Cooper, City Attorney Kyle Hayes, City Manager Tina Broussard, City Clerk The City Council of the City of Beaumont, Texas, met in a regular session on July 1,2008,at the City Hall Council Chambers, 801 Main Street, Beaumont, Texas, at 1:30 p.m. to consider the following: OPENING Invocation Pledge of Allegiance Roll Call Presentations and Recognition Public Comment: Persons may speak on scheduled agenda items 1-3/Consent Agenda Consent Agenda Mayor Ames called the council meeting to order at 1:30 p.m. Councilmember Pate gave the invocation. Frank Kiefer, citizen of Beaumont, led the Pledge of Allegiance. Roll call was made by Tina Broussard, City Clerk. Present at the meeting were Mayor Ames, Mayor Pro Tern Samuel, Councilmembers Coleman, Beaulieu, Wright and Pate. Absent: Councilmember Smith. Also present were Kyle Hayes, City Manager; Tyrone Cooper, City Attorney; Tina Broussard, City Clerk. Councilmember Smith - Absence due to training for his job Proclamations, Presentations, Recognitions "Fourth of July " -July 1, 2008- Proclamation read by Mayor Ames; accepted by Claudie Hawkins, Events Facilities Director, City of Beaumont Mayor Ames read the announcement regarding Executive Session being held at the conclusion of the General Business portion of the meeting. Public Comment: Persons may speak on scheduled agenda items 1-3/Consent Agenda. None CONSENT AGENDA Approval of minutes - June 24, 2008 Confirmation of committee appointments - None Minutes-July 1,2008 A) Authorize the acceptance of a water line easement to provide water services for Our Mother of Mercy School - Resolution 08 - 197 B) Approve a resolution accepting the First Baptist Church Parking Lot Construction Project- Resolution 08 - 198 C) Approve a three (3) year financial advisory agreement with RBC Capital Markets - Resolution 08 - 199 Councilmember Wright made a motion to approve the Consent Agenda. Councilmember Pate seconded the motion. AYES: MAYOR AMES, MAYOR PRO TEM SAMUEL, COUNCILMEMBERS COLEMAN, BEAULIEU, WRIGHT AND PATE NAYS: NONE MOTION PASSED GENERAL BUSINESS 1. Consider authorizing the issuance and sale of $30 million City of Beaumont, Texas, Certificates of Obligation, Series 2008; levying taxes to provide for payment thereof; and containing other matters related thereto. Administration recommended approval of an ordinance authorizing the issuance of$30 million City of Beaumont,Texas, Certificates of Obligation, Series 2008; levying taxes to provide for payment thereof; and containing other matters related thereto. Proceeds will be used to provide funds for various street, drainage and general improvement projects. Ryan O'Hara, with RBC Capital Markets spoke to Council regarding the Certificates of Obligation, Series 2008 for $30,000,000 and the Waterworks and Sewer System Revenue Bonds, Series 2008 for $20,730,000 All debt shall be incurred in the Debt Service Fund which is supported by property taxes.The current debt service property tax rate of$.220/$100 assessed valuation is expected to be sufficient to meet debt service requirements on the certificates. Councilmember Beaulieu moved to ADOPT AN ORDINANCE ENTITLED AN ORDINANCE AUTHORIZING THE ISSUANCE AND SALE OF $30,000,000 THE CITY OF BEAUMONT, TEXAS, CERTIFICATES OF OBLIGATION, SERIES 2008; LEVYING TAXES TO PROVIDE FOR PAYMENT THEREOF; AND CONTAINING OTHER MATTERS RELATED THERETO. Mayor Pro Tern Samuel seconded the motion. Consider authorizing the issuance of$20 million City of Beaumont, Texas, Waterworks and Sewer System Revenue Bonds, Series 2008; and containing other matters related thereto. Administration recommended approval of an ordinance authorizing the issuance of$20 million City of Beaumont,Texas,Waterworks and Sewer System Revenue Bonds, Series 2008;and containing other matters related thereto. Proceeds will be used to provide funds for the expansion, repair, renovation and related improvements to the waterworks and sewer system. All debt shall be incurred in the Water Utilities Fund which is supported by revenues of the waterworks and sewer system. Increased Water and Sewer rates, necessary to meet debt service requirements on the Revenue Bonds, will be presented at the time the FY 2009 Budget is submitted for approval in September, 2008. Councilmember Pate made a motion to ADOPT AN ORDINANCE ENTITLED AN ORDINANCE AUTHORIZING THE ISSUANCE OF $20,000,000 THE CITY OF BEAUMONT, TEXAS, WATERWORKS AND SEWER SYSTEM REVENUE BONDS,SERIES 2008;AND CONTAINING OTHER MATTERS RELATED THERETO. Councilmember Coleman seconded the motion. AYES: MAYOR AMES, MAYOR PRO TEM SAMUEL, COUNCILMEMBERS COLEMAN, BEAULIEU, WRIGHT AND PATE NAYS: NONE MOTION PASSED Ordinance 08 - 056 3. Consider approving a resolution accepting the Hayes Gully Drainage Improvements Project. Administration recommended acceptance of the Hayes Gully Drainage Improvement Project, approval of Change Order No.2 in the amount of$94,567.56 and final payment in the amount of $128,070.38 to Excavators and Constructors, LTD. On June 19, 2007, City Council awarded Excavators and Constructors LTD the contract for the Hayes Gully Drainage Improvements Project. for an amount of $3,668,172.00. Page 3 of 6 Minutes-July 1,2008 This project has been inspected and completed in accordance with the Terms and Conditions set out in the contract documents. Funds are available in the Capital Program. Mayor Pro Tern Samuel made a motion to APPROVE A RESOLUTION THAT THE CITY MANAGER IS HEREBY AUTHORIZED TO EXECUTE CHANGE ORDER NO. 2 IN THE AMOUNT OF $94,567.56 THEREBY INCREASING THE CONTRACT TO$2,555,407.66 AND TO MAKE FINAL PAYMENT IN THE AMOUNT OF $128,070.38 TO EXCAVATORS AND CONSTRUCTORS, LTD. Councilmember Beaulieu seconded the motion.
