HomeMy WebLinkAboutORD 06-026 ORDINANCE NO. 06-026 ENTITLED AN ORDINANCE FINDING CERTAIN STRUCTURES TO BE PUBLIC NUISANCES AND ORDERING THEIR DEMOLITION AND/OR REPAIR; PROVIDING FOR SEVERABILITY AND PROVIDING FOR A PENALTY. BE IT ORDAINED BY THE CITY OF BEAUMONT: Section 1. That the City Council of the City of Beaumont hereby finds and declares the buildings located at: 1. 250 E. Alma 21. 3360 Grand 2. 1055 Ashley 2. 2520 Gulf Commercial/Church 3. 3440 Betty 23. 3270 Gulf 4. 6240 Bi ner Rd. &Shed 24. 3180 Highland Avenue 5. 2510 Calder Commercial 5. 550 Jeanette 6. 8795 College Commercial 6. 795 Jeanette 7. 8795 College Trailer 7. 1545 Liberty 8. 4423 Dallas & Sheds 28. 3139 Magnolia (Garage Apartment) 9. 570 Delaware 29. 4024 Magnolia 10. 811 Doucette (Garage Apartment) 31. 2485 Monroe 11. 770 EI ie and Garage 32. 1822 Nora 12. 545 Euclid (Garage Apartment) 33. 1895 Nora 13. 1995 Fillmore 34. 2105 Nora 15. 1058 Fulton Avenue 35. 3173 Prairie 16. 495 E. Gill 139. 5470 Tyrrell Park Road 0. 3390 Glenwood Avenue to be public nuisances in that said buildings violate Chapter 14, Section 14-50 of the Code of Ordinances of the City of Beaumont and are for want of repairs, or by reason of age or dilapidated condition, likely to cause or promote fires that would endanger persons or property. Section 2. In accordance with Article XVII, Section 2, of the Charter of the City of Beaumont, Section 14-52 of the Code of Ordinances of Beaumont, Texas, it is hereby ordered that the owner or owners of the following described buildings demolish and remove said structures within ten (10) days of the effective date of this ordinance. 1. 250 E. Alma 2. 2520 Gulf Commercial/Church 2. 1055 Ashley 3. 3270 Gulf 3. 3440 Be 4. 3180 Highland Avenue 6. 8795 College Commercial 5. 550 Jeanette 7. 8795 College Trailer 16. 795 Jeanette 9. 570 Delaware 27. 1545 Liberty 10. 811 Doucette (Garage Apartment) 28. 3139 Magnolia (Garage Apartment) 12. 545 Euclid (Garage Apartment) 31. 2485 Monroe 15. 1058 Fulton Avenue 32. 1822 Nora 16. 495 E. Gill 36. 460 San Jacinto 0. 3390 Glenwood Avenue 38. 1175 Tulane (Garage Apartment) 1. 3360 Grand 139. 5470 Tyrrell Park Road If the property owner(s)fail(s)to comply within ten (10)days, Council orders that the property be demolished without further notification to the property owners or City Council action. Section 3. In accordance with Article XVII, Section 2, of the Charter of the City of Beaumont, Section 14-52 of the Code of Ordinances of Beaumont, Texas, it is hereby ordered that the property owner(s)of the following described buildings execute a work program with the City within ten (10)days of the effective date of this ordinance and either demolish or complete all repairs and receive a Certificate of Occupancy within one-hundred fifty (150) days. Should the owner(s) fail to obtain substantial completion as defined in the work program, within ninety(90)days from the initiating date of the work program, Council hereby orders that the property be demolished without further notification to the property owner(s)or City Council action. 4. 6240 Bi ner Rd. & Shed 13. 1995 Fillmore 5. 2510 Calder Commercial 29. 4024 Magnolia 8. 4423 Dallas & Sheds 37. 2290 Taylor 11. 770 Elgie and Garage Section 4. If the property owner requests and is authorized by City Council to enroll in a work program, all properties are to be secured from unauthorized entry, and all delinquent taxes shall be paid in full or a payment plan executed prior to the enrollment of the property in the work program. Section 5. That if any section, subsection, sentence, clause or phrase of this ordinance, or the application of same to a particular set of persons or circumstances should for any reason be held to be invalid, such invalidity shall not affect the remaining portions of this ordinance, and to such end the various portions and provisions of this ordinance are declared to be severable. Section 6. That any person who violated any provision of this ordinance shall, upon conviction, be punished as provided in Section 1-8 of the Code of Ordinances of Beaumont, Texas.
