WHEREAS, City Council approved Resolution No. 05-152 on July 12, 2005, to sell
the surplus property as described below and on Exhibit "A" attached hereto to Maurice
James Newman in the amount of$3,609; and,
WHEREAS, Mr. Newman has not paid for the below described property and has
officially requested to withdraw his bid:
400 block Elm Street
Sheffield Addition - Block 3, Lots 1 - 6
LI - Light Industrial
and,
WHEREAS, Magnolia Cemetery submitted a bid in the amount of$1,000 and has
committed to the purchase of the property for expansion of their grounds, the City of
Beaumont has no objection to the disposal of the surplus property as described below and
on Exhibit "A" attached hereto; and,
WHEREAS, the land is no longer needed for the use of citizens as a road, nor does
it have a potential for park, conservation, recreation or similar purposes; and,
WHEREAS, the City of Beaumont wishes to sell the above properties as shown;
NOW, THEREFORE, BE IT RESOLVED BY THE
CITY COUNCIL OF THE CITY OF BEAUMONT:
THAT the City Manager be, and he is hereby, authorized to execute a General Warranty
Deed for the sale of above-described property as shown.

September, 2005.
