July 3, 1984 Council Letter No. 605 Honorable Mayor and Members of City Council Subject: Annexation of 120 . 4 acres located at the intersection of Florida Avenue and the Beaumont City Limits line. In the City ' s adopted Comprehensive Land Use Plan, specific areas are identified as having growth potential for the city. Those areas fitting these criteria which are outside of the City Limits, principally on the western edge of the city, are likely locations for future annexations . After the adoption of the Land Use Plan in August of 1982, the City' s posture in annexing these areas has been strictly at the request of the individual land owners. State statutes require that areas annexed into a city' s corporate limits must be serviced with municipal utilities within three years of the annexation date. In addition, since most of these areas are within the City ' s extra-territorial jurisdiction, State statutes also authorize the City to review all subdivision plats. The current requirement for annexation is two public hearings before the Planning Commission and City Council in order that any residents of the area proposed for annexation may voice their opinions in favor of or in opposition to the annexation. The first reading reading was April 24, 1984. The applicant, Mr. Joe Zerangue, owner of Drilco Well Services, has requested the annexation in order to maintain the water and sanitary sewer service which he is currently receiving from the City. His business is located upon the subject property which is generally west of Cardinal Drive on the south side of Florida Avenue. Should the subject land be annexed, the following basic scope of services would be provided: - Water Service. The subject property would be provided with water service from the extension of a 6 and 8-inch water line to be extended from existing lines located in Florida Avenue. - Sanitary Service. The subject property would be provided sanitary sewer service from a 36-inch force main which would tie to existing facilities within the city limits. Page 2 Storm Drainage. All developments within the proposed annexation area will be addressed according to specifications from the City Engineer ' s office. Storm runoff from all new development will be accepted into the Usan Street ditch which runs southward towards Cardinal Drive then south within the proposed annexation site. Additional storm drainage for the proposed landfill site will occur from an existing ditch running north/south along the eastern boundary of the sewage treatment plant. Solid Waste Collection. Solid waste collection will follow the normal pattern for commer- cial areas. Fire Protection. Fire protection would be provided by Stations #3 and #10 at Ken- neth and Brockman and 3.855 Washington Boulevard, respectively. Police Protection. Normal police patrol service will be provided for the annexed property. This area falls into police patrol districts 4 and 5. Maintenance of Publicly Dedicated Community Facilities. Dedicated Streets : Streets which will be dedicated by way of subdivision plat will be maintained by the City upon acceptance by the Director of Public Works as per the normal procedure. Dedicated parks or Playgrounds: Any lands intended to be dedicated for recreational purposes will receive individual review by the Director of Parks and Recreation as well as the Planning Depart- ment to see that they are consistent with the City' s Comprehensive Park and Open Space Plan prior to their acceptance. Street Liqhts. Street lights in new platted subdivisions within the annexed area are to be provided at the developer's expense as per the re- quirements of the current Street Light Ordinance. The locations are determined by the Traffic Department in conjunction with Gulf States Utilities. PLANNING COMMISSION RECOMMENDATION The Planning Commission recommended approval of the annexation by a vote of 5 to 0 . ENTITLED AN ORDINANCE ANNEXING THE HEREINAFTER DESCRIBED TERRITORY TO THE CITY OF BEAUMONT, JEFFERSON COUNTY, TEXAS, AND EXTENDING THE BOUNDARY LIMITS OF SAID CITY SO AS TO INCLUDE THE SAID PROPERTY WITHIN THE CITY LIMITS, AND GRANTING THE SAID TERRITORY AND TO ALL INHABITANTS THEREOF ALL OF THE RIGHTS AND PRIVILEGES OF OTHER CITIZENS; AND BINDING SAID INHABITANTS BY ALL OF THE ACTS AND ORDINANCES OF SAID CITY. WHEREAS, a public hearing was held concerning the proposed annexation of the territory described in Exhibit "A" attached hereto for all purposes. Said public hearing was held on March 19 , 1984. At the public hearing, all interested persons were provided an opportunity to be heard; and, WHEREAS, such public hearing was held not more than forty ( 40) days nor less than twenty ( 20) days prior to the institution of annexation proceedings; and, WHEREAS, notices of such public hearing was published in the newspaper having general circulation in the City of Beaumont, Texas not more than twenty ( 20) nor less than ten ( 10) days prior to such hearing; and, WHEREAS, the territory lies adjacent to and adjoins the present boundaries