February 3, 1984 Council Letter 299 Honorable Mayor and Members of City Council Subject: Traffic Signal Agreement The State Department of Highways and Public Transportation has applied to the Federal Highway Administration and has received funding to install a signal at S.H. 124 (Fannett) and U.S. 69 frontage roads. The funds received are from the Federal Highway Administrations 's 1983 Highway Safety Improve- ment Program. These funds are used for improvements at locations with a high accident history for the previous three years. The State will furnish funds for preparation of plans and specifications, construction, and will be responsible for the installation. The City will maintain the signals after installation. This signal will be interconnected with the proposed signal installation at S.H. 124 and Lafin Road. The sig- nal at Lafin will be installed and maintained by the City. It is recommended that the City Manager be authorized to execute an agree- ment in which the City will have responsibility for maintenance after con- struction. February 3, 1984 Council Letter 307 Honorable Mayor and Members of City Council Subject: Dowlen Road T. . I.P. Project Final Payment On April 27, 1982, the City of Beaumont awarded a contract to Troy Dodson Construction Company in the amount of $2,877,277 for the construction of Dowlen Road from Calder Avenue to College Street. The project included an overpass across the combined Southern Pacific Transportation Company and the Missouri Pacific Railroad Company tracks. The roadway has been constructed as a four-lane concrete curb and gutter with protected left-turn lanes at Calder and College Street. Also included in the project was Calder Avenue reconstruction between Long Road and Marceline and the addition of a double left-turn lane for southbound Dowlen Road traffic at Phelan Boulevard. Completion of this project provides a four-lane arterial from Concord Road to College Street. Two Change Orders were approved by City Council on this project. Change Order No. 1, approved December 28, 1982, authorized modifications to the traffic railing at a saving to the City of $11,980.50. Change Order No. 2, approved May 10, 1983, authorized a payment of $5,000 to maintain a traffic detour at the intersection of Calder and Dowlen Road. The two Change Orders resulted in a revised contract cost of $2,870,296.50. The final construction cost of the project to the City is $2,889,601.63, a 0.67 percent overrun. The $19,310. 13 overrun can be attributed to minor differences between esti- mated plan quantities and actual measured quantities of work done. The Engineering Division has inspected the project and found that it has been satisfactorily constructed in accordance with plans and specifications. Final payment in the amount of $158,240.04 to Troy Dodson Construction Company is now due. It is recommended that a resolution authorizing final payment be approved. February 3, 1984 Council Letter 297 Honorable Mayor and Members of City Council Subject: Speed Limit Change on Keith Road between Calder and College The City has received several requests to raise the existing 30 mph speed limit on Keith Road between Calder and College. A speed and accident study was conducted and the results show that the existing speed limit is not reasonable. Approximately 96 percent of the drivers exceed the posted 30 mph speed limit from 5 to 27 mph. There have been two accidents in the last three years along this street; neither accident was speed-related. Drivers ' traveling speeds are influenced by four general conditions. These include the physical characteristics of the roadway and its roadsides; the weather; the presence of other vehicles; and speed limitations. While one of these may govern at any given time, the effects of these conditions are almost always combined. An approximately uniform speed is generally the aim of all drivers. The generally accepted methods of setting speed limits include the 10 mph pace and 85 percent speed. The pace is a speed range of 10 mph which contains the largest number of observations. The 10 mph pace speed on Keith Road is 40 to 50 mph for northbound and 39 to 49 mph for southbound. The 85 percent speed is that speed in which 85 percent of the unimpeded drivers are traveling. The 85th percentile speed on Keith Road is 49 mph for northbound and 47 mph for southbound. Normally, the speed limit selected should not vary more than 7 mph below the 85th percentile speed. In addition, the speed limit should be to the nearest 5 mph value. Based on this information, it is the recommendation of our traffic engineers that the speed limit on Keith Road be changed from 30 mph to 40 mph.. It is recommended that this ordinance be approved. ENTITLED AN ORDINANCE AMENDING CHAPTER 26 , SECTION 26-23 OF THE CODE OF ORDINANCES OF THE CITY OF BEAUMONT TO ESTABLISH A MAXIMUM SPEED LIMIT ON KEITH STREET; PROVIDING FOR SEVERABILITY; PROVIDING FOR REPEAL AND PROVIDING A PENALTY. BE IT ORDAINED BY THE CITY OF BEAUMONT: Section 1 . That Chapter 26 , Section 26-23 of the Code of Ordinances of the City of Beaumont be, and the same is hereby amended to add the following maximum speed limit on Keith Street: Direction Maximum Street Limits of Travel Speed Keith Between Calder and College North 40 South Section 2 . That if any section, subsection, sentence, clause or phrase of this ordinance, or the application of same to a particular set of persons or circumstances, should for any reason be held to be invalid, such invalidity shall not affect the remaining portions of this ordinance, and to such end the various portions and provisions of this ordinance are declared to be severable. Section 3 . That all ordinances or parts of ordinances in conflict herewith are repealed to the extent of the conflict only. Section 4 . That any person who violates any provision of this ordinance shall, upon conviction, be punished as provided in Section 1-8 of the Code of Ordinances of Beaumont, Texas. February 3, 1984 Council Letter 306 Honorable Mayor and Members of City Council Subject: Final Payment for Gorman Street Bridge Replacement and the