WHEREAS, on March 16, 2004, the City Council of the City of Beaumont, Texas,
passed Resolution No. 04-053 awarding a contract in the amount of$2,598,065.77 to W.
B. Construction and Sons, Inc.for the Virginia Street Pavement Improvement Project; and,
WHEREAS, Change Order No. 1, passed by Resolution No. 05-270 on 12/20/05,
in the amount of$176,400 was required to construct sidewalks on both sides of Virginia
Street from Avenue A to Mercantile Street and to remove and replace 300 linear feet of
existing concrete pavement on St. Louis Street from Virginia to Bourbon Street thereby
increasing the contract amount to $2,774,465.77; and,
WHEREAS, Change Order No.2 on 2/26/06 in the amount of$9,900 did not require
council action as the amount was less than $10,000, was required to reimburse the
contractor for extending the insurance for a period of 180 days to complete additional work
added to the contract by the City thereby increasing the contract amount to$2,784,365.77;
and,
WHEREAS, Change Order No. 3, is required to reflect the actual quantities used
in completing the project thereby decreasing the contract amount by($50,393.20)thereby
decreasing the contract amount to $2,733,972.57.
NOW, THEREFORE, BE IT RESOLVED BY THE
CITY COUNCIL OF THE CITY OF BEAUMONT:
THAT the City Manager be and he is hereby authorized to execute Change Order No. 3
decreasing the contract amount by ($50,393.20) for a total amount of$2,733,972.57 for
the Virginia Street Pavement Improvement Project.
BE IT FURTHER RESOLVED that the project, as stated above, be and the same
is hereby accepted and the City Manager is hereby authorized to make final payment in
the amount of$191,163.39 to be paid to W. B. Construction and Sons, Inc.