of the City of Beaumont, Texas; NOW, THEREFORE, BE IT ORDAINED BY THE CITY OF BEAUMONT: Section 1 . THAT the land and territory lying adjacent to and adjoining the present boundaries of the City of Beaumont, Texas and described in Exhibit "A" attached hereto and made a part hereof for all purposes, is hereby added and annexed to the City of Beaumont, Texas; said territory shall hereinafter be included within the boundary limits of the City of Beaumont, Texas; the present boundary limits of such City at the various points contiguous to the area hereinafter described in Exhibit "A" , are altered and amended so as to include said area within the corporate limits of the City of Beaumont, Texas; such property shall be within Ward 2 for purposes of municipal elections. Section 2. The described territory in the area so annexed shall be a part of the City of Beaumont, Texas, and the inhabitants thereof, if any , shall be entitled to all the rights and privileges of all the citizens and shall be bound by the acts, ordinances, resolutions and regulations of the City of Beaumont, Texas. Section 3 . Chapter 10, Section 10-21 of the Code of Ordinances of the City of Beaumont is hereby amended to add 120. 4 acres to be the property hereinafter described in Exhibit "A" attached hereto and made a part hereof for all purposes. He currently owns all land between the proposed area and the existing City Limits line, generally west of Major Drive between Dishman Road and Manion Drive. Should the subject land be annexed, the following basic scope of municipal services would be provided: - Water Service. The subject property would be provided with water service from the extension of a 24-inch water line located in Major Drive (FM 364) . - Sanitary Sewer Service . The subject property would be provided sanitary sewer service from.a 54-inch force main which would tie to existing facilities within the city limits., Page 2 Storm Drainage.) July 6, 1984 Council Letter 624 Honorable Mayor and Members of City Council Subject: Interstate 10 North/Gladys Avenue Rezoning Study GENERAL INFORMATION Boundaries of this study are Gladys , Longfellow, Interstate 10, and all properties within 1000 feet to the north of Gladys and within 500 feet south of Gladys. Existing R-3 zoning is original from 1955. Land use north of Gladys is the Longfellow Apartments ; south of Gladys land uses include a gasoline station, doctors ' , dentists and insurance offices. Existing zoning is GC-MD south of the study and RS across Lonfellow to the west. The comprehensive plan designates the area-in-the study as an Activity Corridor. Existing Zoning and Land Use R-3 ; apartments, doctors, dentists, insurance offices , and a service station. Surrounding Zoning and Land Use north - RS, single family east - Interstate 10 south - GC-MD, professional offices, savings and loan west - (across Longfellow) RS, single family Comprehensive Plan Activity Corridor SPECIAL INFORMATION Public Utilities in Longfellow Sanitary Sewer: 6 inch line Water: 6 inch line Streets Longfellow is a local street with a 60-foot right-of-way, 35-foot pavement. The vote was 4 to 1. This item was deferred from the June 26th agenda, pending more discussion between the Planning Department and the residents of that area. ENTITLED AN ORDINANCE AMENDING CHAPTER 30 OF THE CODE OF ORDINANCES OF BEAUMONT, TEXAS, AND IN PARTICULAR THE BOUNDARIES OF THE ZONING DISTRICTS AS INDICATED UPON THE ZONING MAP OF BEAUMONT, TEXAS, BY CHANGING THE ZONING FROM R-3 (MODIFIED TWO FAMILY AND MULTIPLE DWELLING DISTRICT) TO RM-H (RESIDENTIAL MULTIPLE FAMILY - HIGH DENSITY) AND NC ( NEIGHBORHOOD COMMERCIAL DISTRICT) ON PROPERTY LOCATED ON THE WEST SIDE OF INTERSTATE 10 NORTH AT GLADYS AVENUE; PROVIDING FOR SEVERABILITY; PROVIDING FOR REPEAL AND PROVIDING A PENALTY. That in all other respects the use of the property hereinabove described shall be subject to all of the applicable regulations contained in Chapter 30 of the Code of Ordinances of Beaumont, Texas, as amended. Section 3 . That if any section, subsection, sentence, clause or phrase of this ordinance, or the application of same to a particular set of persons or circumstances, should for any reason be held to be invalid, such invalidity shall not affect the remaining portions of this ordinance, and to such end the various portions and provisions of this ordinance are declared to be severable. Section 4. That all ordinances or parts of ordinances in conflict herewith are repealed to the extent of the conflict only . Section 5 . That any person who violates any provision of this ordinance shall, upon conviction, be punished as provided in Section 1-8 of the Code of Ordinances of Beaumont, Texas. July 6, 1984 Council Letter 610 Honorable Mayor and Members of City Council Subject: Amending Chapter 18 of the Code of Ordinances During the June 26th Work Session, Council declared its support favoring a City ordinance prohibiting the act of loitering for the purpose of prostitu- tion. The ordinance provides Beaumont law officials with