HomeMy WebLinkAboutORD 08-103 ORDINANCE NO. 08-103 ENTITLED AN ORDINANCE FINDING CERTAIN STRUCTURES TO BE PUBLIC NUISANCES AND ORDERING THEIR DEMOLITION AND REMOVAL; PROVIDING FOR SEVERABILITY AND PROVIDING FOR A PENALTY. BE IT ORDAINED BY THE CITY OF BEAUMONT: Section 1. That the City Council of the City of Beaumont hereby finds and declares the buildings located at: 1. 3820 Avenue B 22. 3620 Goliad 2. 2286 Blanchette 23. 4136 Grandberry 3. 4304 Brandon 24. 7640 Greenfield Drive (Mobile Home) 4. 2669 Broadway 25. 1224 Hazel (Garage) 5. 7530 Broussard Road 26. 2601-05 Hazel 7. 1428 Cable 27. 2405 Hegele(Commercial) 8. 1590 Cartwright (Garage) 28. 2665 Hegele 9. 4286 Congress 29. 2087 Hemlock (Garage) 10. 1395 Cottonwood (Garage Apartment) 30. 705 Highland Drive 11. 3112 W. Section 2. In accordance with Article XVII, Section 2, of the Charter of the City of Beaumont, Section 14-52 of the Code of Ordinances of Beaumont, Texas, it is hereby ordered that the owner or owners of the following described buildings demolish and remove said structures within ten (10) days of the effective date of this ordinance. 1. 3820 Avenue B 9. 4286 Congress 2. 2286 Blanchette 10. 1395 Cottonwood (Garage Apartment) 3. 4304 Brandon 11. 3112 W. Section 3. In accordance with Article XVII, Section 2, of the Charter of the City of Beaumont, Section 14-52 of the Code of Ordinances of Beaumont,Texas, it is hereby ordered that the property owner(s)of the following described buildings execute a work program with the City within ten (10)days of the effective date of this ordinance and either demolish or complete all repairs and receive a Certificate of Occupancy within one-hundred fifty (150) days. Should the owner(s)fail to obtain substantial completion as defined in the work program, within ninety(90)days from the initiating date of the work program, Council hereby orders that the property be demolished without further notification to the property owner(s)or City Council action. All property owners authorized to enroll in a work program shall secure the property from unauthorized entry, and all delinquent taxes shall be paid in full or a payment plan executed prior to the enrollment of the property in the work program. 13. 4477 Dallas 35. 6920 LeBlanc Road 15. 3150 Dogwood Lane 36. 2475 Liberty& Real Garage Apt. 21. 3025 Goliad 44. 580 Nolan 22. 3620 Goliad 46. 731 Palm 25. 1224 Hazel (Garage) 47. 4360 Park 28. 2665 Hegele 59. 2697 Washington Boulevard Section 4. If the property owner requests and is authorized by City Council to enroll in a work program, all properties are to be secured from unauthorized entry, and all delinquent taxes shall be paid in full or a payment plan executed prior to the enrollment of the property in the work program. Section 5. That if any section, subsection, sentence, clause or phrase of this ordinance, or the application of same to a particular set of persons or circumstances should for any reason be held to be invalid, such invalidity shall not affect the remaining portions of this ordinance, and to such end the various portions and provisions of this ordinance are declared to be severable. Section 6. That any person who violated any provision of this ordinance shall, upon conviction, be punished as provided in Section 1-8 of the Code of Ordinances of Beaumont, Texas.
