Interim Services,Inc. is the call center operation in Nederland formerly known as NorCross. Designation as an Enterprise Project would not entail any City of Beaumont incentives,but would qualify the project for state sales tax refunds paid for the purchase of equipment based on the number of employees hired. The Texas Department of Economic Development designated the Beaumont/Nederland/Jefferson County Enterprise Zone on January 9, 1998. Jefferson County nominated Interim Services, Inc. as an Enterprise Project on November 29, 1999. For Interim Services,Inc.to become an Enterprise Project,the City of Beaumont and City of Nederland will also need to nominate the company. A copy of the staff memorandum is attached for your review. B) Accept improvements constructed in Christina Court Subdivision, Phase I for City maintenance Administration recommends approval of accepting maintenance of the street,storm sewer,water and sanitary sewer improvements in Christina Court Subdivision, Phase I. The improvements in the subdivision passed final inspection from all entities involved on November 30, 1999. A copy of the staff memorandum is attached for your review. C) Approve the acquisition of properties for the Concord Road Improvement Project 1) Property located at 3545 and 3555 Concord Road (0.065 acre out of the A. Williams Survey) would be purchased from Joe Herrera, Jr. and Antonia Martha Herrera for the appraised value of $10,200. 2) Property located at 3680 Concord Road (0.067 acre out of the A. Williams Survey) would be purchased from Richard Hegele for the appraised value of$2,000. 3) Property located at 3690 Concord Road (0.021 acre out of Lot 3, Block 2 of the Minglewood Addition)would be purchased from Robert L. and Glenda F. Smith for the appraised value of$900. The properties were appraised by Bishop Real Estate Appraisers, Inc. v D) Approve a grant application to the Texas Department of Health to provide Internet connectivity to the Beaumont Public Health Department Administration recommends approval of a grant application to the Texas Department of Health to provide Internet connectivity to the Beaumont Public Health Department in the amount of$60,000. The grant would allow for the purchase of 10 personal computers with software, two printers, line installation and utilization charges, and the hardware and software to communicate with the City's Internet service provider. According to the grant terms, recipients must match 10% of the grant amount. Funds for the match are available in the Capital Reserve Fund. A copy of the staff memorandum is attached for your review. F) Approve the purchase of one diesel powered truck cab and chassis equipped with a 10.5 cubic yard concrete mixer body for use in the Public Works Department Administration recommends approval of the purchase of one 1995 International Model F-5070-SFA truck from Olympic International Trucks,Inc.in the amount of$50,000. A used truck was specified rather than a new unit due to budgetary constraints (a comparably equipped unit purchased new is approximately$100,000). The absence of a concrete truck has forced the department to rely on local concrete companies for pouring concrete on street repair projects. The City projects are considered small jobs by the companies and are not given high priority. A copy of the staff memorandum is attached for your review. F) Approve an annual contract for the purchase of automotive batteries for use by the Fleet Management Division Administration recommends approval of an annual contract with Nationwide Batteries of Beaumont for purchasing automotive batteries at the unit costs stated in the attached memorandum with.an estimated total annual expenditure of$26,620.20. Funds are available for this expenditure in the Fleet Management Division's operating budget. G)Approve a travel policy which is applicable to all employees including the City Council for the payment of travel expenses incurred in the performance of their duties outside of Beaumont Administration recommends approval of Travel Policy(6.1)which is attached for your review. In September 1989,the initial Travel Policy for City Council was approved by resolution. In 1996, it was determined that the reimbursement guidelines and procedures for City Council were outdated. In an effort to ensure that members of Council were reimbursed consistently with other city employees,the City Manager on October 1, 1996 approved through an administrative memorandum the current Travel Policy for reimbursement of related travel of Councilmembers. The current reimbursement guidelines and procedures have been in effect since October 1, 1996 and no changes are recommended. RECOMMENDATION The Administration recommends approval of the nomination of Interim Services, Inc. as an Enterprise Project. Interim Services, Inc. is the call center operation in Nederland formerly known as NorCross. RECOMMENDED MOTION Approve/Deny nominating Interim Services, Inc. as an Enterprise Project pursuant to the Texas Enterprise Zone Act. v STATE OF TEXAS § IN THE COMMISSIONERS COURT OF COUNTY OF JEFFERSON § JEFFERSON COUNTY ORDER NOMINATING THE INTERIM SERVICES, INC.AS AN ENTERPRISE PROJECT PURSUANT TO THE TEXAS ENTERPRISE ZONE ACT (TEXAS GOVERNMENT