CONVEYED, subject to the reservations and exceptions hereinafter made, and by these presents
does GRANT, SELL and CONVEY unto the said CITY OF BEAUMONT, P. O. Box 3827,
Beaumont, Texas 77704 and to its successors and assigns forever the property described in Exhibit
"A," attached hereto and made a part hereof for all purposes.
GRANTOR does hereby except and reserve from this conveyance unto itself,its successors
and assigns, forever, all of the oil,gas,and sulphur in and under the land herein conveyed but waive
all rights of ingress and egress to the surface thereof for the purpose of exploring,developing,mining
or drilling for same.
This conveyance is expressly made subject to all zoning laws and to restrictions, covenants,
conditions, easements and mineral and/or royalty reservations, if any, effecting the property.
TO HAVE AND TO HOLD the above described premises together with all and singular the
rights and appurtenances thereto and in any wise belonging, unto the said GRANTEE and
GRANTEE'S successors and assigns, forever; and said GRANTOR binds itself and its successors
and assigns to warrant and forever defend all and singular the said premises unto the said GRANTEE
and GRANTEE'S successors or assigns, against every person lawfully claiming or to claim all or
any part of the property, subject to the provisions stated above, when the claim is by, through, or

THAT the undersigned, of the County of Jefferson, and State of Texas, the legal and
equitable owner and holder of that one certain Vendor's Lien retained in deed dated October 25,
2005 from Oakmont, L. P. to TARM Properties,L.L.C.,recorded under County Clerk's Film Code
No. 2005038589 of the Real Property Records of Jefferson County, Texas securing the payment of
one note of even date therewith in the principal sum of$268,000.00 payable to Texas State Bank,
and additionally secured by Deed of Trust of even date therewith to the order of James, M.
Roberson, Trustee for Texas State Bank, said Deed of Trust filed for record with the County Clerk
of Jefferson County, Texas on October 27, 2005, recorded under County Clerk's Film Code No.
2005038590 of the Real Property Records of Jefferson County, Texas.
For a good and valuable consideration paid to the undersigned, the receipt of which is
hereby acknowledged, the undersigned has released and discharged, and by these presents hereby
releases and discharges, the property which is described in Exhibit "A," attached hereto and made
a part hereof for all purposes, a portion of the property described in the above mentioned Deed
of Trust from all liens and assignments held by the undersigned to secure payment of the above
mentioned note.
But it is expressly agreed and understood that this is a PARTIAL RELEASE only, and that
the same shall in no wise release, affect or impair said lien or liens against any other property in
said instrument mentioned.