the right to cease any action which is considered soliciting or procuring another to commit an act of prostitution. In addition, Council set a minimum fine of $100 for persons in violation of this ordinance. It is recommended that this ordinance be adopted. Karl Nol1enberger City Manager r .7 z1- N F`1G IT CA p/1 v ORDINANCE NO. ��- ENTITLED AN ORDINANCE AMENDING CHAPTER 18 OF THE CODE OF ORDINANCES OF THE CITY OF BEAUMONT BY ADDING A NEW ARTICLE III TO BE ENTITLED "PROSTITUTION LOITERING" ; PROVIDING DEFINITIONS; PROHIBITING THE ACT OF LOITERING FOR THE PURPOSE OF PROSTITUTION; ENUMERATING CERTAIN UNLAWFUL ACTS; PROVIDING A PENALTY; PROVIDING FOR SEVERABILITY; PROVIDING FOR REPEAL AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY OF BEAUMONT: Section 1 . That Chapter 18 of the Code of Ordinances of the City of Beaumont is hereby amended by adding a new Article III to read as follows: Article III: Prostitution Loitering. Section 18-19. Definitions. In the interpretation of this article, the following words and terms are to be used and interpreted as defined hereafter: 1 . Act of prostitution. Offers to engage, agrees to engage, or engages in sexual conduct for a fee or solicits another in a public place to engage with him or her in sexual conduct for hire. 2 . Known prostitute or panderer. A person who, within one year previous to the date of arrest for violation of this section, has within the knowledge of the arresting officer been convicted of violating the Statute of the State of Texas defining and punishing acts of soliciting, committing, or offering or agreeing to commit an act of prostitution. 3 . Loiter. Remaining idle in essentially one place and shall include the concepts of spending time idly , loafing or walking about aimlessly. 4 . Inducing. To invite or appeal to someone to engage in illicit sexual activity. 5. Enticing. To wrongfully solicit, persuade, attract, coax, seduce, lure or tempt someone to commit an act of prostitution. 6 . Soliciting. To accost, lure or tempt someone with immoral intentions into unlawful conduct by seduction. 7 . Procuring. To get and make available a person for an act of prostitution. 8 . Hailing. To call out or greet someone with enthusiasm in an effort to solicit an act of prostitu- tion. 9. Beckons - To summon or signal by a wave of the hand, a nod or other gesture with the intent of soliciting an act of prostitution. 10. Thoroughfare. A street or passage through which one can travel. 11. Assignation. The making of any appointment or engagement for prostitution or lewdness or any act in furtherance of such appointment or engagement. 12. Sexual Conduct. Includes homosexual relations, deviate sexual intercourse, sexual contact, and sexual intercourse. 2 - Section 18-20. Prohibiting Acts of Loitering for Purposes of Prostitution. It is hereby unlawful to: Intentionally , knowingly , or recklessly loiter in or near any thoroughfare, street, highway , or place open to the public in a manner and under circumstances manifesting the intent of inducing, enticing, soliciting, or procuring another to commit an act of prostitution or assignation. Among circumstances which may be considered in determining whether such purpose is manifested are: that such person is a known prostitute or panderer; repeatedly beckons to, stops or attempts to stop or engages passers-by in conversation; or repeatedly stops or attempts to stop motor vehicle operators by hailing, waving of arms or any other bodily gesture. No arrest shall be made for a violation of this subsection unless the arresting officer first affords such person an opportunity to explain such conduct, and no one shall be convicted of violating this section if it appears that at trial the explanation given was true and disclosed a lawful purpose. Section 2. In any prosecution charging a violation of this article where a person is found guilty of prostitution loitering, punishment shall be by a fine of not less than One Hundred ($100) Dollars nor more than Two Hundred ($200) Dollars. Section 3 . That if any section, subsection, sentence, clause or phrase of this ordinance or the application of same to a particular person, or to a particular set of circumstances, should for any - 3 - reason be held invalid, such invalidity shall in no way effect the remaining portions of this ordinance and to such end that various portions and provisions of this ordinance are declared to be severable. Section 4 . That all ordinances or parts of ordinances in conflict herewith are hereby repealed to the extent of the conflict only. Section 5 . July 6, 1984 Council Letter 619 Honorable Mayor and Members of City Council Subject: Foreign Trade Zone The need to diversify our City's economy and to attract various types of industry to our area has been expressed by many. In response to this re- quest, the Beaumont Port Commission, the Port Arthur Port Commission, the Orange Port Commission and the Jefferson County Airport investigated the possibility of the Golden Triangle being declared a Foreign Trade