WHEREAS, on October 28, 2003,the City Council of the City of Beaumont, Texas,
awarded a contract to Brystar Contracting Inc. in the amount of $4,224,066.30 for the
Delaware Street Extension Project; and
WHEREAS, Change Order No. 5 in the amount of$52,844.06 is required to adjust
the estimated quantities on the project to reflect the actual quantities used during the
performance of the project thereby increasing the contract amount to $4,752,418.36;
NOW, THEREFORE, BE IT RESOLVED BY THE
CITY COUNCIL OF THE CITY OF BEAUMONT:
THAT the City Manager be, and he is hereby authorized, to execute Change Order No. 5
in the amount of$52,844.06 to adjust the estimated quantities on the project to reflect the
actual quantities used during the performance of the project thereby increasing the contract
amount to $4,752,418.36.
BE IT FURTHER RESOLVED THAT the project, as stated above, be and the same
is hereby accepted and the City Manager be and he is hereby authorized to make final
payment in the amount of$238,698.97 to be paid to Brystar Contracting Inc.
PASSED BY THE CITY COUNCIL of the City of Beaumont this the 24th day of
January, 2006.