CODE CHAPTER 2303, SUBCHAPTER F) WHEREAS,the Texas Department of Economic Development(`Department") designated the Beaumont/Nederland/Jefferson County Enterprise Zone (the"Zone") on January 9, 1998; and WHEREAS, the Department will consider Interim Services, Inc. as an enterprise project pursuant to a nomination and an application made by the Cities and County; and WHEREAS, the Cities and County desire to pursue the creation of the proper economic and social environment in order to induce the investment of private resources in productive business enterprises located in the Zone and to provide employment to residents of the Zone and to other economically disadvantaged individuals; and WHEREAS, pursuant to Chapter'2303, Subchapter F of the Texas Enterprise Zone Act, Texas Government Code(the"Act"), Interim Services, Inc. has applied to the Cities and County for designation as an enterprise project; and, WHEREAS, the County finds that Interim Services, Inc. meets the criteria for designation as an enterprise project under Chapter 2303, Subchapter F of the Act on the following grounds: 1. Interim Services, Inc. is a "qualified business" under Section 2303.402 of the Act since it will be engaged in the active conduct of trade or business in the Zone and at least twenty-five percent(25%) of the business' new employees will be residents of a Zone within the County or economically disadvantaged individuals; 2. Interim Services, Inc. is located in the Zone, or has made a substantial commitment to locate in the Zone, which has an employment rate of not less than one and one-half(1-1/2)times the state unemployment rate; (or a population loss of at least twelve percent(12%) during the most recent six- year period or a population loss of at least four percent (4%)for the most repent three-year period) 3. There has been and will continue to be a high level of cooperation between public, private and neighborhood entities within the Zone; and 4. The designation of Interim Services, Inc. as an enterprise project will contribute significantly to the achievement of the plans of the Cities and County for development and revitalization of the Zone. WHEREAS, the County finds that Interim Services, Inc. meets the criteria for tax relief and other incentives adopted by the Cities and County and nominates Interim Services, Inc. on the grounds that it will be located wholly within the Zone, will create a higher level of employment, economic activity and stability; and r v WHEREAS, the County finds that it is in the best interest of the County to nominate Interim Services, Inc. as an enterprise project pursuant to the Act; NOW, THEREFORE, IT IS ORDERED by the Commissioners Court of Jefferson County, Texas: That the findings of the County and its actions approving this order of the Commissioners Court are hereby approved and adopted. IT IS FURTHER ORDERED that Interim Services, Inc. is a "qualified business", as defined in Section 2303.402 of the Act, and meets the oriteria for designation as an enterprise project, as set forth in Section 2303, Subchapter F of the Act. IT IS IFURTHER ORDERED that the enterprise project shall take effect on the date of designation of the enterprise project by the department and terminate five (5)years after that date of designation. RECOMMENDATION Administration recommends approval of Brownstone Drive from existing Brownstone Drive approximately 609 feet west to and including the cul-de-sac, Christina Court North from proposed Brownstone Drive approximately 176 feet north to three(3)OM-4P End of Roadway markers. Also, recommended for approval are the Water and Sanitary Sewer Improvements for Lots 1-13 and Lots 27 & 28. Parcels 80 and 85 are in Phase III of the project with 30 parcels. BUDGETARYIMPACT This project is funded under the Capital Improvement Program. PREVIOUS ACTION There are thirty-five parcels acquired in Phase II since June 1998 and authorization for eminent domain has been approved for one parcel. The Jefferson County has foreclosed on the owners of five parcels. By law the property must be condemned to be able to acquire a portion of the lots for the right-of-way. Council authorized eminent domain proceedings on these parcels. Three parcels have been acquired in Phase III since September 1998. SUBSEQUENT ACTION Two offers are pending on Phase II and the owners of six parcels have accepted the appraised value. Three offers are pending and two owners have accepted the appraised value. RECOMMENDED BY City Manager, Public Works Director, and City Engineer. Bonczek, City Manager PREPARED BY: Ingrid Holmes, Public Health Director MEETING DATE: December 7, 1999 AGENDA MEMO DATE: December 1, 1999 REQUESTED ACTION: Council consider approving a grant application to the Texas Department of Health to provide Internet connectivity to the Beaumont Public Health Department. RECOMMENDATION Administration recommends approval of a grant application to the Texas Department of Health (TDH) to provide Internet connectivity to the Beaumont Public Health Department in the amount of$60,000. BACKGROUND TDH is working in cooperation with the Telecommunication Infrastructure Fund Board (TIFB) to make available grants to provide Internet connectivity for local health departments