WHEREAS, on June 16, 2009, the City Council of the City of Beaumont, Texas,
passed Resolution No. 09-179 awarding a contract in the amount of$1,156,900 to McInnis
Construction, Silsbee, Texas, for all labor, materials, equipment and supplies for the
construction of eight (8)tennis courts and additional parking at the Athletic Complex; and
WHEREAS, Change Order No. 1 in the amount of$23,200 is required for extra work
to include installation of a new masonry refuse container enclosure and additional site
clearing not specified in the original contract, thereby increasing the contract amount to
$1,180,100;
NOW, THEREFORE, BE IT RESOLVED BY THE
CITY COUNCIL OF THE CITY OF BEAUMONT:
THAT the City Manager be and he is hereby authorized to execute Change Order No. 1
for additional work described above, thereby increasing the contract amount by $23,200
for a total contract amount of $1,180,100.
PASSED BY THE CITY COUNCIL of the City of Beaumont this the 1st day of
September, 2009.

COMMENTS
On September 1,2009, by Resolution No. 09-257, City Council approved the execution of Change Order No. 1
for revisions to the plans and specifications from McInnis Construction, Inc. of Silsbee for the above referenced
project. Attached for your review and approval are three (3) copies of the Change Order.
Change Order No. 1 provides for the installation of a new masonry refuse container enclosure designed to prevent
damage from refuse trucks and vandalism in the amount of$4,950. In addition,the change order provides for
additional site clearing not specified in the original contract in the amount of$18,250.
The total cost of Change Order No. 1 is $23,200, representing 2% of the original contract amount of$1,156,900.
The change order results in an increased contract amount of$1,180,100 and adds fifteen (15) days to the project.
The new expected date of substantial completion is December 12, 2009.
