ENTITLED AN ORDINANCE AMENDING CHAPTER 30 OF THE CODE OF ORDINANCES OF BEAUMONT, TEXAS, AND IN PARTICULAR THE BOUNDARIES OF THE ZONING DISTRICTS, AS INDICATED UPON THE ZONING MAP OF BEAUMONT, TEXAS, BY CHANGING THE ZONING OF PROPERTY PRESENTLY ZONED GC-MD (GENERAL COMMERCIAL-MULTIPLE FAMILY DWELLING) DISTRICT TO RS (RESIDENTIAL SINGLE FAMILY DWELLING) DISTRICT FOR TWO 2-ACRE TRACTS OF LAND LOCATED IN THE 9800 BLOCK OF OLD VOTH ROAD, BEAUMONT, JEFFERSON COUNTY, TEXAS; PROVIDING FOR SEVERABILITY; PROVIDING FOR REPEAL AND PROVIDING A PENALTY. BE IT ORDAINED BY THE CITY OF BEAUMONT: Section 1. That Chapter 30 of the Code of Ordinances of Beaumont, Texas, and in particular the boundaries of the zoning districts, as indicated upon the Zoning Map of the City of Beaumont, referred to in Section 30-56 thereof, is hereby amended by changing the zoning of property presently zoned as GC-MD (General Commercial-Multiple Family Dwelling) District to RS (Residential Single Family Dwelling) District for two 2-acre tracts of land located in the 9800 block of Old Voth Road being two 2-acre tracts out of the W. B. Dyches Survey, Ab-17, being more particularly described as follows: Called Tract No. 2 BEING a 2.00 acre tract of land situated in the W.B. Dyches Survey, Abstract 17, Jefferson County, Texas and being a part of that certain 20.315 acre tract conveyed to James E. Parker et al by deed in Volume 2192, Page 380 of the Deed Records of Jefferson County, Texas; said 2.00 acre tract being more particularly described by metes and bounds as follows: G ACGIORDINANC\ZONINGHC.ORD BEGINNING at a 1 inch steel rod found in the west right-of way line of U. S. Highway 69, 96, &287 and the east line of said 20.315 acre tract for the southeast comer of a 3.00 acre tract described as Parker Brothers Subdivision Unit One per plat recorded in Volume 16, Page 18 of the Map Records of Jefferson County, Texas and being the northeast corner of the herein described tract; THENCE South 100 46' 45" East with the west right-of-way line of said U. S. Highway 69, 96, & 287 for a distance of 163.74 feet to a 5/8 inch steel rod set for the southeast corner of the herein described tract; THENCE North 890 12' 25" West along a line being parallel to and 160.41 feet perpendicular distance from the south line of said Parker Brothers Subdivision Unit One for a distance of 546.77 feet to a 5/8 inch steel rod set in the east line of Voth Road and the west line of said 20.315 acre tract for the southwest corner for the herein described tract; THENCE North 080 14' 30" West with the east line of Voth Road for a distance of 162.43 feet to a '/ inch steel rod found for the southwest corner of said Parker Brothers Subdivision Unit One and being the northwest corner of the herein described tract; THENCE South 890 12' 25" East with the south line of said Parker Brothers Subdivision Unit One for a distance of 539.43 feet back to the point of beginning and containing 2.00 acres of land. The bearings recited herein are referenced to the bearing of South 10° 46' 45" East for the west right-of way line of U. S. Highway 69, 96 & 287 per the deed recorded in Volume 2192, Page 380 of the Deed Records of Jefferson County, Texas. Highway 69, 96 & 287 and being the east line of said 20.315 acre tract for the southeast comer of a 3.00 acre tract described as Parker Brothers Subdivision Unit One per plat recorded in Volume 16, Page 18 of the Map Records of Jefferson County, Texas; THENCE South 100 46' 45" East with the west right-of-way line of said U. S. Highway 69, 96 &287 for a distance of 163.74 feet to a 5/8 inch steel rod found for the southeast comer of a 2.00 tract located between the herein described tract and said Parker Brothers Subdivision with said 5/8 inch steel rod being the northeast corner and POINT OF BEGINNING of the herein described tract; THENCE South 100 46' 45" East continuing with the west right-of-way line of U. S. Highway 69, 96 &287 for a distance of 161.57 feet to a '/z inch steel rebar with cap stamped "RPLS 564" set for the southwest corner of the herein described tract; THENCE North 890 12' 25" West along a line being parallel to and 158.29 feet distance from the south line of said 2.00 acre tract located between said Parker Brothers Subdivision and the herein described tract, for a distance of 554.01 feet to a '/z inch steel rebar with cap stamped "RPLS 564" set in the east right-of-way line of Voth Road for the southwest corner of the herein described tract; G ACG\ORDINANC\ZONINGHC.ORD THENCE North 080 14' 30"West with the east right-of-way line of Voth Road for a distance of 160.28 feet to a '/ inch steel rod found for the southwest corner of said 2.00 acre tract located between the herein described tract and said Parker Brothers Subdivision and being the northwest corner of the herein described tract; THENCE 890 12' 25" East with the south line of said 2.00 acre tract located between said Parker Brothers Subdivision and the herein described tract for a distance of 546.77 feet back to the point of beginning and containing 2.00 acres of land. The bearings recited herein are referenced to the bearing of South 10° 46' 45" East for the west right-of-way line of U. S. Highway 69, 96 & 287 per said the deed recorded in Volume 2192, Page 380 of the Deed Records of Jefferson County, Texas, as shown on Exhibit "K attached hereto and made a part hereof for all purposes, and the official zoning map of the City of Beaumont is hereby amended to reflect such changes. Section 2. That, in all other respects, the use of the property hereinabove described shall be subject to all of the applicable regulations contained in Chapter 30 of the Code of Ordinances of Beaumont, Texas, as amended. Section 3. That if any section, subsection, sentence, clause or phrase of this ordinance, or the application of same to a particular set of persons or circumstances, should for any reason be held to be invalid, such invalidity shall not affect the remaining portions of this ordinance, and to such end, the various portions and provisions of this ordinance are declared to be severable. That all ordinances or parts of ordinances in conflict herewith are repealed to the extent of the conflict only. Section 5. That any person who violates any provision of this ordinance shall, upon conviction, be punished, as provided in Section 1-8 of the Code of Ordinances of Beaumont, Texas.
