Coleman,Ward I SPECIAL EMERGENCY MEETING Nancy Beaulieu,Ward II Audwin Samuel, Mayor Pro Tem,Ward III September 16, 2008 Jamie Smith,Ward IV Tyrone E. Cooper, City Attorney Kyle Hayes, City Manager Tina Broussard, City Clerk The City Council of the City of Beaumont, Texas, met in a special emergency session on September 16, 2008, at the Emergency Operations Center, 700 Orleans, Beaumont, Texas, at 10:00 a.m. to consider the following: OPENING Roll Call Reports from Mayor and City Manager Emergency Business Comments Mayor Ames called the meeting to order at 10:00 a.m. Roll call was made by Stephanie Gandy, Deputy City Clerk. Present at the meeting were Mayor Ames, Mayor Pro Tern Samuel, Councilmembers Coleman, Pate and Smith. Absent: Councilmembers Beaulieu and Wright. Also present were Kyle Hayes, City Manager; Tyrone Cooper, City Attorney; Stephanie Gandy, Deputy City Clerk. REPORTS Mayor Ames complimented the departments from the City, the public information officers and commented on their efficiency. City Manager, Kyle Hayes, reported that the water plant is on power, though a boil water notice will remain in effect for at least 5 days. The sewer plant is running at 90% capacity on generators. Nearly all of the city roadways are driveable. Due to the power lines that are down on Lafin Road, the City Landfill will not open at this time, however Entergy is working on clearing Lafin Road of downed lines. As soon as that occurs, the landfill will open. The curfew is still in effect. Restaurants and food establishments wishing to reopen must be inspected by the Health Department before opening. Entergy has stated that Beaumont should have power by September 30th Minutes-September 16,2008 EMERGENCY BUSINESS 1. Consider approval of declaration of emergency; extending and renewing the authorities, rules, regulations until the state of disaster is terminated. Administration recommended approval of an ordinance declaring an emergencyforthe City of Beaumont Mayor Pro Tern Samuel moved to ADOPTAN ORDINANCE ENTITLED AN ORDINANCE DECLARING AN EMERGENCY; EXTENDING AND RENEWING THE AUTHORITIES, RULES, REGULATIONS AND ALL OTHER PROVISIONS OF THE EMERGENCY POWERS ORDINANCE UNTIL THE STATE OF DISASTER IS TERMINATED; PROVIDING NOTICE; PROVIDING A PENALTY; PROVIDING SEVERABILITY; AND PROVIDING AN EFFECTIVE DATE. Councilmember Smith seconded the motion. AYES: MAYOR AMES, MAYOR PRO TEM SAMUEL, COUNCILMEMBERS COLEMAN, PATE AND SMITH NAYS: NONE MOTION PASSED Ordinance 08 - 080 2. Consider approval of removing the operations of the competitive bidding requirements. Administration recommended approval of an ordinance removing the operations of the competitive bidding requirements. Councilmember Smith made a motion to ADOPT AN ORDINANCE ENTITLED AN ORDINANCE DECLARING AN EMERGENCY; REMOVING THE OPERATION OF THE COMPETITIVE BIDDING REQUIREMENTS OF THE APPLICABLE COMPETITIVE BIDDING