WHEREAS, on June 19, 2007, the City Council of the City of Beaumont, Texas,
passed Resolution No. 07-192 awarding a contract in the amount of $3,668,172 to
Excavators and Construction, LTD for a contract for the Hayes Gully Drainage
Improvement Project; and,
WHEREAS, Change Order No. 1 was required to remove a portion of the work in
the amount of$1,207,331.90, thereby decreasing the amount to $2,460,840.10; and,
WHEREAS, Change Order No. 2 is required to adjust the quantities actually used
during the performance of the project in the amount $94,567.56 thereby increasing the
contract to $2,555,407.66; and,
WHEREAS, the project has been inspected and completed in accordance with the
terms and conditions of the contract and should be accepted.
NOW, THEREFORE, BE IT RESOLVED BY THE
CITY COUNCIL OF THE CITY OF BEAUMONT:
THAT the Hayes Gully Drainage Improvement Project be and the same is hereby
accepted.
BE IT FURTHER RESOLVED that the City Manager is hereby authorized to execute
Change Order No. 2 in the amount $94,567.56 thereby increasing the contract to
$2,555,407.66.
BE IT ALSO RESOLVED that the City Manager is hereby authorized to make final
payment in the amount o� 28,070.38 to Excavators and Constructors, LTD.