which are members of the State's Health Alert Network. The TIFB was established in 1995 to develop the telecommunications infrastructure of educational institutions and public health delivery systems. The ability of its participating local health department to communicate and access information is vital to TDH's ability to respond to public health emergencies. TDH is developing state-wide telecommunications resources which will allow communication of critical Health Alerts; access to surveillance data, health advisories, emergency response information, diagnosis and treatment guidelines, and other data critical to minimizing the impact of bioterrorism acts and other public health emergencies; online disease reporting; training; planning; and better epidemiologic investigation and reporting. The grant allows for the purchase of ten (10) personal computers (PC's) with software, two (2) printers, line installation and utilization charges, and the hardware and software to communicate with the city's Internet service provider. Access to the Internet will be provided through T1 communication lines and the city's proposed Internet network which is currently in the bidding process. The cost to provide hardware, software and communications is approximately $60,000. RECOMMENDATION Administration recommends award of a bid for the purchase of one (1) 1995 International Model F-5070-SFA truck with a 10.5 cubic yard McNeilus concrete mixer body to Olympic International Trucks, Inc. in the amount of$50,000. BACKGROUND Bids were requested for one (1) 1994 or later model truck with a concrete mixer for use in street repair by the Public Works Department, Streets and Drainage Division. A used truck was specified rather than a new unit due to budgetary constraints (a comparably equipped unit purchased new is approximately $100,000). Twenty vendors were notified of the bid, with only Olympic International Trucks, Inc. responding with a bid on Monday, November 29, 1999. The absence of a concrete truck has forced the department to rely on local concrete companies for pouring g concrete on street repair projects. The city projects are considered small jobs by the companies and are not given high priority, resulting in project delays and lost employee-hours brought about by late delivery. The truck and concrete mixer will afford savings both in lower concrete costs and a reduction in lost employee-hours. The unit has been inspected by Fleet Management personnel and meets all requirements of the bid specifications. BACKGROUND Bids were requested for an annual contract for automotive batteries for use by the Fleet Management Division to maintain city-owned vehicles and equipment. RECOMNENDATION Administration recommends that Council approves the Travel Policy(6.1)which is applicable to all employees for the payment of travel expenses incurred in the performance of their duties outside of Beaumont. BACKGROUND In September 1989,the initial Travel Policy for City Council was approved by resolution. In 1996, it was determined that the reimbursement guidelines and procedures for City Council were outdated. On October 1, 1996 in an effort to ensure that members of Council were reimbursed consistently with other city employees,the City Manager approved through an administrative memorandum the current Travel Policy for reimbursement of related travel of Councilmembers. At this time, administration is recommending City Council approval of the attached Travel Policy. The current reimbursement guidelines and procedures have been in effect since October 1, 1996 and have also been applied to reimbursement related to Councilmembers' travel. The most noteworthy changes from the initial policy which are reflected in the current Travel Policy are "meals are reimbursable on a per diem basis" only and "reimbursement for personal telephone calls (one arrival and one departure)up to a maximum of$5 for each call." Both policies are attached for your review and consideration. BUDGETARY EWPACT Appropriation of funds is available in the Travel & Training line item of the City Council Budget in the amount of$35,000 for FY2000. PURPOSE The purpose of this policy is to establish acceptable guidelines and procedures to be followed by members of City Council who in the performance of their duties are traveling outside the City of Beaumont. II. REIMBURSABLE EXPENSES Subject to the requirements and guidelines of this policy, all reasonable and ordinary travel expenses incurred in travel are reimbursable. A. Transportation. The mode of transportation is left to the good judgement of the individual who shall give due consideration to the time involved, safety, convenience, and cost of such transportation. 