Cooper, City Attorney Kyle Hayes, City Manager Rose Ann Jones, City Clerk The City Council of the City of Beaumont, Texas, met in a regular session on September 13, 2005, at the City Hall Council Chambers, 801 Main Street, Beaumont, Texas, at 1:30 p.m. to consider the following: OPENING Invocation Pledge of Allegiance Roll Call Presentations and Recognition Public Comment: Persons may speak on scheduled agenda items 1-2/Consent Agenda Consent Agenda Mayor Goodson called the council meeting to order at 1:30 p.m. Pastor Reggie Lloyd, Jr. of the Praise Christian Church gave the invocation. Navila Pompa and Breanna Edmondson, Miss Hispanic and Jr. Miss Hispanic Heritage led the Pledge of Allegiance. Roll call was made by Rose Ann Jones, City Clerk. Present at the meeting were Mayor Goodson, Mayor Pro Tern Samuel,Councilmembers Beaulieu, Ames and Patterson. Absent: Councilmembers Smith and Cokinos. Also present were Kyle Hayes, City Manager; Joe Sanders, Assistant City Attorney; Rose Ann Jones, City Clerk. None CONSENT AGENDA Approval of minutes - Minutes of September 6, 2005 Minutes-September 13,2005 Confirmation of committee appointments - Resolution 05-199 E.J.Sherlock will be reappointed as Chairman of the Small Business Revolving Loan Fund Board. The current term will expire June 22, 2006. (Mayor Guy N. Goodson) Mary Jowers will be reappointed as Vice Chairman of the Small Business Revolving Loan Fund Board. The current term will expire June 22, 2006. (Mayor Guy N. Goodson) Adrian Hudspeth will be appointed as Vice Chairman of the Parks and Recreation Advisory Committee. The term will commence September 13, 2005 and expire September 13, 2006. (Mayor Guy N. Goodson) Myra Clay will be appointed as Chairman of the Parks and Recreation Advisory Committee. The term will commence September 13, 2005 and expire September 13, 2006. (Mayor Guy N. Goodson) Dana L. Timaeus will be reappointed to the Board of Adjustment (Zoning). The current term will expire May 12, 2007. (Mayor Guy N. Goodson) Marie Broussard will be reappointed to the Historic Landmark Commission. The current term will expire May 1, 2007. (Mayor Guy N. Goodson) Felix Broussard will be reappointed to the Historic Landmark Commission. The current term will expire September 10, 2007. (Mayor Guy N. Goodson) Dale Hallmark will be reappointed to the Historic Landmark Commission. The current term will expire August 18, 2007. (Mayor Guy N. Goodson) Beauregard Brown will be reappointed to the Community Development Advisory Committee. The current term will expire August 18, 2007. (Councilmember Andrew P. Cokinos) Dora Nisby will be reappointed to the Community Development Advisory Committee. The current term will expire June 5, 2007. (Councilmember Andrew P. Cokinos) Dr. Richard LeBlanc will be reappointed to the Convention and Tourism Advisory Board. The current term will expire July 26, 2007. (Councilmember Andrew P. Cokinos) Ryan Smith will be reappointed to the Convention and Tourism Advisory Board. The current term will expire September 11, 2007. (Councilmember Lulu Smith) Shaheen Farah will be reappointed to the Historic Landmark Commission. The current term will expire June 23, 2007. (Councilmember Nancy Beaulieu) Tony Guillory will be appointed to the Parks and Recreation Advisory Committee. The term will commence September 13, 2005 and expire September 12, 2007. (Councilmember Nancy Beaulieu) Connie Berry will be appointed to the Community Development Advisory Committee. The term will commence September 13, 2005 and expire September 12, 2007. (Councilmember Nancy Beaulieu) Page 2 of 6 Minutes-September 13,2005 A) Approve a resolution authorizing the acceptance of three (3) water line easements providing access for fire prevention services - Resolution 05-200 Mayor Pro Tern Samuel made a motion to approve the Consent Agenda. Councilmember Ames seconded the motion. AYES: MAYOR GOODSON, MAYOR PRO TEM SAMUEL, COUNCILMEMBERS BEAULIEU,AMES AND PATTERSON NAYS: NONE MOTION PASSED GENERAL BUSINESS 1. Consider approving a maintenance agreement for HTE, Inc. software support - Resolution 05-201. Administration recommended payment of an invoice