycle detail is popular at City events and parades and is utilized for VIP and dignitary
escorts, official funerals, hazardous cargo escorts and military escorts.
The lease is structured as a one-year agreement with two one-year extensions. New motorcycles
are supplied each year. The lease also includes charges for periodic maintenance performed
according to vehicle mileage. Units currently average 7,500 miles per year.
Bids were solicited from three (3)vendors. The sole response was from Cowboy Harley-
Davidson, who also held the previous lease. Bid was received as follows:

contract for Ready Mix Concrete and related materials.
RECOMMENDATION
The Administration recommends award of a contract to Transit Mix, Inc., of Beaumont, in the
estimated amount of$595,850.
BACKGROUND
Ready Mix Concrete and heavy construction materials, such as sand cement, stabilized sand,
stabilized limestone, and raw sand, are primarily used by both the Streets and Drainage Division
for street and sidewalk repair,and by the Water Utilities Department for sewer and water line
installation and repair. This contract replaces separate contracts for each department and
combines their requirements as well as those of other City departments under a single heavy
construction materials contract.
Five(5)vendors were solicited for bids,with two(2)responding. Transit Mix, Inc. of Beaumont
responded with a bid which represents the lowest overall cost to the City. Transit Mix has
previously held contracts for these materials.
BUDGETARY EWPACT
Funds for this expenditure are budgeted in the user departments' operating budgets.

REQUESTED ACTION: Council consider an appeal by Dorothy Marshall of the
Historic Landmark Commission's denial of her request to
demolish her house at 2185 South Street
RECOMMENDATION
The Administration recommends approval of the request.
BACKGROUND
Dorothy Marshall has applied for the appeal.
Ms. Marshall states that she recently became eligible for the Texas Homeowners Assistance
Program(THAP)/Hunicane Rita. Through this program, Ms. Marshall will be able to receive a
new house because her existing residence at 2185 South was damaged by Hurricane Rita. Since
this property is located within the Oaks Historic District, the demolition of the existing house
must be approved by the Historic Landmark Commission.
Ms. Marshall states that she has several leaks in the house which have led to mold and
deterioration. In addition,there are problems with the electrical and plumbing systems and
termite infestation.
If the structure is to be rehabilitated, the THAP Rita Program requires that the structure be
brought up to HUD's Housing Quality Standards. If that amount exceeds$40,000, then the
structure is to be demolished and a new structure built. The cost estimate by Shaw Group to
renovate the house is $96,236.08.
At Public Hearings held August 16 and 26, 2010,the Historic Landmark Commission voted 9:0
and 4:3, respectively, to deny the request for demolition of the house at 2185 South. The Historic
Landmark Commission stated that it does not oppose the demolition so much as the congruity of
the size and design of the new house. The program regulations state that the size of the family
dictates the size of the house.

One story frame structure. Gable front roof. Interior brick chimney. Overhanging eaves, exposed rafters, and elbow
brackets. Louvered vent and asbestos siding in gable. Two 25-over-one sash. off-center wood panel door. Shed roof
portico supported by four aluminum supports on rusticated stone and cement piers. Wood porch and cement steps.
11. Present Condition Fair. The use of modern materials sacrifices the architectural integrity of the structure.

The house is typical of middle class housing built in Beaumont after the first Spindletop boom.

ENTITLED AN ORDINANCE OVERTURNING THE DECISION
OF THE HISTORIC LANDMARK COMMISSION TO DENY AN
APPLICATION FOR A CERTIFICATE OF
APPROPRIATENESS TO DEMOLISH THE PROPERTY
LOCATED AT 2185 SOUTH STREET, BEAUMONT, TEXAS,
AND APPROVING SAID APPLICATION.
WHEREAS, on July 13, 2010, Dorothy Marshall applied to the Historic Landmark
Commission for a Certificate of Appropriateness to demolish a house at 2185 South Street,
Beaumont, Texas; and
WHEREAS, on August 16 and 26, 2010, the Historic Landmark Commission
conducted two (2) public hearings to consider the application for the Certificate of
Appropriateness; and
WHEREAS, at the conclusion of the public hearings, the Historic Landmark
Commission voted 9:0 and 4:3 respectively to deny the request for demolition of the house
at 2185 South Street; and
WHEREAS, Section 30-21.2(h)6 of the Code of Ordinances of the City of Beaumont
gives the applicant the right to appeal to the City Council a decision of the Historic
Landmark Commission to deny a Certificate of Appropriateness; and
WHEREAS, Dorothy Marshall has timely appealed the decision to deny her request
for a Certificate of Appropriateness;
NOW, THEREFORE, BE IT ORDAINED BY
THE CITY COUNCIL OF THE CITY OF BEAUMONT:
THAT after considering the evidence and testimony of the witnesses, the City Council
hereby finds and declares that the decision of the Historic Landmark Commission to deny
the application of Dorothy Marshall for a Certificate of Appropriateness to demolish the
property at 2185 South Street, Beaumont, Texas, should be overturned.
BE IT FURTHER ORDAINED THAT the application of Dorothy Marshall for a
Certificate of Appropriateness to demolish the property at 2185 South Street, Beaumont,
Texas, is hereby approved.

REQUESTED ACTION: Council to hold a public hearing on the 2010 (FY 2011)
Proposed Tax Rate.
RECOMMENDATION
Administration recommends that Council hold a public hearing, as scheduled, on the 2010 (FY
2011) Proposed Tax Rate of$0.6400. In accordance with the Property Tax Code, the Council
must make the following announcement: The meeting to vote on the tax rate will be held on
September 21,2010 at 1:30 p.m. in the Council Chambers.
BACKGROUND
Chapter 26 of the Property Tax Code requires taxing units to comply with truth-in-taxation laws
in adopting their tax rate. Two public hearings are required if the proposed tax rate exceeds the
lower of the effective tax rate or the roll back tax rate. A Notice of Public Hearing on Tax
Increase is required to be published in the newspaper, on the city website, and on a television
channel, if available. The notice was published in the newspaper, on the website and on the
cable channel 4 on August 24, 2010, regarding the proposal to increase total tax revenue from
properties on the tax roll by 2.68%. Although the proposed tax rate is remaining the same,the
increase is related to new property added to the tax roll this year and a slight increase in
appraised values.
BUDGETARYIMPACT
Applying the proposed tax rate of$.6400 and a 97% collection rate,budgeted revenues of
$29,017,000 and$13,249,000 respectively to the General and Debt Service Funds are
anticipated. The total rate of$0.6400 is apportioned$0.439385/$100 assessed valuation to the
General Fund and$0.200615/$100 assessed valuation toward the Debt Service Fund.

The notice of the public hearing on the Budget and Capital Program was published August 24,
2010.
BUDGETARY IMPACT
The proposed FY 2011 Budget appropriation for all funds, net of contingency, totals
$213,616,228.
