Cooper, City Attorney Kyle Hayes, City Manager Tina Broussard, City Clerk The City Council of the City of Beaumont,Texas, met in a regular session on August 7,2007, at the City Hall Council Chambers, 801 Main Street, Beaumont, Texas, at 1:30 p.m. to consider the following: OPENING Invocation Pledge of Allegiance Roll Call Presentations and Recognition Public Comment: Persons may speak on scheduled agenda item No. 1/Consent Agenda Consent Agenda Mayor Ames called the council meeting to order at 1:30 p.m. Councilmember Nancy Beaulieu gave the invocation. Councilmember Smith led the Pledge of Allegiance. Roll call was made by Tina Broussard; City Clerk. Present at the meeting were Mayor Ames, Councilmembers Coleman, Beaulieu, Pate and Smith. Absent: Mayor Pro Tern Samuel,Councilmember Gethrel Williams-Wright. Also present were Kyle Hayes; City Manager, Tyrone Cooper; City Attorney, Tina Broussard; City Clerk. Proclamations, Presentations, Recognitions None Public Comment: Persons may speak on scheduled agenda item No. 1/Consent Agenda. None CONSENT AGENDA Approval of minutes - July 24, 2007 Confirmation of committee appointments - Resolution 07-222 Barbara White would be appointed to the Parks and Recreation Advisory Committee. The term would commence August 7, 2007 and expire August 6, 2009. (Councilmember Jamie D. Smith) Pat Avery would be appointed as Chairman of the Board of Adjustment(Zoning). The term would commence August 7, 2007 and expire August 6, 2008. (Mayor Becky Ames) Minutes-August 7,2007 Joey Hilliard would be reappointed to the Board of Adjustment (Zoning). The current term would expire February 17, 2009. (Mayor Becky Ames) Pat Avery would be reappointed to the Board of Adjustment(Zoning). The current term would expire January 6, 2009. (Mayor Becky Ames) Councilmember Smith made a motion to approve the Consent Agenda. Councilmember Beaulieu seconded the motion. AYES: MAYOR AMES,COUNCILMEMBERS COLEMAN, BEAULIEU, PATE AND SMITH NAYS: NONE MOTION PASSED GENERAL BUSINESS 1. Consider authorizing a License to Encroach for a pool and garage encroaching onto the utility easement at 6870 Glen Willow. Administration recommended authorization to execute the License to Encroach. Raymond L. and Jo Theresa Audilet,owners of the property at 6870 Glen Willow Drive, have submitted an application for a License to Encroach for a pool and garage encroaching on the utility easement at that location. An in ground swimming pool is encroaching 7 feet for a distance of 18 feet and a brick garage is encroaching 3.3 feet for a distance of 11 feet into the City's twenty(20)foot utility easement across the rear of said lot[Lot 12, Block 14, Dowlen West Unit XVII Addition]. The License to Encroach protects the City from Liability and provides a thirty (30) day cancellation clause. There is a one time fee of$500 for the License to Encroach. Councilmember Beaulieu made a motion tO APPROVEA RESOLUTION THAT THE CITY MANAGER BE AND HE IS HEREBY AUTHORIZED TO EXECUTE A LICENSE TO ENCROACH TO RAYMOND L.AND JO THERESA AUDILET, REGARDING THE ENCROACHMENT OF A POOL AND GARAGE ONTO THE TWENTY(20) FOOT UTILITY EASEMENT AT 6870 GLEN WILLOW DRIVE, WHICH IS DESCRIBED AS BEING OUT OF LOT 12, BLOCK 14, DOWLEN WEST UNIT XVII ADDITION, TO THE CITY OF BEAUMONT, JEFFERSON COUNTY, TEXAS, FOR ALL PURPOSES FOR A ONE-TIME FEE OF FIVE HUNDRED DOLLARS ($500.00 FOR THE LICENSE TO ENCROACH. Councilmember Smith seconded the motion. COUNCILMEMBER BEAULIEU - NONE COUNCILMEMBER WRIGHT- ABSENT COUNCILMEMBER PATE- ATTENDED A MEETING WITH CONGRESSMAN TED POE AND THE (FAA) FEDERAL AVIATION ADMINISTRATION, REGARDING THE AIR TRAFFIC CONTROL,COUNCILMEMBER PATE WAS PLEASE TO ANNOUNCE THAT THE AIR TRAFFIC CONTROL WILL STAY IN JEFFERSON COUNTY,ALSO THERE WILL BE A PUBLIC MEETING HELD TONIGHT WITH CONGRESSMAN TED POE AT 7:00 P.M. AT THE PORT ARTHUR YMCA, 6760 NINTH AVENUE, ENCOURAGED EVERYONE TO ATTEND MAYOR PRO TEM SAMUEL - ABSENT COUNCILMEMBER SMITH - THANKED ALL THE CITIZENS OF WARD IV THAT ATTENDED THE WARD MEETING HELD ON AUGUST 2, 2007 CITY ATTORNEY COOPER - NONE CITY MANAGER HAYES - NONE MAYOR AMES- ANNOUNCED THE MEETING WITH CONGRESSMAN TED POE, COMMENTED ON THE WARD IV MEETING, DISCUSSED THE WORKSHOP HELD ON TUESDAY, JULY 31, 2007 Public Comments (Persons are limited to three minutes) Mary Ann Mastrangelo 850 Avenue D Beaumont TX Discussed the Oaks Historic Neighborhood Association meeting, regarding the Just Out - Fresh Starting facility that is proposed for the Oaks Historic Neighborhood Page 3 of 4 Minutes-August 7,2007 James Segura 1960 Long Ave Beaumont TX Discussed the Just Out-Fresh Starting facility in his neighborhood;supports Ms. Mastrangelo and her efforts Brenda Holmes Gilbert 10745 Johnson Rd.