Zone. During a recent public hearing on the establishment of a Foreign Trade Zone, which was held at the John Gray Institute by the U.S. Government, many favorable results were emphasized. These include attracting new industry, new manufacturers and increased job opportunities. These are definite factors that we, as a City, are seeking to utilize in our continuing efforts for economic revitalization. Councilmember Audwin Samuel attended the public hearing in conjunction with the City Manager and expressed the City of Beaumont' s support for the Foreign Trade Zone proposed in the Golden Triangle. The representatives from the Foreign Trade Zone Board indicated it would take six months for a decision to be made on this application. Councilmember Samuel felt the City Council should implore our Congressional delegation to expedite the process as much as possible so that we could take advantage of this economic tool as soon as possible. It is recommended that a resolution urging immediate action by the Foreign Trade Zone Board designating the Golden Triangle as a Foreign Trade Zone be approved. July 6, 1984 Council Letter 614 Honorable Mayor and Members of City Council Subject: Purchase of Work Uniforms On June 18, 1984, bids were received from five vendors for the purchase of work uniforms for non-civil service employees. This bid covers the antici- pated needs for work uniforms for a twelve-month period, and includes work pants, jackets, jumpsuits and smocks. We requested "all or none" bids be- cause of the difficulty in obtaining individual items and excessive cost to the City. The bids are as follows: Shepherd Uniform $42,519.50 Blair Uniform 42,331.90 Tyler Uniform 45,528.00 Factory Sales 46,175.50 Martin's Uniform 58,156.25 The staff recommends that the bid be awarded to Shepherd Uniforms of Beaumont at a cost of $187.60 more than Blair Uniform because of the ease in dealing with a local vendor as opposed to an out-of-town vendor for any problems that may occur with the uniforms. We feel that this price differential will be more than made up by: long distance phone service to notify company of problems; delays in exchanging ill-fitting uniforms; delays in outfitting new employees hired during the year; and problems in distribution of the uniforms upon the initial shipment. Shepherd's has been our supplier this past year and our relationship with them has been excellent. It is recommended that the bid of Shepherd Uniforms be approved. Currently, in certain areas, we are operating below that standard; some hydrants are 600 feet from every structure. In order to alleviate this inadequacy in fire protection and to meet the fire hydrant spacing requirements, bids were received June 4, 1984, on the 1984 Water System Improvement Contract. This work entails the following four project elements: Project I Shall consist of approximately 3,138 feet of 8-inch AC pipe and four fire hydrants in Sallie Street, Calloway and Parsons Drives in the Rothwell Subdivision. Project II Shall consist of approximately 1,783 feet of 6-inch AC pipe and one fire hydrant in Greeves, Riggs and Gross Streets in the Gulf Terrace Subdivision. Project III Shall consist of approximately 1,755 feet of 6-inch AC pipe and three fire hy- drants in IH-10 northeast frontage road between Louisiana Street and Doctors Drive. Project IV Shall consist of approximately 933 feet of 6-inch AC pipe and one fire hydrant in Cardinal Drive west north frontage road from American Recreational Vehicles, Inc. to State Highway 124. July 6, 1984 Council Letter 626 Honorable Mayor and Members of City Council Subject: Contract for Hot Mixed-Hot Laid Asphaltic Concrete The Street Division will be shifting more of its asphalt road maintenance material from hot mix-cold laid to hot mix-hot laid material due to its higher durability. Hot mixed-cold laid asphaltic concrete is a plant mix that can be spread and compacted at atmospheric temperature. Because of the volatiles in the mixture, it must be aerated and cured prior to opening to traffic. Hot mixed-hot laid asphaltic cement is a plant mix that must be spread and compacted while it is at an elevated temperature. There are no volatiles in this mixture and it can be opened to traffic immediately following compaction. The hot mixed-hot laid asphaltic concrete will be used in repairing utility cuts, intersection reconstruction, leveling road surfaces and patching operations. Bids were received May 14th, on a six-month contract, from the following vendors: Keown Supply $26.50/ton Troy Dodson Construction Company 29.50/ton The expected use for a six-month period is 380 tons ($10,070) . A map of the project area is attached. The agreement stated that the Drainage District would contract for the channel construction required and that actual cost of construction would be paid equally by the City and the District. Cost of the channel work was es- timated to be $50,000. Bids were received January 24, 1984, by Drainage District 6 for construction of the channel and a contract was awarded