Cooper, City Attorney Kyle Hayes, City Manager Rose Ann Jones, City Clerk The City Council of the City of Beaumont, Texas, met in a Special Emergency Meeting on September 26,2005,at the Willie Bauer Conference Room,400 Walnut Street, Beaumont,Texas, at 6:00 p.m. to consider the following: OPENING Roll Call Mayor Goodson called the council meeting to order at 6:00 p.m. Roll call was made by Rose Ann Jones, City Clerk. Present at the meeting were Mayor Goodson, Mayor Pro Tern Samuel, Councilmembers Beaulieu, and Ames. Absent: Councilmembers Cokinos, Smith, and Patterson. Also present were Kyle Hayes, City Manager; Tyrone Cooper, City Attorney; Rose Ann Jones, City Clerk. REPORTS Reports from Mayor and City Manager Mayor Goodson gave an update on the status of the City in relation to Jefferson County; reported that he was proud of all the 254 police officers who stayed to protect the City as well as the fire department, water and solid waste employees, street department, parks department and all others who have helped at this crucial time; trees down, no power, no electricity and the City is not safe for citizens to return; fire department is starting a house to house search for those in need City Manager Hayes reported that the main objectives of the City at this time were to provide EMS and Fire protection, provide Police protection for residential and commercial properties,and clear the streets for emergency vehicles and work crews; provide water and sewer to City; proud of the way everybody has pulled together to get the City back together EMERGENCY BUSINESS 1. Consider approval of declaration of emergency; extending and renewing the authorities, rules, regulations until the state of disaster is terminated - Ordinance 05-075 Administration recommended Council adopt the declaration of emergency. Minutes-September 26,2005 Mayor Pro Tern Samuel moved to ADOPT ORDINANCE 05-075 DECLARING AN EMERGENCY; EXTENDING AND RENEWING THE AUTHORITIES, RULES, REGULATIONS AND ALL OTHER PROVISIONS OF ORDINANCE 05-074 UNTIL THE STATE OF DISASTER IS TERMINATED; PROVIDING FOR PENALTY; PROVIDING FOR SEVERABILITY;AND PROVIDING AN EFFECTIVE DATE. Councilmember Beaulieu seconded the motion. AYES: MAYOR GOODSON, MAYOR PRO TEM SAMUEL, COUNCILMEMBERS BEAULIEU,AND AMES NAYS: NONE MOTION PASSED 2. Consider approval of removing the operations of the competitive bidding requirements - Ordinance 05-076 Administration recommended that Council approve these requirements during the state of disaster for a period of at least 90 days from and after September 21, 2005. Councilmember Beaulieu made a motion to DECLARE AN EMERGENCY;REMOVING THE OPERATION OF THE COMPETITIVE BIDDING REQUIREMENTS OF THE APPLICABLE COMPETITIVE BIDDING PROVISIONS OF THE CITY CHARTER AND CODE OF ORDINANCE PURSUANT TO SECTION 252.022 OF THE TEXAS LOCAL GOVERNMENT CODE WITH RESPECT TO CONTRACTS FOR PROCUREMENTS MADE BECAUSE OF THE PUBLIC CALAMITY RESULTING FROM HURRICANE RITA,FORA PERIOD OF AT LEAST 90 DAYS FROM AND AFTER SEPTEMBER 21, 2005. Councilmember Ames seconded the motion. AYES: MAYOR GOODSON, MAYOR PRO TEM SAMUEL, COUNCILMEMBERS BEAULIEU,AND AMES NAYS: NONE MOTION PASSED COUNCILMEMBER COMMENTS MAYOR PRO TEM SAMUEL- HAS SERIOUS CONCERNS ABOUT CITIZENS COMING IN TOO SOON AS STREETS ARE NOT SAFE; ALSO CREATES UNSAFE ENVIRONMENT FOR THE POLICE OFFICERS; NO MEDICAL HELP READILY AVAILABLE; HIGH RISK FOR CITIZENS AT THIS TIME COUNCILMEMBER AMES- FEELS THAT THE CITY IS NOT SAFE FOR RESIDENTS AT THIS TIME BUT FEELS THAT AT SOME TIME SOON THE RESIDENTS WILL BE ALLOWED ACCESS TO THEIR HOMES FOR DAMAGE OBSERVATION Page 2 of 3 Minutes-September 26,2005 COUNCILMEMBER BEAULIEU - ASKED ABOUT THE MAIL DELIVERY IN THE CITY AND IF WE KNEW ABOUT THE STATUS OF THE BISD SCHOOLS MAYOR GOODSON - DEBRIS, WATER AND SEWER LINES ARE BEING REPAIRED, POSTAL SERVICE IS WORKING ON STATIONS,HIGH RISK FOR CITIZENS AT THIS TIME;BUSINESSES TO RETURN MUST ONLY BE FOR SUPPORT RELIEF Mayor Pro Tern Samuel stated his concern that this meeting did not begin with a prayer.
