WHEREAS,the lawsuit styled Fuqua General Contractors Inc. v. City of Beaumont,
et al was discussed in an Executive Session properly called and held Tuesday, October 25,
2005; and,
WHEREAS, the Council desires to authorize the settlement of the lawsuit styled
Fuqua General Contractors Inc. v. City of Beaumont, et al;
NOW, THEREFORE, BE IT RESOLVED BY THE
CITY COUNCIL OF THE CITY OF BEAUMONT:
THAT the City Attorney be, and he is hereby, authorized to settle the lawsuit styled Fuqua
General Contractors Inc.v. City of Beaumont,et al.for the amount of Ninety-one Thousand
Nine-Hundred Thirty-One and 29/100 Dollars ($91,931.29).
BE IT FURTHER RESOLVED that the City Manager be authorized to execute the
necessary instruments on behalf of the City of Beaumont to settle the suit.
PASSED BY THE CITY COUNCIL of the City of Beaumont this the 1st day of
November, 2005.