to Doty Construction Company, Inc. on April 2, 1984, in the amount of $40,260. The cable feeds information into the computer, and is used to monitor primary systems which include the primary clarifier, the primary and secondary recirculation pumps and sludge pumps. Before the computerized system was installed, we had three shifts of personnel manually watching the process units. But now that the cables are not feeding in- formation into the computer and there is no shift personnel , there is no way for us to know if and when a problem occurs in these unmonitored areas. We've been without the necessary cable for about four weeks. Only one bid of $6,950 was submitted by the Bruning Division of AM International . Of the three brands available, two companies indicated that they did not receive bid information in time to submit bids. Due to this indication, bids were taken a second time on June 18, 1984. Again, only one bid, from Bruning Division of AM International , was received for $6,950. The other companies indicated they could not fulfill the local maintenance requirement. Council Letter 621 Honorable Mayor and Members of City Council Subject: Caldwood Addition Drainage Easements Several areas in the Caldwood Addition (see attached drawing) have experienced flooding problems during heavy rains. Expanding soils in the area have caused the pavement to buckle and obstruct the flow of water. Two property owners in one of the areas have agreed to donate ten-foot drainage easements along their common property line to provide underground drainage into the Caldwood Cutoff Relief Ditch west of the area. The City's cost for this drainage im- provement, where the easements will be placed, is estimated to be $16,600. Funds for this project have not been made available and will not be allocated until the 1985 fiscal year. The drainage project has been designed in conjunction with a street rehabili- tation project along West Caldwood and South Caldwood Drives. Plans have been prepared for reconstruction of pavement, curbs and gutter and drainage facili- ties when funds are available. The property owners are aware that this pro- ject is tentatively scheduled during the summer of 1985. Since Glen Siecko, one of the property owners, is also an employee of the City, an Affidavit of Public Disclosure has been filed at the Courthouse to comply with the Texas Civil Statutes. Administrative Service Paid to Parent The Company has a management agreement with TCI whereby TCI's management is providing administrative services and has assumed managerial responsibility for cable television system operations and construction. Such services include, but are not limited to, the utilization of TCI's: executive management (financial and operational) ; payroll department; data processing depart- ment; purchasing department; accounts payable department; and benefit of TCI's lower interest rates on debt resulting from its broader nationwide operations. As compensation for these services, the Company pays a fee based upon miles of plant and number of subscribers. 2. Depreciation and Amortization The Company depreciate$ its assets based on the straight-line method of depreciation using the estimated useful lives of 3 to r 15 years. Franchise purchase costs represent the cost of acquir- ing a franchise in excess of its net book value and is being de- preciated over 40 years. TCI acquired the Company in September 1983 and, accordingly, recognized depreciation and amortization expense of $191,881 for the four months ended December 31, 1983. This amount is reflec- ted in the Company's balance sheet as accumulated depreciation and amortization at December 31 , 1983. The Statement of opera- tions, however, presents revenue and expenses for the year ended I December 31, 1983 and includes revenue and expenses for the entire year, including depreciation and amortization expense. Dotson Group Controller SUMMARY OF THE MAJOR PROVISIONS OF H.R. 4103, "THE CABLE TELECOMMUNICATIONS ACT OF 1983" AS REPORTED BY THE HOUSE COMMITTEE ON ENERGY AND COMMERCE H.R. 4103 would amend the Communications Act of 1934, adding a new title relating to cable television as follows: 2=RQM The purposes of the bill are to: -- Establish a national policy concerning cable communications. -- Assure that cable communications provide the widest possible diversity of information sources and services to the P ublic. -- Establish guidelines for the exercise of federal, state, and local authority with respect to the regulation of cable systems. -- Establish franchise procedures and standards which encourage the growth and development or cable systems and which assure that cable systems are responsive to the needs and interests of the local community. Rate Regulation -- Total deregulation of cable services is established. -- Franchising authorities may continue to regulate the rates for four years for basic cable service (any tier which standing alone contains retransmission of local broadcast signals) to the extent provided for in existing