Council Letter 532 Honorable Mayor and Members of City Council Subject: Support for the South East Texas Arts Council Recently, the Texas Commission on the Arts approved the submission of a State application to the National Endowment for the Arts for a project de- signed to benefit local arts agencies and arts organizations. The total proposed program package for the three-year period, beginning in fiscal year 1986, is $1,800,000. This request for federal funds will essentially allow the local arts council to use locally-appropriated funds as match for securing federal funds. Under present guidelines, the Texas Commission on the Arts would serve as the grant administrator and would interface with local recognized arts councils. The South East Texas Arts Council serves as the local arts agency for Jefferson, Orange and Hardin Counties. With respect to Beaumont, the Arts Council serves the much-needed role of assessing and ranking funding requests from the 46 local members of the Council . These requests are packaged and submitted to City Council as a routine part of the yearly budget process. In this past year, some $100,000 of Hotel-Motel Tax monies was ap- propriated for 16 local projects, plus the Arts Council . Our local arts organization is aggressively pursuing all possible alternate funding sources in order to be able to continue expanding the scope of its program. Support by the local governments within their service area will be of great benefit in this lengthy application process. It is recommended that this resolution be approved. June 1, 1984 Council Letter 531 Honorable Mayor and Members of City Council Subject: Emergency Medical Services Contract with City of Bevil Oaks The Emergency Medical Services function for the City of Beaumont, now operating as a separate line department reporting to Fire Chief Shelton, was first organized as an independent non-profit Corporation with an ap- pointed governing body. In January, 1984, the Corporation was dissolved and the City assumed control of this activity. In its first year of operation, the EMS board negotiated a contract with the Bevil Oaks community guaranteeing ambulance service to the area. This original contract is now up for renewal . The contract, for a base charge of $1,959 (approximately $1.50 per capita) essentially guarantees that an EMS ambulance will respond to a call from a Bevil Oaks resident. After extensive discussion with staff and Bevil Oaks, it is felt that the contract should be formally approved by the City for the following rea- sons: 1. Bevil Oaks is within our current five-mile limit of service. 2. The contract generates additional revenue for the ser- vice with no additional manpower or equipment. 3. The collection rate for Bevil Oaks residents has been excellent (100 percent) . 4. We have never had an unnecessary request for service in Bevil Oaks. 5. Only once have we had to refer an emergency call to another company because one of our units was responding to Bevil Oaks. In addition, the contract has a 30-day cancellation clause, allowing the City to terminate the contract in the event responding to Bevil Oaks be- comes a problem. Under present usage, with calls averaging slightly more than one a month, no problem is anticipated. A complete review of our rate structure with respect to Emergency Medical Services will be incorporated in our fiscal year 1985 budget discussions. It is recommended that this resolution be approved. Karl Nollenberger City Manager a ' NO R E S O L U T I O N BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF BEAUMONT: THAT the City Manager be, and he is hereby , authorized to execute a one year contract providing for the payment to the City of Beaumont of One Thousand Nine Hundred Fifty-Nine Dollars ( $1 ,959) by the City of Bevil Oaks to provide emergency medical services to Bevil Oaks. June 1, 1984 Council Letter 524 Honorable Mayor and Members of City Council Subject: Griffing Place Identification Wall License Mr. Earl J. Frost, representing Griffing Realty, Joint Venture, has re- quested a license agreement with the City of Beaumont for installation of it subdivision identification wall at the entrance to Griffing Place sub- division, as illustrated by the attached sketch. The proposed wall would bear the subdivision name for identification purposes and in conjunction with landscaping, be used to aesthetically enhance the area. The structure would be located on Griffing Boulevard near its intersection with Walker Road. It is necessary for the City to grant a license for this because of the fact that the subdivision identification wall will be located on public right-of-way. All costs for installation and maintenance would be borne by the Joint Venture. In addition, the City would be held harmless for all costs associated with the installation, maintenance, use and state of repair of the wall . The proposed wall is not anticipated to present any sight re- striction, access limitation, or hazard. In addition, the City or fran- chised utilities would have full access rights without liability for damages sustained by the wall . Provisions of the proposed license would allow cancellation of the license by the City with sixty days' written notice in which the Joint Venture would be required to restore the site to an acceptable condition. The Joint Venture has agreed to a one-time license fee of $250. It is recommended that this resolution be approved. Council Letter 528 Honorable Mayor and Members of City Council Subject: Issuance of Bonds for St. Charles Plaza Project The Beaumont Industrial Development Corporation has issued an inducement re- solution and adopted a bond resolution agreeing to finance $1,500,000 in in- dustrial development revenue bonds for the construction of the St. Charles Plaza Project, a shopping center located on Phelan Boulevard at Prutzman Road. The developers are Sam Parigi , Jr. ; Frank L. Messina; Frank G. Messina; .Joseph R. Messina; Jude T. Messina; Vincent M. Messina; Thomas L. Messina; and James M. Messina. The rules of the Texas Economic Development Commission and federal tax law require that the City Council hold a public hearing and approve the issuance of the bonds. The bonds will not be obligations to the City of Beaumont; the sole source of every payment will be revenues from the project. June 1, 1984 Council Letter 525 (Honorable Mayor and Members of City Council Subject: Airport General Service Agreements For several years, Professional Aviation Services Company, as well as Don and Celia Born, have operated at the Municipal Airport through Fixed Base Operator Agreements. These existing agreements provide direct services to pilots while the City provides facility improvements. In order to involve the Fixed Base Operators more closely with the operations of the Municipal Airport and to eliminate duplication of services, proposed service contracts were initiated with both operators. If the proposed contracts are approved, the position of Airport Superintendent (currently vacant) could be replaced with it clerical position. This clerical position will monitor Airport acti- vities and will also work on administrative matters relating to the landfil.l and transit functions. Three part-time positions could also be eliminated. The City will continue to provide administrative and clerical activities re- lated to the City responsibilities. These proposed contracts will provide general assistance and support to the public, the City, and other parties at the Airport and are separate agreements from the current Fixed Base Operator contracts. In general , the City will retain all authority for operations and rates pro- vided at the Airport; . P p t; Professional Aviation will provide administrative and facility maintenance services; and Don and Celia Born will provide field maintenance. The specific responsibilities of each Fixed Base Operator and the City are identified below: Professional Aviation Service Company 1. Maintain all administrative offices and telephone services relating to the Airport. 2. Represent the City in performing duties related-to leasing training room, T-hangars and contracts for vending machines. 3. Provide all custodial services for main terminal building, including purchase of equipment and supplies as needed for this service. 4. Provide minor maintenance services for main terminal build- ing and T-hangars up to $500 per event and represent the City, when authorized, to implement any Capital Improve- ments in excess of $500 per event. Council Letter 525 June 1, 1984 Page 2 5. Provide City with all records pertaining to services ren- dered. 6. Provide information on project and program planning and any incident of significance or public interest. 7. Provide public with all services, programs, and opport- unities available at Airport. 8. Support and promote air demonstration shows and other events at the Airport. 9. Post and distribute to City and other Fixed Base Operators all NOTAMS, letters, bulletins and other information from federal , state or local agencies. Don and Celia Born 1. Maintain all grounds, including mowing of properties and facilities, except main Terminal Building, T-hangars, in- cluding open space, runways, taxiways, grounds, landscaping, weed and insect control . 2. Provide maintenance of City vehicles. 3. Provide City with all records pertaining to services ren- dered. 4. Provide information on project and program planning, and any incident of significance or public interest. 5. Provide public with all services, programs and opportunities available at Airport. 6. Support and promote air demonstration shows and other events at the Airport. City 1. Establish all rates and charges for services and facility usage. 2. Pay for gas and electricity. 3. Maintain "waiting list" for T-hangar rental . :[n compensation for services provided in the contracts, the City will pay Professional Aviation Services Company $18,000 and pay Don and Celia Born $36,000 during the first year of the contract with predetermined annual increases during the terms of the contract. Either party may cancel the contract with 90 days' notice. Adequate insurance, maintenance and audit- ing provisions are also included in the contracts. Council Letter 525 June 1, 1984 Page 3 In the fiscal year 1984 City budget, $72,350 was allocated for the Municipal Airport within the administrative budget of the Urban Transportation Depart- ment. An additional $8,300 capital funds will have to be expended for the replacement of the wind tee directional vane, resulting in a total annual budget of $80,650. The approval of these contracts and the administrative savings will have a positive impact on the City' s fiscal year 1984 budget. The anticipated annual expenditures (including