HomeMy WebLinkAboutORD 10-011 ORDINANCE NO. 10-011 ENTITLED AN ORDINANCE FINDING CERTAIN STRUCTURES TO BE PUBLIC NUISANCES AND ORDERING THEIR DEMOLITION AND REMOVAL OR REPAIR; PROVIDING FOR SEVERABILITY AND PROVIDING FOR A PENALTY. BE IT ORDAINED BY THE CITY OF BEAUMONT: Section 1. Section 2. In accordance with Article XVII, Section 2, of the Charter of the City of Beaumont, Section 14-52 of the Code of Ordinances of Beaumont, Texas, it is hereby ordered that the owner or owners of the following described buildings demolish and remove said structures within ten (10) days of the effective date of this ordinance. 1. 4655 Buffalo 8. 1603 Earl 2. 3266 Case 11. 1040 Fairway and Shed 3. 2830 Concord Rd (Commercial Apts) 13. 590 E. Section 3. In accordance with Article XVII, Section 2, of the Charter of the City of Beaumont, Section 14-52 of the Code of Ordinances of Beaumont, Texas, it is hereby ordered that the property owner(s)of the following described buildings execute a work program with the City within ten (10)days of the effective date of this ordinance and either demolish or complete all repairs and receive a Certificate of Occupancy within one-hundred fifty (150)days. Should the owner(s)fail to obtain substantial completion as defined in the work program,within ninety (90)days from the initiating date of the work program, Council hereby orders that the property be demolished without further notification to the property owner(s) or City Council action. 4. 2365 Cousins 18. 1450 Interstate 10 (Commercial Aux Bld) 6. 1845 Delaware 25. 324 La Salle 9. 1685 Earl 30. 2036 Linson 10. 4075 El Paso 35. 2610 Magnolia Avenue (Commercial) 12. 450 E. If a property owner requests and is authorized by City Council to enroll in a work program, all properties are to be secured from unauthorized entry, and all delinquent taxes shall be paid in full or a payment plan executed prior to the enrollment of the property in the work program. Section 5. The following structures shall be deferred for a period of at least sixty(60)days. During which time the owner or person in control of said properties shall insure that the buildings and/or structures are secured such that no unauthorized person can enter into said property through missing or unlocked doors or windows or through other openings in the building. This property is to remain secure from unauthorized entry at all times. 19. 1910 Ives 55. 2365 Taylor and Garage Section 6. That if any section, subsection, sentence, clause or phrase of this ordinance, or the application of same to a particular set of persons or circumstances should for any reason be held to be invalid, such invalidity shall not affect the remaining portions of this ordinance, and to such end the various portions and provisions of this ordinance are declared to be severable. Section 7. That any person who violated any provision of this ordinance shall, upon conviction, be punished as provided in Section 1-8 of the Code of Ordinances of Beaumont, Texas.
