WHEREAS,The Protestant Episcopal Church Council of the Diocese of Texas has
offered to convey a ten foot (10')wide exclusive water line easement for property located
at 4090 Delaware, being 0.0335 acre out of Part of Lot 6, Block 4 of the French Addition,
as described in Exhibit "A" and shown on Exhibit "B", attached hereto, to the City of
Beaumont for the purpose of providing water services to St. Stephen's Episcopal Church
and allowing for the construction, alteration, operation and maintenance of the said water
line and appurtenances; and,
WHEREAS, the City Council has considered the purpose of said conveyance and
is of the opinion that the acceptance of said conveyance is necessary and desirable and
that same should be accepted;
NOW, THEREFORE, BE IT RESOLVED BY THE
CITY COUNCIL OF THE CITY OF BEAUMONT:
THAT the easement conveyed by The Protestant Episcopal Church Council of the Diocese
of Texas, as described in Exhibit"A"and shown on Exhibit"B,"be and the same is hereby,
in all things, accepted.
PASSED BY THE CITY COUNCIL of the City of Beaumont this the 11th day of May,
2010.

Beaumont, Jefferson-County, Texas
BEING a 0.0335 acre (1460 sq. feet)waterline easement situated in A. Williams Survey,
Abstract No. 385, Jefferson County, Texas and being out and part of Lot 6, Block 4 of the French
Subdivision, a subdivision of the City of Beaumont, Jefferson County, Texas according to the
map or plat thereof, recorded in Volume 3, Page 227, Map Records, Jefferson County,Texas and
being out of and part of that certain tract of land as described in a "Deed" from George Lindow
and wife, Phoebe Lindow to The Protestant Episcopal Church Council of the Diocese of Texas as
recorded in Volume 858, Page 320, Deed Records,Jefferson County,Texas, said 0.0335 acre
(1460 sq. feet) waterline easement being more particularly described as follows:
NOTE: All bearings are based on the South line of said The Protestant Episcopal
Church Council of the Diocese of Texas tract as recorded in Volume 858, Page
320 and that certain tract of land described in a "Deed"from Marjorie Silvia to
The Protestant Episcopal Church Council of the Diocese of Texas as recorded in
Volume 858, Page 322, both of the Deed Records of Jefferson County Texas as
NORTH 90 000'00"EAST.
COMMENCING at a 1/2" iron rod found for the Southeast corner of said The Protestant
Episcopal Church Council of the Diocese of Texas tract and being the Southwest corner of that
certain called 1.4937 acre tract of land as described in a "Warranty Deed" from Jerrie Ann
Sachitano, Individually and as Independent Executrix and Trustee under the will of Roy John
Sachitano, Deceased to Sun Chase Enterprises as recorded in Clerk's File No. 99-9901299 of the
Official Public Records of Real Property, Jefferson County, Texas and said corner also being in
the North right-of-way line of Delaware Street (based on a width of 60 feet);
THENCE SOUTH 90 000'00"WEST, along and with the North right of way line of Delaware
Street, for a distance of 45.47 feet to a point for the POINT OF BEGINNING and the Southeast
corner of the tract herein described;
THENCE SOUTH 90 000'00" WEST, continuing along and with the North right of way line of
Delaware Street, for a distance of 10.00 feet to a point for corner;
THENCE NORTH 00 005'38" WEST, over and across said The Protestant Episcopal Church
Council of the Diocese of Texas tract, for a distance of 146.01 feet to a point for corner;