the capital project and con- tract payments) are $72,810, or a savings of approximately $7,840. Some of these savings are attributed to the vacant Airport Superintendent position. Although it is anticipated that the fiscal year 1985 expenditures will be comparable to expenditures in fiscal year 1984, the net effect of these changes will result in improved Airport services. It is recommended that this resolution be approved. June 1, 1984 Council Letter 523 Honorable Mayor and Members of City Council Subject: Payment for Rental of Bulldozer On December 30, 1983, it was necessary to rent a bulldozer to accomplish excavation on the new landfill . The Fiat Allis dozer belonging to the City was rendered inoperative due to internal engine problems. The rental was necessary to accomplish the construction of the cells at the landfill in a timely manner to meet deadlines and to adhere to regula- tory specifications. Plains Machinery Company, Equipment Headquarters and Mustang Gractor and Equipment Company were contacted in an effort to locate a D-6 or larger dozer. The only adequate machine available was rented from Mustang Tractor and Equipment Company. The rental machine was returned on February 17, 1984, when the City' s machine was repaired. The monthly rental on the Caterpillar D-6 is $4,800.00 plus $104.65 for insurance. The weekly rental amount is $1,600.00 plus $104.65 for in- surance. The total invoiced amount due is $8,153.95, to be charged against Urban Transportation's Lease and Rental account. Due to a misunderstanding in the rental of this dozer, equipment services in excess of $1,000.00 was acquired without prior approval of the City Council . The City now has a contract with another company to provide this service. It is recommended that payment of this invoice to Mustang Tractor and Equipment Company be approved. Eight Thousand One Hundred Fifty-Three Dollars and Ninety-Five Cents ( $8, 153. 95) for rental of a bulldozer used at the new landfill. June 1, 1984 Council Letter 530 Honorable Mayro and Members of City Council Subject: Formation of Regional Marketing Organization The John Gray Institute hosted a Futures Conference on May 9th and 10th of this year. It was a consensus of this conference that coordination of public and private initiatives to promote economic development in the three- county area (Jefferson, Orange and Hardin Counties) is needed. To' compete effectively with other regions, a unified marketing will be essential. It is intended that existing staff and financial resources in the region will be utilized with the guidance of a new organization before resorting to new staff or additional financing. The purpose of the Regional Marketing Organization is to coordinate regional marketing of the Beaumont-Orange-Port Arthur area for purposes of economic development and jobs. The umbrella organization will : 1. Assure coordination of regional information, advertising and mailings. 2. Conduct external marketing of the region including prepara- tion of promotion materials, coordinating equitable distri- bution of inquiries and referrals, maintaining suitable listings and information for industrial and commercial re- cruitment. 3. Serve as a continuing forum for dialogue among individuals and organizations concerned with economic development. The City of Beaumont will be designated as a member of the organization. Initially, Gulf States Utilities Company has agreed to serve as a clearing- house for responses to advertising and concurrent dissemination of informa- tion. This concept is certainly supportive of Council policy with respect to economic development in this area. It is recommended that a resolution endorsing this concept be approved. Karl Nollenberger City Manager r � R E S O L U T I O N WHEREAS, the Mid-South Jefferson County Economic Develop- ment Corporation wants to take new directions and improve the overall economic base of the Golden Triangle; and, WHEREAS, the City of Beaumont wishes to communicate a sense of urgency and necessary action to all individuals , groups and businesses in the Golden Triangle; and, WHEREAS, there is a need to coordinate marketing efforts to promote: a) the Jefferson County Airport; and, b) the ports of the Golden Triangle and their iminent designation as a foreign trade zone; and, WHEREAS, these marketing and public relation efforts will represent a common interest shared by everyone in the Golden Triangle; and, WHEREAS, many privately owned companies have already contributed substantial sums for economic development; and, WHEREAS, both the airport and the port facilities are publicly operated and maintained; and, WHEREAS, every citizen in the Golden Triangle would benefit from the investment in a promotional effort; and, WHEREAS, these facilities represent a significant hope for improving the tax base to the individual cities through job creation; and, WHEREAS, although public budgets are strained, there is nevertheless a need to " INVEST" tax dollars in the future of our combined area; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF BEAUMONT: THAT the City of Beaumont supports the Mid-South Jefferson County Economic Development Corporation in its proposed coordinated regional marketing and public relations effort for the Jefferson County Airport and the ports of the Golden Triangle. Section 4 . The following structures are hereby ordered