HomeMy WebLinkAboutRES 06-190 RESOLUTION NO. 06-190 WHEREAS, HEB Grocery Company, L.P. has conveyed a ten-foot (10') wide Water Line Easement, as described on Exhibit "A" attached hereto, to the City of Beaumont for the purpose of providing access for fire prevention services: • Lot 1, Block 1 of the HEB Grocery Addition and, WHEREAS, the City Council has considered the purpose of said conveyance and is of the opinion that the acceptance of said conveyance is necessary and desirable and that same should be accepted; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF BEAUMONT: THAT the easement conveyed by HEB Grocery Company, L.P. as described on attached Exhibit 'A" be and the same is hereby, in all things, accepted. Grantor agrees not to hereafter place any new structures or appurtenances within the Easement Property except as provided above, but Grantor shall have the right to repair and replace any existing structures or appurtenances currently located at the Easement Property and to construct, maintain, lay, inspect, repair, alter, substitute, replace and remove surface materials, roads, streets, sidewalks, parking lots and landscaping over, across and along the Easement Property, and if Grantor damages any of Grantee's utilities within the Easement Property then it will be the Grantor's responsibility to pay Grantee for repairs. Grantee shall not be responsible for the repair and replacement of any paving or other structures within the Easement Property, provided, however, Grantee shall leave the Easement Property in a safe condition.
