HomeMy WebLinkAboutORD 06-040 ORDINANCE NO. 06-040 ENTITLED AN ORDINANCE TO APPEAL THE DECISION OF THE HISTORIC LANDMARK COMMISSION FOR THE PROPERTY LOCATED AT 2501 HAZEL STREET, BEAUMONT, JEFFERSON COUNTY, TEXAS. WHEREAS, Yvonne Sharpton made a request for a certificate of appropriateness to allow a pre-fab metal carport/storage building for property located at 2501 Hazel Street, Beaumont, Jefferson County, Texas; and, WHEREAS, after conducting a public hearing and hearing the evidence concerning the application, the Historic Landmark Commission voted to deny the request; and, WHEREAS, pursuant to the ordinances of the City of Beaumont, the applicant, Yvonne Sharpton, has filed an appeal of the decision of the Commission to the City Council for the City of Beaumont. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BEAUMONT: THAT the Council considered the request of Yvonne Sharpton for an appeal of the decision of the Historic Landmark Commission to deny a certificate of appropriateness to allow a pre-fab carport/storage building on property located at 2501 Hazel in Beaumont, Texas. The Council, after considering the request, the evidence provided in support of the request and the staff response finds and determines that the request should be granted subject to compliance with the following conditions: The will be moved off of the right-of-way. The carport will be setback a minimum of ten (10)feet from the property line on 9th St. and sit parallel to the street. A minimum (6) foot tall wood screening fence will be constructed along the east and north sides of the carport to provide screening.