to be demolished and removed by the City of Beaumont on the account of the owners thereof and such expense of demolition and removal shall be assessed as a special tax against the properties upon which the buildings are situated. Council Letter 527 Honorable Mayor and Members of City Council Subject: Food Service Establishment Fee Structure In September, 1983, Council adopted a new fee structure for the 1983-84 budget year for food service establishments licensed and inspected by the Health De- partment. Council had charged the Health Department to propose new fees that would basically recover the City's cost of providing those licensing and in- spection activities. Prior to the adoption of those new fees last September, it had been some 25 years since the Health Department had proposed raising the fees for providing this regulatory activity. It is an attempt to recover at least the cost of per- sonnel time through the licensing process. This is in accordance with the Council Letter 527 June 1, 1984 Page 2 City revenue policy which states that, "The City will establish all user charges and fees at a level related to the cost of providing the services for all programs except those oriented at the youth population and the senior citizens". The fees include only personnel costs and do not include the costs of supplies, overhead, or other costs. They are based on the Health Department conducting inspections of most food service establishments every two or three months. Personnel costs were calculated as follows: Average number of inspections per year: 6 Average time per inspection: 1 hour, 45 minutes Total manhours: 10.5 Average Sanitarian salary: $9.85/hour Average cost per establishment: $103/year In accordance with its adopted fiscal revenue policy, On January 7, 1984, Council amended the fee structure to allow a 50 percent discount to non- profit organizations primarily serving youth or senior citizens. At this time, there are approximately 17 licenses establishments which fall into this youth or senior citizen category. Our records do not reflect the total number of non-profit organizations that are licensed in the City. The re- venues collected from these 17 establishments total approximately $1,228 per year. Revenues collected from all food permits total approximately $59,000 per year. With respect to Halfway Houses, our records indicate that there are eight such establishments operating in the City. These privately-operated,erated non- profit p rofit c r P o r ations generate approximately $655 P er Y ear in revenues. A new fee category licensing "special events", such as the food concessions at the South East Texas State Fair, the Food and Heritage Festival and other such events was also later established, based on the rate of $200 for the first day and $100 for each succeeding day to the sponsoring organization. This fee structure, in most cases, actually represented less licensing ex- pense than if individual booths had to pay the temporary permit fee. Council also adopted an amendment to the ordinance which provided for ex- emption from licensing and inspection requirements for non-profit organiza- tions which prepare and/or serve only non-potentially hazardous baked goods. This amendment was adopted on February 14, 1984. N Council Letter 527 June 1, 1984 Page 3 In February, 1984, Council adopted a new Food Service Sanitation Code to comply with State and Federal law and rules in existence since 1976. Pre- viously, the City of Beaumont had operated under a 1962 Code. The Health Department is responsible for protecting the health of the public and preventing disease outbreaks and other health concerns from arising. One of the means of accomplishing this is through licensing and inspection efforts to insure that various business concerns fully comply with State and local laws and regulations. Proper food preparation, sanitation and control by restaurants and temporary providers alike are essential to prevent the occurrence of food-borne disease outbreaks. The current fee structure re- covers the major portion of City costs in providing this protection. Karl Nollenberger City Manager W/S June 1, 1984 2. Council Letter 526 Honorable Mayor and Members of City Council Subject: Adoption of the 1984 Edition of the National Electrical Code The City of Beaumont, within the routine and normal inspections that are performed by our Department of Building and Housing Services, Building Inspection Division, utilizes as a guide the National Electrical Code. This Code is normally adopted by City Council and is then utilized by the electrical inspection staff in its normal routine regulatory functions. Every three years, the National Electrical Code is updated with all amendments that are felt necessary in order that the Code remain current with the changes in technology and procedure. These revisions and/or changes are then submitted to local regulatory bodies for review and acceptance. Our local procedure calls for these changes to be reviewed by the Electrical Board of Review and our departmental staff. In addition, the amendments are then discussed in work shop settings with all interested local contractors and/or suppliers. The process as described above has now been completed and all parties are in general concurrence that the 1984 National Electrical Code should be adopted for use by the City of Beaumont.