to HTE, Inc. for the renewal of an annual maintenance agreement for software support in the amount of$84,980. HTE, Inc. software is used by various City Departments. This purchase is exempt from competitive bidding since it is available from only one (1) source having exclusive rights to modify and maintain the software. The software maintenance agreement provides for unlimited telephone support and up to three (3) software updates during the annual term. The agreement is for an annual period beginning October 1, 2005 and includes twenty-four(24)applications. Last year, nineteen(19)applications were maintained at a cost of $77,575. The increase this year is due to the addition of the Water Utilities Customer Service billing system. Funding is budgeted for Fiscal Year 2006 as follows: SOFTWARE APPLICATION CONTRACT AMOUNT General Fund $55,160 Municipal Court Technology Fund $19,310 Water Fund $10,510 TOTAL: $84,980 JI Councilmember Beaulieu moved to APPROVE RESOLUTION 05-201 THAT THE CITY MANAGER BE AUTHORIZED TO PAY AN INVOICE IN THE AMOUNT OF$84,980 TO HTE, INC. FOR THE RENEWAL OF AN ANNUAL MAINTENANCE AGREEMENT FOR SOFTWARE SUPPORT. Councilmember Ames seconded the motion. Consider approving various budget adjustments and transfers related to the FY 2005 Budget - Ordinance 05-070 Administration recommended that Council amend the FY 2005 Budget as proposed in the attached detail. Approving the proposed amendments will preclude the City from having expenditures in excess of appropriations. As the fiscal year progressed, unanticipated funds became available and additional expenditures arose resulting in the need to amend the FY 2005 Budget to allow for appropriation of expenditures related to such. The proposed FY 2005 Budget amendments for all funds will increase total appropriations by $2,939,500. Sufficient fund balance is available to cover all increases in appropriations where individual fund revenues are not able to fully sustain those appropriations. No prior FY 2005 Budget amendments have been proposed or approved. Councilmember Ames made a motion to ADOPT ORDINANCE 05-070 ENTITLED AN ORDINANCE AMENDING THE FISCAL BUDGET OF THE CITY OF BEAUMONT FOR THE FISCAL YEAR 2005 TO APPROPRIATE AND TRANSFER$350,000 FROM THE GENERAL FUND AND $200,000 FROM THE WATER FUND TO THE GENERAL LIABILITY FUND;AND APPROPRIATING $365,900 FOR THE GOLF COURSE FUND; APPROPRIATING $924,300 FOR CONFISCATED GOODS FUND; APPROPRIATING $852,100 FOR THE CAPITAL RESERVE FUND; AND APPROPRIATING $247,200 FOR THE FLEET FUND; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR REPEAL. Councilmember Beaulieu seconded the motion. AYES: MAYOR GOODSON, MAYOR PRO TEM SAMUEL, COUNCILMEMBERS BEAULIEU,AMES AND PATTERSON NAYS: NONE MOTION PASSED WORKSESSION Review proposed changes to the Taxicab Ordinance Worksession opened at 2:00 p.m. and closed at 2:20 p.m. Page 4 of 6 Minutes-September 13,2005 Citizen Comments: James Hensley 2305 Victoria Beaumont TX A-1 Taxi; requested rate increase for first 1/10 of mile;feels that the proposed rate changes will only put the owners in line with the current guides of other cities but not in line with the current expenses of the owners Paul Leger 1215 Liberty Street Beaumont TX American Quality Cabs; stated that this proposed increase will only bring the owners to where others are now not in line to what other cities are proposing to increase; also additional passenger rate needs to increase Following a question and answer period, worksession was closed. COUNCILMEMBER COMMENTS Councilmember Beaulieu - ATTENDED A WONDERFUL 911 COMMERATIVE SERVICE AT FIRST METHODIST CHURCH WERE SHE REPRESENTED THE COUNCIL AND MAYOR'S OFFICE AT A BEAUTIFUL SERVICE WHERE OUR LOCAL ENFORCEMENT AND EMERGENCY PERSONAL WERE RECOGNIZED AS WELL REMEMBERING THE SACRIFICE OF THOSE WHO CAME TO THE RESCUE OF THOSE IN THE TWIN TOWERS AND THANKED EVERYBODY FOR REMEMBERING; CONGRATULATED THE FLETCHER ELEMENTARY 4T" GRADERS FOR THEIR FINE GENEROUS SPIRIT, FOR THEIR INITIATIVE AND FOR THE ADULTS WHO ARE HELPING THEM LEARN THAT LESSON COUNCILMEMBER AMES - NONE MAYOR PRO TEM SAMUEL- NONE COUNCILMEMBER PATTERSON - NONE ASSIST.