franchises. -2- -- The FCC must promulgate rules that define circumstances and establish standards under which franchising authorities would be permitted to regulate basic service rates because a cable system is not subject effective competition. -- Any regulated basic service rates may be increased annually at the discretion of a cable operator by up to 5 percent. -- Cable operators wishing rate increases in excess of 5 percent may pursue traditional rate increase procedures. -- Final action on a rate increase request must be taken within 180 days, or it will be deemed granted. -- Franchising authorities are prohibited from regulating the rates for any cable service other than basic. -- Franchise agreements which fix the rates for basic service for a specified period of time are grandfathered for that period. Renewals -- Between 36 and 30 months prior to expiration of a franchise, a franchising authority may begin proceedings to identify the future cable- related needs and interests of the community and to review the performance of the cable operator. The franchising authority must begin such proceedings if the operator requests them. -- After a cable operator submits a renewal proposal, a franchising authority may either grant renewal, or begin an administrative- type proceeding to determine whether: ( 1) the cable operator has substantially complied with the material tends of the franchise and with applicable law; -3- (2) the quality of the operator's service has been reasonable in light of community needs; (3) the operator has the financial, legal, and technical ability to provide the services, facilities, and equipment proposed; and (4) the operator's proposal is reasonable to meet future cable related needs and interests of the community. -- The franchising authority must conduct an administrative-type proceeding if the operator requests it. -- In any administrative-type proceeding, the cable operator shall have full due process rights, including the right to adequate notice, the right to introduce evidence and compel production of evidence from others, the right to examine Witnesses, and the right to a record. -- If, at any time during an administrative-type proceeding, an operator is denied due process, he may file an interlocutory appeal is state or federal court and obtain an order directing the franchising authority to provide the due process required. -- If an administrative-type proceeding is conducted, a franchising authority must make its decision based solely on the record of that proceeding. -- An operator denied renewal may obtain judicial review 3a state or federal court. If the operator demonstrates that an adverse finds% is not based on a preponderance of the evidence on the record, the courtmay grant appropriate relief. Contract Modification -- In addition to all other contract rights and remedies available to cable operators, the legislation creates an alternative procedure to modify commitments to provide facilities, equipment, and services. A. Facilities and Eq uj nm n . -- an operator may obtain modification of commitments to provide facilities or equipment, through negotiations with the franchising authority, upon a showing that such provision has become commercially impracticable. -- If an operator's negotiations are unsuccessful, he may obtain modification in state or federal court upon a showing that the provision of facilities or equipment has become commercially impracticable. B. Services. -- An operator may obtain modification of a franchise commitment to provide particular services, through negotiations with the franchising authority, upon a showing that the mix, quality, and level of services required by the franchise will be maintained. -5- -- If an operator's negotiations are unsuccessful, he may obtain modifications in state or federal court upon a showing that the mix, quality, and level of services required by the franchise will be maintained. -- An operator may rearrange, replace, or remove at his discretion any service: (1) which is no longer available, or (2) for which the operator must pay a copyright royalty substantially higher that that paid when the service was originally offered and which has not been specifically compensated for in a rate increase or other adjustment. -- An operator may at his discretion reorganize, retier, or otherwise offer any service required by a franchise, other than a basic service subject to regulation. Franchise Fees -- Cable operators may be required to pay annual franchise fees of up to 5 percent of a cable system's gross revenues. -- The terms of existing franchises relating to the level of franchise fees to be paid by operators are grandfathered. -6- -- Funding for PEG required by existing franchises does not count toward 5 percent limit. Funding for PEG in new or renewed franchises Will count toward 5 percent limit, except for the capital costs of PEG facilities. -- Payments made by cable systems for bonds, security funds, letters or credit, insurance, indemnification, penalties, liquidated