Hear citizens. Recess. RECONVENE FOR WORK SESSION. April 16 , 1984 1. Council Letter No. 444 Honorable Mayor and Members of City Council Subject: Annexation of 120 . 4 acres located at the intersection of Florida Avenue and the Beaumont City Limits line. In the City' s adopted Comprehensive Land Use Plan, specific areas are identified as having growth potential for the city. Those areas fitting these criteria which are outside of the City Limits , principally on the western edge of the city, are likely locations for future annexations . After the adoption of the Land Use Plan in August of 1982, the City' s posture in annexing these areas has been strictly at the request of the individual land owners. State statutes require that areas annexed into a city ' s corporate limits must be serviced with municipal utilities within three years of the annexation date. In addition, since most of these areas are within the City ' s extra-territorial jurisdiction, State statutes also authorize the City to review all subdivision plats. The current requirement for annexation is two public hearings before the Planning Commission and City Council in order that any residents of the area proposed for annexation may voice their opinions in favor of or in opposition to the annexation. The applicant, Mr. Joe Zerangue, owner of Drilco Well Services, has requested the annexation in order to maintain the water and sanitary sewer service which he is currently receiving from the City. His business is located upon the subject property which is generally west of Cardinal Drive on the south side of Florida Avenue. Shduld the subject land be annexed, the following basic scope of services would be provided: Water Service. The subject property would be provided with water service from the extension of a 6 and 8-inch water line to be extended from existing lines located in Florida Avenue. Sanitary Service. The subject property would be provided sanitary sewer service from a 36-inch force main which would tie to existing facilities within the city limits . Page 2 - Storm Drainage. All developments within the proposed annexation area will be addressed according to specifications from the City Engineer ' s Office. Storm runoff from all new development will be accepted into the Usan Street ditch which runs southward towards Cardinal Drive then south within the proposed annexation site. Additional storm drainage for the proposed landfill site will occur from an existing ditch running north/south along the eastern boundary of the sewage treatment plant. Solid Waste Collection. Solid waste collection will follow the normal pattern for commer- cial areas. Fire Protection . Fire protection would be provided by Stations #3 and #10 at Ken- neth and Brockman and 3855 Washington Boulevard, respectively. Police Protection. Normal police patrol service will be provided for the annexed property. This area falls into police patrol districts 4 and 5 . Maintenance of Publicly Dedicated Community Facilities. Dedicated Streets : Streets which will be dedicated by way of subdivision plat will be maintained by the City upon acceptance by the Director of Public Works as per the normal procedure. Dedicated naarks or playgrounds : Any lands intended to be dedicated for recreational purposes will receive individual review by the Director of Parks and Recreation as well as the Planning Depart- ment to see that they are consistent with the City' s Comprehensive Park and Open Space Plan prior to their acceptance . Street Lights . Street lights in new platted subdivisions within the annexed area are to be provided at the developer' s expense as per the re- quirements of the current Street Light Ordinance. The locations are determined by the Traffic Department in conjunction with Gulf States Utilities. ENTITLED AN ORDINANCE ANNEXING THE HEREINAFTER DESCRIBED TERRITORY TO THE CITY OF BEAUMONT, JEFFERSON COUNTY, TEXAS, AND EXTENDING THE BOUNDARY LIMITS OF SAID CITY SO AS TO INCLUDE THE SAID PROPERTY WITHIN THE CITY LIMITS, AND GRANTING THE SAID TERRITORY AND TO ALL FUTURE INHABITANTS THEREOF ALL OF THE RIGHTS AND PRIVILEGES OF OTHER CITIZENS; AND BINDING SAID FUTURE INHABITANTS BY ALL OF THE ACTS AND ORDINANCES OF SAID CITY. WHEREAS, a public hearing was held concerning the proposed annexation of the territory described in Exhibit "A" attached hereto for all purposes. Said public hearing was held on March 19 , 1984. At the public hearing, all interested persons were provided an opportunity to be heard; and, WHEREAS, such public hearing was held not more than forty ( 40) days nor less than twenty ( 20) days prior to the institution of annexation proceedings; and, WHEREAS, notices of such public hearing was published in the newspaper having general circulation in the City of Beaumont, Texas not more than twenty ( 20) nor less than ten ( 10) days prior to such hearing; and, WHEREAS, the territory lies adjacent to and adjoins the present boundaries of the City of Beaumont, Texas; NOW, THEREFORE, BE IT ORDAINED BY THE CITY OF BEAUMONT : Section 1 . THAT the land and territory lying adjacent to and adjoining the present boundaries of the City of Beaumont, Texas and described in Exhibit "A" attached hereto and made a part hereof for all purposes, is hereby added and annexed to the City of Beaumont, Texas; said territory shall hereinafter be included within the boundary limits of the City of Beaumont, Texas; the present boundary limits of such City at the various points contiguous to the area hereinafter described in Exhibit "A" , are altered and amended so as to include said area within the corporate limits of the City of Beaumont, Texas; such property shall be within Ward 2 for purposes of municipal elections. He currently owns all land between the proposed area and the existing City Limits line, generally west Of Major Drive between Dishman Road and Manion Drive. Should the subject land