WHEREAS, HEB Grocery Company, L.P. has conveyed a ten-foot (10') wide Water
Line Easement, as described on Exhibit "A" attached hereto, to the City of Beaumont for the
purpose of providing access for fire prevention services:
• Lot 1, Block 1 of the HEB Grocery Addition
and,
WHEREAS, the City Council has considered the purpose of said conveyance and is of the
opinion that the acceptance of said conveyance is necessary and desirable and that same
should be accepted;
NOW, THEREFORE, BE IT RESOLVED BY THE
CITY COUNCIL OF THE CITY OF BEAUMONT:
THAT the easement conveyed by HEB Grocery Company, L.P. as described on attached
Exhibit 'A" be and the same is hereby, in all things, accepted.
PASSED BY THE CITY COUNCIL of the City of Beaumont this the 11th day of July,
2006.

COMMENTS
In connection with the above referenced project, please find a copy of the recorded easement from
which HEB Grocery Company,L.P.,conveyed to the City of Beaumont property for a ten foot(101)
wide water line easement. This easement, out of Lot 1, Block 1 of the HEB Grocery Addition (H.
Williams Survey, Abstract 58) and located at the intersection of Dowlen Road and Delaware, will
provide mandatory access for fire prevention services.

KNOW ALL MEN BY THESE PRESENTS:
WATER LINE EASEMENT
THAT, HEB GROCERY COMPANY, LP, a Texas limited partnership, hereinafter called
"GRANTOR", whether one or more, for and in consideration of the sum of ONE AND NO/100
DOLLAR ($1.00), and other good and valuable consideration to it in hand paid by the CITY OF
BEAUMONT, a municipal corporation domiciled in Jefferson County, Texas, hereinafter called
"GRANTEE", the_receipt and sufficiency of which consideration is hereby acknowledged, has
GRANTED, SOLD and CONVEYED, and by these presents does GRANT, SELL and
CONVEY unto the CITY OF BP NT, P. O. Box 3827, Beaumont, Texas 77704, Jefferson
County, Texas, its successors and assigns, a Water Line Easement and the exclusive right to
construct, alter, and maintain said water line and appurtenances on the Easement Property
hereinafter defined, under, over, in and across that certain tract or parcel of land owned by
GRANTOR situated in the County of Jefferson, State of Texas, being more particularly
described in Exhibit"A" attached hereto and depicted on Exhibit"B" attached hereto and made a
part hereof for all purposes, the "Easement Property", except that Grantor, its successors and
assigns, reserves the right hereunder to dedicate, place, construct, operate, repair, rebuild,
replace, relocate and/or remove other utility lines and appurtenances which may cross and/or
intersect the Easement Property.
The easement herein granted shall be used for the specific purpose of placing,
constructing, operating, repairing, rebuilding, replacing, relocating, and/or removing water lines
and appurtenances within the Easement Property, and the following rights are also hereby
conveyed:
It is expressly understood and agreed that the City of Beaumont shall have the right of
ingress to and egress from the Easement Property, over, across and upon Grantor's adjacent real
property for the urposes_.aforesaid and giving_ said._.City__the right and_priv__lege to_ mpro _
maintain and operate said water line and appurtenances on the Easement Property to the extent
permitted by law.
Grantor agrees not to hereafter place any new structures or appurtenances within the
Easement Property except as provided above, but Grantor shall have the right to repair and
replace any existing structures or appurtenances currently located at the Easement Property and
to construct, maintain, lay, inspect, repair, alter, substitute, replace and remove surface materials,
roads, streets, sidewalks, parking lots and landscaping over, across and along the Easement
Property, and if Grantor damages any of Grantee's utilities within the Easement Property then it
will be the Grantor's responsibility to pay Grantee for repairs. Grantee shall not be responsible
for the repair and replacement of any paving or other structures within the Easement Property,
provided, however, Grantee shall leave the Easement Property in a safe condition.
TO HAVE AND TO HOLD the above described easements and right-of-way unto the
said CITY OF BEAUMONT, its successors and assigns forever, subject to the terms, conditions
and provisions set forth herein and all matters of record in Jefferson County, Texas, validly
substituting against the Easement Property on this date.
