HomeMy WebLinkAboutORD 08-083 - ORDER AMENDING THE PUBLIC CURFEW HURRICANE IKE �I City of Beaumont Becky Ames Mayor ORDER AMENDING THE PUBLIC CURFEW WHEREAS, pursuant to §418.108 of the Texas Government Code, the Mayor of the City of Beaumont on the11t" day of September 2008 issued an emergency powers order putting into effect a public curfew in the City of Beaumont between the hours of 8:00 p.m. and 6:00a.m.during the declared state of disaster due to the imminent threat to public safety posed by the aftermath of Hurricane Ike; and WHEREAS, the City Council by Ordinance 08-080 ratified and extended the emergency powers order and granted to the Mayor the authority to continue to provide for the protection, preservation, and improvement of life and property within the City during the state of emergency; and WHEREAS, it has been determined by the Mayor that the conditions posing the threat to the preservation of life and property in the city have subsided to the point where the curfew can be amended; NOW, THEREFORE, BE IT PROCLAIMED BY THE MAYOR OF THE CITY OF BEAUMONT, TEXAS: That the public curfew previously ordered for the City of Beaumont is and it is hereby amended by this proclamation as follows: CURFEW. Box 3827 • Beaumont,Texas 77704-3827 (a) A person shall not remain or travel upon any public or private property within the City of Beaumont from 11:00 p.m. to 5:00 a.m. beginning Saturday September 20, 2008. (b) Subsection (a) shall not apply to: (1) A person authorized by the Emergency Management Director to assist in the production of the health, safety, or welfare of the public; or (2) A person who remains or travels upon private property which is owned by him or upon which the person has been invited.
