Cooper, City Attorney Kyle Hayes, City Manager Rose Ann Jones, City Clerk The City Council of the City of Beaumont, Texas, met in a regular session on February 28, 2006, at the City Hall Council Chambers, 801 Main Street, Beaumont, Texas, at 1:30 p.m. to consider the following: OPENING Invocation Pledge of Allegiance Roll Call Presentations and Recognition Public Comment: Persons may speak on scheduled agenda items 1-3/Consent Agenda Consent Agenda Mayor Goodson called the council meeting to order at 1:30 p.m. Brother Terry Littledike of the Church of Jesus Christ of Latter Day Saints gave the invocation. Councilmember Beaulieu led the Pledge of Allegiance. Roll call was made by Rose Ann Jones, City Clerk. Present at the meeting were Mayor Goodson, Mayor Pro Tern Samuel, Councilmembers Smith, Beaulieu, Cokinos, Ames and Patterson. Also present were Kyle Hayes, City Manager; Tyrone Cooper, City Attorney; Rose Ann Jones, City Clerk. Frank Kiefer 3190 Willowood Beaumont TX Welcome to Councilmember Cokinos - Against any type of rate increase for Centerpoint CONSENT AGENDA Approval of minutes - February 21, 2006 Confirmation of committee appointments - None Minutes-February 28,2006 A) Approve a resolution accepting maintenance of the street, storm sewer,water and sanitary sewer improvements in Highlands Pointe Addition - Resolution 06-070 B) Authorize the City Manager to apply for and receive funding through the Department of Homeland Security's Buffer Zone Protection Plan Program for ExxonMobil - Resolution 06-071 C) Authorize the City Manager to apply for and receive funding through the Department of Homeland Security's Buffer Zone Protection Plan Program for Martin Operating Partnership, LP - Resolution 06-072 D) Authorize the City Manager to apply for and receive funding through the Department of Homeland Security's Buffer Zone Protection Plan Program for Arkema Chemical - Resolution 06-073 E) Authorize the City Manager to apply for and receive funding through the Department of Homeland Security's Buffer Zone Protection Plan Program for Parkdale Mall - Resolution 06-074 F) Approve a bid for the purchase of one (1) automated ion analysis and titration system for use at the Water Reclamation Plant - Resolution 06-075 G) Authorize the City Manger to execute a Memorandum for Record with the Corp of Engineers regarding completion of Hurricane Rita debris removal in Beaumont - Resolution 06-076 H) Authorize the City Manager to execute an Interlocal Agreement with the Public Employee Benefits Alliance - Resolution 06-077 Councilmember Cokinos made a motion to approve the Consent Agenda. Councilmember Beaulieu seconded the motion. AYES: MAYOR GOODSON, MAYOR PRO TEM SAMUEL, COUNCILMEMBERS SMITH, BEAULIEU, COKINOS, AMES AND PATTERSON NAYS: NONE MOTION PASSED GENERAL BUSINESS 1. Consider authorizing the City Manager to apply for and receive funding through the Department of Homeland Security's Port Security Grant Program and to execute an inter-local agreement of support with the Port of Beaumont in order to comply with applicable federal regulations - Resolution 06-078 Administration recommended authorizing the City Manager to apply for and receive funding in the amount of$296,774 through the Department of Homeland Security Grant Program and to execute an inter-local agreement of support with the Port of Beaumont in order to comply with applicable federal regulations. Page 2 of 5 Minutes-February 28,2006 The Department of Homeland Security Port Security Grant Program is intended to enhance security of the Port of Beaumont which has been designated as critical to national infrastructure. Due to the Port Security Grant providing equipment funding to support the Port of Beaumont and its jurisdictional boundaries, a memorandum of agreement must be allowed prior to acceptance of funding. An additional $296,774 in law enforcement equipment with no matching funds from the City. Councilmember Ames made a motion to APPROVE RESOLUTION 06-078THATTHE CITY MANAGER BEAND HE IS HEREBY AUTHORIZED TOAPPLY FORAND RECEIVE FUNDING IN THE AMOUNT OF $296,774 THROUGH THE DEPARTMENT OF HOMELAND SECURITY PORT SECURITY GRANT PROGRAM AND TO EXECUTE AN INTER-LOCAL AGREEMENT OF SUPPORT WITH THE PORT OF BEAUMONT IN ORDER TO COMPLY WITH APPLICABLE FEDERAL REGULATIONS. Councilmember Smith seconded the motion. AYES: MAYOR GOODSON, MAYOR PRO TEM SAMUEL, COUNCILMEMBERS SMITH, BEAULIEU, COKINOS,AMES AND PATTERSON NAYS: NONE MOTION PASSED 2. Consider approving a request to deed surplus property to Habitat for Humanity for the development of affordable housing This item was deferred until next meeting. 3. Consider approving a job order contract for repairs, renovations or alterations of City facilities - This item was pulled by the City Manager. 4. PUBLIC HEARING: Dangerous Structures Public Hearing convened at 1:50 p.m. Public comments were made by the following person who personally appeared and requested additional time to make repairs to his property. Alvinee Johnson 3903 Irving Beaumont TX #2 - 580 Brockman Public Hearing closed at 2:00 p.m. Consider approval of an ordinance declaring certain structures to be dangerous structures and ordering their removal within 10 days or authorizing the property owner to enroll the dangerous structures in a work program - Ordinance 06-012 Page 3 of 5 Minutes-February 28,2006 Councilmember Patterson made a motion to ADOPT ORDINANCE 06-012 ENTITLED AN ORDINANCE FINDING CERTAIN STRUCTURES TO BE PUBLIC NUISANCES AND ORDERING THEIR DEMOLITION AND/OR REPAIR; PROVIDING FOR SEVERABILITY AND PROVIDING FOR A PENALTY. Councilmember Samuel seconded the motion. L. KING COMMISSION AND CENTRAL HIGH SCHOOL[CHOIR] FOR THEIR SUPPORT TO MOVE FORWARD WITH THE MARTIN LUTHER KING JR. Flores 2425 Buchanan Beaumont TX Would like to know why the City has not applied for a grant from Texas Dept of Transportation for funds available for the beautification to include landscape and lighting along Old Spanish Trail (he distributed copies of information to Council) Frank Kiefer 3190 Willowood Beaumont TX Concerned about damaged sidewalks of Blocks 3000 and 3100 Minglewood which are dangerous for the older citizens who use these sidewalks daily; would like the City to use the $555,000 federal grant to help people who had no insurance to replace or repair their homes and are unable to receive any grant money because all of Jefferson County is in a 100 Year Flood Plan; would like this money to be used for hiring of more police officers to better protect our City; welcome back to Councilmember Cokinos Open session of meeting recessed at 2:20 p.m. EXECUTIVE SESSION Consider matters related to contemplated or pending litigation in accordance with Section 551.071 of the Government Code: ACM Cities' Motion to Deny Centerpoint's Request for Declaratory Relief and Motion to Dismiss Centerpoint's Petition for Review, GUD Docket No. 9630 EGSI transition to competition rate case, Docket No. 31544 There being no action taken in Executive Session, Council adjourned.