Hille- brandt Bayou at 23rd Street Crossing Project On May 3, 1983, the City awarded a contract to Saucier and Sons Enterprises, Inc. , in the amount of $156,130.29 with 60 working days to complete the pro- ject. The project has been completed after 70 working days at a cost of $147,795.09, which is $8,335.20 (5.3 percent) below the contract price. This underrun is due to variations in quantities used as a result of field changes made at the request of the contractor. The Engineering Division has inspected the project and it was found to have been satisfactorily constructed according to the revised plans and specifi- cations. Liquidated damages of $2,100 were assessed for the 10-day overrun on the project. Saucier and Sons Enterprises, Inc. , is now due final pay- ment of $6,855.94. It is recommended that a resolution authorizing final payment be approved. February 3, 1984 Council Letter 307 Honorable Mayor and Members of City Council Subject: Final Payment for Lafin Road Project On August 9, 1983, the City of Beaumont awarded a contract to Trotti and Thomson in the amount of $259,891 for the Lafin Road Project. The project has been completed at a cost of $261,501.75, which is $1,610.75 (0.6 percent) above contract price. This overrun is due to variations in actual quantities used. The Engineering Division has inspected the project and it was found to have been satisfactorily constructed according to the plans and specifica- tions. Trotti and Thomson is, at this time, due final payment of $13,075.09. It is recommended that a resolution authorizing final payment be approved. On item B-7, the hydrogen peroxide, we chose to use a local vendor for ease of supply. On items in Section H, the apparent low bidder failed to meet specifications in that he bid a foil instead of the required plastic tape. February 3, 1984 Council Letter 312 Honorable Mayor and Members of City Council Subject: Resolution Authorizing Purchase of Treasury Bond Interest Coupons This resolution will authorize the City to purchase interest coupons stripped off U.S. Treasury bonds maturing in future years. These coupons, which are a promise by the U.S. Treasury to pay the face value at maturity, are sold at a discount value and we will use them in our sinking funds for debt service. We plan at this time to purchase face value of coupons somewhat in excess of $600,000 at a price of $500,000, which will mature on February 15, 1986. The February 15th date is significant in that on March 1, 1986, we have principal and interest maturities from our debt service funds of $1.6 million. These coupons will be used to fund a portion of that maturity. The advantages of this investment are two-fold. First, as we currently anticipate holding these coupons to their maturity, the market risk of interest rates fluctuat- ing higher causing the principal balance to decline is eliminated. Secondly, should interest rates decline, the value of these coupons will increase to the present value based on a lower discount rate. This will enable us, should it be deemed advisable, to sell these coupons prior to their maturity and earn a capital gain on our funds. After funding through this vehicle some of the more near term maturities, we anticipate using this same investment vehicle to start funding maturities out through 1998 when all of our current bonds will be retired. The ad- vantage in doing this would be that we will be able to buy those coupons at such a large discount that we will be paying for the maturities at less than 25� on the $1.00. The rate of return on these investments compares favor- ably with other instruments and provides an opportunity for better longer term yield when balanced with other needs in our investment portfolio. It is recommended that this resolution be approved. This system will provide lighting on U.S. 69 main lanes. The lights will be staggered be- tween the east and west sides of U.S. 69 at a spacing of approximately 400 feet. The State will furnish funds for preparation of plans and specifications, construction, and will be responsible for the installation and maintenance of the system. These machines will be located at the Water Utilities and at the Fleet Service Center for the crews that operate out of these areas. One ice machine and the bin will be paid for out of monies appropriated for construction of the Service Center. The other machine will be bought from the Water Utilities operating budget. It is recommended that this resolution be approved. Council Letter 309 Honorable Mayor and Members of City Council Subject: Highland Avenue Project On October 6, 1983, the City Council authorized the City Manager to execute an agreement with the firm of Fittz and Shipman, Inc. for engineering ser- vices in connection with the Highland Avenue T. I.P. Project. The project extends from Florida Avenue north to Alma Street. Fittz and Shipman, Inc. is now nearing completion of the preliminary phase of the project. The preliminary phase includes a review of conditions and problems related to existing roadway, sidewalk, driveway, drainage, utility, landscape and other concerns. As part of this process, a public meeting was held on January 11, 1984, in which citizen input was received. Following the re- view and public meeting, the engineers submitted proposed improvements in each of these areas. The following is a summary of the findings and recom- mendations of the preliminary phase. - Roadway - The current roadway is a 37-foot curb and gutter street, except in the vicinity of South Park High School , where the existing pavement is 45 feet wide. Proposed im- provements include widening of the 37-foot sections to 45 feet and placement of an asphaltic concrete overlay to pro- vide a basic four-lane roadway. In addition, the improve- ments include widening to five lanes at the intersections of Highland Avenue and Florida Avenue and Lavaca Street. This widening will provide left-turn lanes on Highland Avenue and require purchase of approximately five feet of right-of-way on both sides of the project, impacting ap- proximately 30 parcels. - Sidewalks - Sidewalks generally