be annexed, the following basic scope of municipal services would be provided: Water Service. The subject property would be provided with water service from the extension of a 24-inch water line (FM 364) . located in Major Drive Sanitary Sewer Service . The subject property would be provided sanitary sewer service from.a 54-inch force main which would tie to existing facilities within the city limits . Page 2 Storm Drainage. All development within the proposed annexation area will be addressed according to specifications from the City Engineer ' s Office. Study boundaries are the Caldwood cut-off- ditch on the west, Maitland, and generally all properties more than 700 feet north of College on the east and west sides of Lind- Bergh and Chamberlin. All of the property in the study is zoned R-3 . Surrounding zoning is LI on the north and west, HI on the east and GC-MD on the south. Three distinct areas demonstrate varied land use patterns. AREA l: (properties on Jeny and Tina Lanes) Existing land use is single family residences. Additionally, the administrative offices for Drainage District #6 are located on the southwest corner of this area. AREA 2 : (properties fronting on the east and west sides of Lindbergh and at the intersection of College and Lindbergh) Mixed land uses exhibited. These include a gas station, jewelry store, motel, drive-in grocery, liquor package store, copy shop, day care and video store . AREA 3 : (properties which are near the intersection of Maitland and Chamberlin) Some residential uses exhibited. Properties east of Chamberlin on the north side of Maitland have frontage on unimproved right-of-way and face Southern Pacific railroad holding yards. Staff conducted a land use inventory of the study area. Proposed rezoning is based on (1) exhibited land uses; (2) changing district boundaries on platted lot lines ; (3) having similar districts fronting into each other; and (4) creating a transition pattern where possible. PLANNING STAFF RECOMMENDATION Based on the criteria listed above, staff proposes the following: AREA 1: RS (Residential Single Family) . Most properties on Wall , Jeny and Tina Lanes. AREA 2: GC-MD (General Commercial - Multiple Dwelling) . All properties on the northwest corner of Lindbergh and College and extending 700 feet north and 400 feet west respectively. AREA 3 : CM (Commercial Manufacturing) . All other properties in the study on both sides of Lindbergh and Chamberlin. Section 2. That in all other respects the use of the property hereinabove described shall be subject to all of the applicable regulations contained in Chapter 30 of the Code of Ordinances of Beaumont, Texas, as amended. Section 3 . That if any section, subsection, sentence, clause or phrase of this ordinance, or the application of same to a particular set of persons or circumstances, should for any reason be held to be invalid, such invalidity shall not affect the remaining portions of this ordinance, and to such end the various portions and provisions of this ordinance are declared to be severable. Section 4 . That all ordinances or parts of ordinances in conflict herewith are repealed to the extent of the conflict only. Section 5 . North of the request across Dollinger the only land use is Dollinger Steel Co. The two tracts in the study have frontage on Seventh Street and access to Interstate 10. The eastern tract has access to the Santa Fe Railroad. The tracts total 17. 46 acres. j The comprehensive plan designates the area as a Conservation and Revitalization Area. April 20, 1984 Council Letter 451 Honorable Mayor and Members of City Council Subject: Crockett Connector Right-of-Way Acquisition On March 13, 1984, the City Council passed a resolution authorizing pro- ceedings in eminent domain for Parcel 4 of the Crockett Connector Project which is located on the northeast corner of Laurel Avenue and James Street and illustrated by the attached drawing. The title company employed by the City would not issue a title policy on the property because of certain legal irregularities and procedures at the time the present owner acquired the property by sheriff's sale. After Council 's March 13th action, the property owner contacted his in- surance company, the American Title Insurance Company, the company which issued the original title policy, subsequent to the sheriff's sale. The opinion of American Title Insurance Company is that the title is good and marketable and has agreed to issue, in favor of the City, a title policy for that portion of Lots 7, 8 and 9, Block 20 of Calder Addition, to be purchased by the City for right-of-way purposes. The owner of the pro- perty, Mr. J. R. Samford, has agreed to accept the appraised value of $43,593. April 20, 1984 Council Letter 453 Honorable Mayor and Members of City Council Subject: Purchase of Specialized Sprayer for Chemical Application As a part of the City's expanded effort in weed control , the Parks Department is securing materials and equipment necessary for that effort. On April 3rd, some $12,700 of various types of approved chemicals were purchased by Council action. The departmental staff has spent a great amount of time over the past several months in analyzing the various types of sprayers on the market and in dis- cussing this complex and potentially hazardous process with other munici- palities, as well as county and state agencies. Specifications for a sprayer were secured from the Texas Department of High- ways and Public Transportation. Essentially, the specifications call for a computerized chemical injection system that utilizes a variable R.P.M. in- jection pump that can change the rate of injection depending on the amount of electric current supplied or allowed by the computerized control . In ad- dition, the injection system allows the user to carry the chemicals in separate, closed tanks on the unit, and enables the operator to "mix" ap- plications, using different chemicals. Bid packets were sent to 13 vendors and only one bid was received, that of Cibolo Manufacturing Company in Jourdanton, Texas, in the amount of $23,875. While it is apparent that no other manufacturer is producing a unit such as was specified, the departmental staff feels strongly that this piece of equipment is the best and safest unit for their application. The Jefferson County Mosquito Control District and the local Highway District are using five of these units at present. It is recommended that this resolution be approved. April 20, 1984 Council Letter 455 Honorable Mayor and Members of City Council Subject: College Street T.I.P. Project Approximately 30 parcels of land for right-of-way purposes will be needed for the College Street T.I.P. Project. College Street will be widened to four lanes from Main Street to 11th Street with a continuous left-turn lane provided from Pearl Street to Neches Street, from Avenue A to Avenue C, and from 4th Street to 11th Street. The curve at the railroad between Avenue G and Amarillo will be flattened to comfortably accommodate 35 mile-per-hour traffic. The project also includes realignment of the north side of 8th Street to produce a safer and clearer operation. Right-of-way from Pearl to Trinity will be acquired from the north side of College and right-of-way will be acquired from the south side of College from Victoria to Avenue D. With the exception of one parcel , the right-of-way required will be ten feet or less in width. One parcel at 8th Street will require a triangular tract fronting approximately 50 feet on College Street and approximately 150 feet on 8th Street. The construction project was authorized as a part of the 1980 Transportation Improvement Program (T.I.P. ) for which the sale of $33 million in bonds was approved. The most recent estimate on this particular project is $2,800,000. Title opinions will be required to ascertain ownership, and title policies will be required to insure legal title to the property acquired for right- of way purposes. It is estimated that the cost of these services will be approximately $6,500. Proposals were requested from title companies in- terested in providing title services for City projects. Replies were re- ceived from three companies, Stewart Title Company, Neches Title Company and Jefferson County Title Company. Since title companies are regulated by the State Insurance Board, charges by all companies are based on the pur- chase price of the property acquired. It has been our practice to rotate the title work among those companies that possess the necessary professional expertise. Stewart Title and Jefferson County Title Company have been utilized on recent City projects. Therefore, it is this Department's re- commendation that Neches Title Company be employed on this project. It is recommended that this resolution be approved. April 20, 1984 Council Letter 454 Honorable Mayor and Members of City Council Subject: Contract Amendment with Mental Health Mental Retardation for Grounds Maintenance In October, 1983, a contract was approved with Mental Health Mental Retardation of Southeast Texas for the grounds maintenance of Riverfront Park, the Civic Center, City Hall , the Julie Rogers Theatre, Tyrrell Historical Library, Beaumont Public Library, Police Station, Orleans Mall , various triangles and boulevards and the Athletic Complex and Tennis Center. This contractural arrangement allowed a minimum savings in this year of $47,000. All Park Department employees affected by this work reduction were relocated in other departments. One of the areas identified as a high City priority in the Clean Community effort is a greater emphasis in litter abatement in the downtown area, defined as the area between College and Calder and Main and Neches. The existing contract with Mental Health and Mental Retardation can be amended to include these areas at a cost of no more than $2,000 per month. Our existing contract is for a year, beginning October 1, 1984 and terminating September 30, 1985. The maximum increase of $10,000 for five month's service, from May 1st, will increase the total contract amount to $171,672. The monies for this increased contract are available in the operating budget of the Parks Department. This expansion is in line with a total community effort in improving the image and perception of this City. April 20, 1984 Council Letter 456 Honorable Mayor and Members of City Council Subject: Wellness Program Educational Contract One of the key components of the City' s new Employee Wellness Program is the capability to conduct appropriate educational sessions for City employees to raise their knowledge and awareness of health habits that impact on their health. Hopefully, such education will motivate employees to change their behaviors and enroll in intervention efforts and organized opportunities with other employees to successfully change those ingrained habits. The Health Department has made arrangements to utilize a state and national award-winning health promotion program developed by Brackenridge Hospital in Austin to give us the capability to offer such educational sessions in- house. Execution of a contract would designate our City Health Department as an authorized user of all materials and training programs developed for Brackenridge Hospital 's "Choices" program. Brackenridge would also train in- structors for the effort. The Health Department has the $2,000 cost for the material in its current operational budget. The contract would provide annual renewal of the agreement and the capability to offer the program eventually to the citizens of the community. This program should prove to be one of the cornerstones of our Employee Wellness Program. It is recommended that the resolution authorizing the City Manager to enter into a contract with Brackenridge Hospital be approved.
