ENTITLED AN ORDINANCE REPEALING ORDINANCE NO.
05-029 GRANTING A FRANCHISE TO ARROW WASTE,
INC., TO OPERATE A SOLID WASTE COLLECTION AND
TRANSPORTATION SERVICE IN THE CITY OF BEAUMONT
AND PROVIDING AN EFFECTIVE DATE.
WHEREAS, Ordinance No. 05-029 passed on April 26, 2005, granted a franchise
to Arrow Waste, Inc., to operate a solid waste collection and transportation service in the
City of Beaumont; and
WHEREAS, Arrow Waste, Inc., has failed to comply with the terms and conditions
of its franchise to operate a solid waste collection and transportation service in the City of
Beaumont by its failure to timely pay the monthly franchise fees; and
WHEREAS,the City of Beaumont desires to terminate the franchise agreementwith
Arrow Waste, Inc.,granted by Ordinance No. 05-029 based on Arrow Waste, Inc.'s,failure
to comply with the terms and conditions of said franchise effective November 2, 2007.
NOW, THEREFORE, BE IT ORDAINED BY
THE CITY COUNCIL OF THE CITY OF BEAUMONT:
THAT Ordinance No. 05-029 granting a franchise to Arrow Waste, Inc., to operate a solid
waste collection and transportation service in the City of Beaumont be and it is hereby
repealed and said franchise agreement is hereby terminated effective November 2, 2007.
PASSED BY THE CITY COUNCIL of the City of Beaumont this the 23rd day of
October, 2007.
