WHEREAS, on October 13, 2009,the City Council of the City of Beaumont,Texas,
passed Resolution No. 09-320 awarding a contract in the amount of$90,784.50 to L.D.
Construction, Beaumont, Texas, for the Phelan Boulevard Extension Sidewalk Project;
WHEREAS, Change Order No. 1 in the amount of($2,619.29) is required to adjust
the quantities actually used during the performance of the project,thereby decreasing the
contract amount to $88,165.21; and
WHEREAS, the project has been inspected and completed in accordance with the
terms and conditions of the contract and should be accepted;
NOW, THEREFORE, BE IT RESOLVED BY THE
CITY COUNCIL OF THE CITY OF BEAUMONT:
THAT the City Manager be and he is hereby authorized to execute Change Order No. 1
in the amount of($2,619.29), thereby decreasing the contract amount to $88,165.21.
BE IT FURTHER RESOLVED THAT the Phelan Boulevard Extension Sidewalk
Project be and the same is hereby accepted.
BE IT ALSO RESOLVED THAT the City Manager is hereby authorized to make final
payment in the amount of$4,408.26 to L.D. Construction.
PASSED BY THE CITY COUNCIL of the City of Beaumont this the 8th day of June,
2010.