exist on Highland Avenue from East Virginia Street to the north. Sidewalks are proposed for both sides of the project along its entire length. Existing sidewalks will be utilized where possible. - Driveways - Current driveways will be replaced as necessary with concrete from the gutter to the right-of-way line. Construction will be directed toward the public's needs and provision of safe and smooth traffic flow. Council Letter 309 February 3, 1984 Page 2 Drainage - An underground storm sewer serves the project from approximately Alma Street to Anchor Street. Under- ground storm sewers are also utilized near intersections with East Virginia and Florida Streets. The south end of the project, from approximately East Virginia to Florida Street, is serviced by open ditches. Proposed improvements include new inlets where widening is proposed and storm sewers in the section from East Virginia to Florida. Utilities - Both overhead and underground utilities will require adjustments to match the proposed roadway improve- ments. The replacement of a six-inch cast iron water line with an asbestos cement water line from Shell Street to East Virginia Street is the only anticipated City utility improvement of signifinance. Landscape - Landscaping efforts near South Park High School , Pietzsch Elementary School and Alice Keith Park have pro- duced scenic rows of large oak trees. These trees are close to, but outside of the right-of-way line and will be pre- served. The estimated cost of the proposed improvements is $1,080,000, as itemized below, for the project. Construction $ 886,000 Surveying, Engineering and Inspection 170,000 Soils and Materials Testing 14 000 Right-of=Way 10,000 Total $1,080,000 At Council Work Session on Tuesday, a review of the project will be presented for discussion. Council Letter 314 Honorable Mayor and Members of City Council Subject: Adoption of 1976 Rules on Food Service Sanitation The City of Beaumont currently operates under the 1962 edition of the U.S. Department of Health Model Food Service and Sanitation Ordinance, adopted by the City in 1972. We are proposing the adoption of an updated food code; specifically the 1976 State Rules on Food Service Sanitation. We propose that these rules be adopted by reference with some modifications to meet specific needs of our City. This code has been designed to insure that sanitary food is served in food service establishments. It incorporates new technical knowledge and recognizes the changes which have taken place in methods of food preparation and service. This proposed ordinance amends the definition of food service establishments to specifically exempt non-profit organizations which are preparing and/or serving only non-potentially hazardous baked goods. It includes a new definition for adulterated food, potentially hazardous food, regulatory authority, and special event food service establishments. The existing grading and placarding system is modified by the proposed code. In place of the current system of Grade A, B or C, will be a system whereby the establishment will receive a placard stat- ing that the sanitary conditions of the establishment are either an "average rating" or an "above average rating". This ordinance adopts by reference the Texas Department of Health Division of Food and Drugs, "Food Service Establish- ment Inspection Report Form". This form is based on a one hundred point de- merit system instead of the 298 point system that is now used. The adoption of this inspection form will make possible the standardization of inspections. Traditionally, food establishment inspections have tended to be too subjective. The use of this form should help to correct this problem. Some of the changes in the proposed ordinance from the existing code include a requirement that food establishments contact the regulatory authority in the event of an emergency occurrence such as a flood, fire or power outage which could result in the contamination of food or which could prevent food from being maintained at proper temperatures. It also requires pre-operational in- spections by the regulatory atuhrity for all new facilities. The proposed code provides that foods which are unsound or contain any filthy, decomposed, or putrid substance or are otherwise safe may be condemned by the regulatory authority. . ,. Council Letter 314 February 3, 1984 Page 2 Another change in the proposed ordinance includes specific requirements for mobile food units. It also requires increased lighting in the working areas of food establishments and protective light shields over artificial lighting fix- tures which are located in areas where food is prepared or stored. The proposed code specifically prohibits the installation of grease traps in food preparation and utensil washing areas. It also prohibits the reuse of soiled tableware by self-service customers. The storage of food and equipment in restrooms is prohibited. Personal medications are prohibited from being stored in food storage, preparation, or service areas. The code provides that poisonous or toxic materials must be stored and located to be physically separated from each other and from food and equipment. This code prohibits the use of steam tables, warmers, or similar hot food holding facilities for the rapid reheating of potentially hazardous foods. Another change from the existing code includes new temperature requirements for reheating potentially hazardous foods. A test kit is required when chemicals are used for manual sanitizing of utensils and equipment. The pro- posed ordinance also provides specific requirements for dishwashing machines which use chemicals for sanitization. There are numerous other technical changes incorporated in this code which re- flect the changes which have taken place in the food industry, such as the recognition of the use of microwave ovens. Sound and updated regulations are essential for an effective food protection program. We feel that this proposed code will enable the City to develop a more effective sanitation program and to maintain a higher level of food pro- tection in food-service operations.