PROVISIONS OF THE CITY CHARTER AND CODE OF ORDINANCE PURSUANT TO SECTION 252.022 OF THE TEXAS LOCAL GOVERNMENT CODE WITH RESPECT TO CONTRACTS FOR PROCUREMENTS MADE BECAUSE OF THE PUBLIC CALAMITY RESULTING FROM HURRICANE IKE, FOR A PERIOD OF AT LEAST 90 DAYS FROM AND AFTER SEPTEMBER 11, 2008. Mayor Pro Tern Samuel seconded the motion. AYES: MAYOR AMES, MAYOR PRO TEM SAMUEL, COUNCILMEMBERS COLEMAN, PATE AND SMITH NAYS: NONE MOTION PASSED Ordinance 08 - 081 COUNCILMEMBER COMMENTS COUNCILMEMBER PATE - PRAISED THE TEAM AT THE EMERGENCY OPERATIONS CENTER, BEAUMONT IS FORTUNATE TO HAVE THEM DOING Page 2 of 4 Minutes-September 16,2008 SUCH A GOOD JOB FOR THE CITIZENS, THANKED ENTERGY AND IS CONFIDENT THAT THE CITY WILL BE UP AND MOVING SOON, SENT PRAYERS OUT TO BRIDGE CITY AND THE BOLIVAR PENINSULAā€˛ THANKED RICKY SMITH AND HIS STAFF FOR ALL OF THEIR HARD WORK COUNCILMEMBER COLEMAN - THANKED THE BEAUMONT FIRE DEPARTMENT, BEAUMONT POLICE DEPARTMENT, ALL OF THE CITY DEPARTMENT HEADS AND THE EMERGENCY OPERATIONS CENTER,ASKED THAT CITIZENS BE PATIENT COUNCILMEMBER SMITH- THANKED THE EMERGENCY OPERATIONS CENTER AND TIM OCNASHECK FOR AN OUTSTANDING JOB, THANKED THE CITIZENS HELPING TO CLEAN UP, ALSO THANKED CONSTABLE STEPHENS AND DANIELS MAYOR PRO TEM SAMUEL - THANKED EVERYONE INVOLVED, COMMENDED FEMA, STATE DEPARTMENTS AND THE GOVERNOR'S OFFICE FOR WORKING WITH THE CITY, THANKED THE CITY EMPLOYEES FOR ALL OF THEIR HARD WORK,FEELS THAT BEAUMONT HAS THE BEST FIRST RESPONDERS IN THE COUNTRY, THANKED THE MEDIA FOR KEEPING THE PUBLIC INFORMED, ENTERGY, THE PORT OF BEAUMONT AND NOVROSKI'S FOR ALL THAT THEY ARE DOING, BELIEVES TIM OCNASCHECK IS THE BEST EMERGENCY MANAGEMENT COORDINATOR IN THE COUNTRY, COMMENDED THE MAYOR FOR HER HARD WORK AND THE FACT THAT SHE STANDS BY HER WORD AND HER BELIEFS, THANKED JUDGE WALKER, THE JEFFERSON COUNTY SHERIFF'S OFFICE AND CONSTABLE, ALSO THANKED THE CITY MANAGER AND THE CITY ATTORNEY COUNCILMEMBER BEAULIEU - ABSENT COUNCILMEMBER WRIGHT- ABSENT CITY ATTORNEY COOPER - NONE CITY MANAGER HAYES - NONE MAYOR AMES- THANKED THE SUPPORT TEAM BECAUSE THE TEAM LEARNS FROM EVERYTHING THAT IS DONE, COMMENTED THAT MAYOR PRO TEM HAS BEEN A GREAT SUPPORT DURING THE WHOLE OPERATION, APPRECIATES THE CITIZENS OF BEAUMONT WHO ARE THE PRIORITY, KNOWS EVERYONE WANTS TO COME BACK BUT STATED THAT THE CITY HAS TO BE THOUGHT OF AS A WHOLE, COMMENTED ON ENTERGY AND THE AMOUNT OF STRESS THAT THEY ARE UNDER AND PRAISED ALL OF THEIR HARD WORK, THANKED THE STATE AND ALL OF THE CITY STAFF THAT HAVE BEEN WORKING SO HARD Page 3 of 4 Minutes-September 16,2008 Report - Officer Crystal Holmes Made a report on the POD and American Red Cross locations within the City of Beaumont Council adjourned at 10:28 a.m. Audio available upon request in the City Clerk's Office. ve*4- Nort" Becky Am Mayor Um Step anie Gandy, eputy Ci Clerk LU - . ii I Page 4 of 4 Minutes-September 16,2008