damages, or taxes or general applicability are not counted as part of franchise fees. -- Consumers may be informed of how much of their monthly cable bills is used to pay franchises fees by designation on the bill as a line item. -- Any increase in franchise fees may, at the operator's option, be passed through directly to subscribers, unless the franchising authority demonstrates that the rates charged already reflect the higher franchise fee costs. Public, educational, and governmental use (PEG) : -- Franchising authorities may, in new franchises, require channel capacity for PEG purposes and establish rules for the use of such capacity. Such requirements in renewal proceedings are subject to renewal Provisions. -- Franchising authorities must set rules allowing a cable operator to offer programming over unused PEG channels. -- Cable operators may not exercise editorial control over PEG programming. -_ I -7- -- Provisions in existing franchises and state laws or regulations relating to PEG channel capacity are grandfathered. B. Third party commercial use: -- Cable systems with 36 or more activated channels are required to dedicate channel capacity for the commercial use (video programming) of unaffiliated persons under the following schedule: -- 36 to 54 activated channels, 10 percent of the total minus those channels pre-empted for television must-carry or aeronautical use. -- 55 to 100 activated channels, 15 percent of the total minus those channels pre-empted for television must-carry or aeronautical use. -- 101 or more activated channels, 15 percent of the total. No level of government can require dedication of channel capacity in excess of the schedule. -- Franchise agreements for commercial use of channel capacity are grandfathered. -- Cable system operators may establish the price, terms, and conditions oz commercial use. These may be at least sufficient to assure that the operation, financial condition, or market development of the cable system will not be adversely affected. -- Systems with filled capacity on September 21 , 1983, will not be required to remove any services; but must make channel capacity available for commercial use as that capacity becomes available. -- Cable operators may not exercise editorial control over programming provided on commercial use channels. -- Cable operators may provide programming on unused commercial use channels until a contract is signed for it with a commercial user. -- Any person denied access may seek relief in court. If that person can demonstrate by clear and convincing evidence that channel capacity was available and that the price, terms, or conditions established by the cable operator were unreasonable, the court can order channel capacity made available and can set the price, terms, or conditions for its use. The court may also award actual damages if it deems such relief appropriate. The court may not look at contracts between the operator and a corporate affiliate that provides service comparable to that of the person denied access in order to judge whether the operator has been unreasonable. -- The FCC is empowered to order access and set _the price, terms, and conditions or use, and other necessary rules, where a person denied access can make a showing that the operator has a record of prior violations of the access provisions. The FCC may establish further rules where a cable system or multiple system operator is guilty of a pattern or practice of violations. -- When cable reaches 70 percent pass-by of U.S. homes and achieves 70 percent penetration of those, the FCC can promulgate additional rules necessary to further the purpose of the commercial access provisions. These rules, however, cannot preempt authority expressly granted to f rancnise authorities elsewhere in the bill. -- Franchise authorities may preclude use of commercial access channels to provide obscene or indecent programming. -9- Ownership -- No one may be a cable system operator if, in the same community, that person owns or controls a television broadcast station, a daily newspaper, or a local telephone company. Telephone cross-ownership is permitted in rural areas, as defined by the FCC. -- Existing co-located broadcast/cable and newspaper/cable combinations are grandfathered if in existence on July 1 , 1984, and not inconsistent with federal and state law on that date. -- Existing FCC authority over cable cross-ownership with other media is preserved. -- State and local governments may not prohibit ownership of cable systems based on ownership of other media. -- A franchising authority that acquires a cable system after a franchise is not renewed must pay fair market value as a going concern, unless a different valuation specified in the franchise. -- A franchising authority may acquire a cable system if the franchise is revoked for cause. Acquisition will be at an equitable price or at a valuation specified in the franchise. -- Programming on any cable system owned by a franchising authority must be selected by an independent body.
