'if i i ss��,,,, - Mayor Becky Ames - EXHIBIT "A" EMPLOYMENT OPPORTUNITY JOB TITLE: City Magistrate Exempt:X Classified: REPORTS TO: City Council DEPT/DIV: Municipal Court STARTING SALARY: $100,000 APPLICATION DEADLINE: DUTIES AND RESPONSIBILITIES Essential Job Functions: This position is created by Article XII, Section 3 of the Charter of the City of Beaumont. As a judicial tribunal in this city's government, the Court is responsible for the administration of the municipal court operation within the corporate city limits of Beaumont in accordance with state and federal law, state statues, the city charter and city ordinances,along with other functions as may be assigned to the court under state law or local regulations. This position presides over a variety of hearings including criminal jury and non jury trials, pre-trial conferences, Class C misdemeanors in the enforcement of city ordinances, traffic violations, criminal misdemeanors, property disputes and other cases appropriately tried in Municipal Court;presides over juvenile arraignments including,but not limited to,alcohol,driving, and curfew violations; conducts driver's license suspension hearings; administers magistrate's warnings to criminal defendants whether charged with misdemeanors and/or felonies; sets bonds and forfeits bail; issues summons; conducts arraignments; considers bond reductions when requested; imposes fines, advises defendants of rights and options; accepts pleas of guilty and nolo contendere and enters judgments;reviews affidavits for sufficiency of facts and determination of the existence of probable cause to issue search and arrest warrants; determines the appropriateness of requests for search warrants; conducts hearings on motions to modify or rescind emergency protection orders,and drafts and issues appropriate orders to the affected citizens,law enforcement agencies, educational institutions and private organizations; adheres to and follows any procedures or policies adopted by City Council and performs related duties as assigned. WORKING CONDITIONS Works inside in a desirable environment; work flow is high, and/or of considerable variety in task assignments. Interruptions can be frequent and distracting. MINIMUM ESSENTIAL QUALIFICATIONS Knowledge: Positions requires knowledge of multiple areas of criminal and municipal law, the Texas Penal, and Code of Criminal Procedure; knowledge of the organization,duties,powers, limitations and authority of Municipal Court; knowledge of legal principals and practices, including civil, criminal, constitutional, and administrative laws and procedures; ordinances, statutes, and court decisions relating to Municipal Court jurisdiction; judicial procedure and rules of evidence; established precedents and sources of legal references, and principles and practices of court administration and state and federal regulations governing criminal violations,prosecutions,and police operations. Skills/Abilities: Must have excellent oral and written communication skills in the performance of all job functions. Must be able to handle multiple assignments and provide timely services; effectively plan, organize and direct the judicial activities of the Municipal Court; organize,interpret,and apply legal principles and knowledge of complex legal problems; effectively apply legal knowledge and principles; properly interpret and make decisions in accordance with laws; must possess a sense of fairness, and exhibit respect towards hostile persons in court; the ability to apply general rules to specific problems to come up with logical answers; ability to combine separate pieces of information or specific answers to problems to form general rules and conclusions; ability to listen to and understand ideas presented through spoken words and sentences, often in stressful situations. Physical Reguirements: Frequently required to see, sit, stand talk and hear. Education/Experience: Juris Doctorate from an accredited law school; Membership in the State Bar of Texas; Must be a resident of the City of Beaumont for one year preceding appointment.