1. Private Auto. Should a person use his/her personal car, he/she will be reimbursed on the City's standard mileage allowance (allowed IRS mileage rate) for actual mileage generally up to the cost round trip coach plane fare. 2 . Public Transportation. Should public transportation be utilized, the actual cost is reimbursable when supported by receipts. Coach fare should be utilized on flights unless circumstances dictate i otherwise. t i B. Hotel/Lodging. The actual cost will be reimbursed supported by hotel receipt. C. Meals/Tips. - Expenses for meals/tips are reimbursable. The person may report total meals/tips expenses based on either: 1. Actual cost supported by restaurant receipts plus 15% tip allowance; or 2 . Thirty ($30) dollars per diem (meals/tips allowance) per person. This per diem is based on a meal cost of breakfast--$6, lunch--$9, and dinner--$15. Should registration cover a meal or if the person's meal is paid for by a third party, the appropriate meal cost should be deducted from the per diem. D. Registration. The actual cost will be reimbursed supported by receipt. Advance registration is encouraged to provide lower expense when available. E. Spouse Attendance. Spouses may travel at their own expense. The difference between the single and double room rate is reimbursable to the City. Travel cost and meals for spouses are not chargeable to the City. F. Telephone Telegraph. Charges for telephone calls and telegraph messages will be allowed for City business. Calls home are reimbursable but should generally be limited to advise of safe arrival and confirm departure time. Charges for telephone calls to one's principal place of business are reimbursable. G. Entertainment. Although charges for entertainment will be left to the good judgement of the person, the reporting of entertainment expenses will be accompanied by appropriate documentation and a statement that indicates: 1. Who was entertained; 2. Type of entertainment (i.e. , dinner; and, 3 . The purpose of such entertainment. H. Miscellaneous Expenses: All other expenses such as taxi fare, car rental, and parking fees are reimbursable, when such expenses are reasonable, ordinary, and necessary to the completion of City business and are documented by receipt when a receipt is normally made available, and the purpose of the trip. I. Lost Receipts: Duplicate invoices for lodging, registrations and transportation costs should be requested from the vendor to replace lost receipts. If receipts cannot be obtained, a signed affidavit identifying date, amount and purpose of the cost may be submitted to support the payment within five (5) days of return from the trip. These affidavits shall be approved by the Audit Committee prior to payment. III. ACCOUNTING FOR TRAVEL EXPENSES A. Advances. A cash advance of up to one, hundred fifty i ($150) dollars per day may be requested. Should an advance be requested, such request should be made on the standard "Travel Request and Report" form and such request should allow five (5) working days for j I e processing. An advance check will be issued attached to the expense report form. (Attachment A) B. Reporting. Upon returning to the City, the person should complete and sign the travel expense report and submit the report along with the required documentation. The report should be submitted within ten (10) working days from the date . of return. Additional advances will not be allowed until outstanding advances are cleared. C. Approval. Expense reports will be reviewed by the Finance Department for compliance with this policy. Air Transportation - Coach-class accommodations must be utilized unless circumstances dictate otherwise. When arranging air travel, departments may want to avoid fare restrictions that limit flexibility. However, if there is little likelihood that travel arrangements will change, airfare should be booked as early as possible and all discounts should be pursued. Two-for-one tickets are to be used only when both parties are City employees and both parties are on official City business. Airline tickets purchased for non-City employees should not be charged to the City. These tickets are to be paid for directly by the employee or the non-City employee traveling companion. 2. Personal Vehicle - Should a person use his/her personal car, he/She will be reimbursed at the City's standard mileage allowance (current IRS rate) for actual mileage, up to the cost of a round trip coach airfare. When more than one department employee or councilmember is traveling for the same purpose, carpooling is required unless such will cause undue hardship or time scheduling conflicts to occur. 0 3. City Vehicle - Where a department is assigned a City vehicle and more than one department employee is traveling for the same purpose, use of a City vehicle is required unless such will cause undue hardship or time scheduling conflicts to occur. A City-furnished vehicle should be used whenever it is reasonably available and a car is required for official travel. Employees will be reimbursed for gasoline, oil and emergency repairs which are purchased during travel if these purchases are supported by receipts which show the date, time, and location of the purchase. Non-city employees may not travel in City vehicles due to liability. 4. Rental Vehicle - Rental of a vehicle is authorized when it is more practicable and/or less expensive than the use of taxi cabs or other public transportation for official business. The size of the vehicle rented should be dictated by the number of staff traveling. An economy/compact car should be used when available. The cost of gasoline for the rental car is reimbursable. Receipts are required. 5. Other Transportation - The use of hotel courtesy vans or other transportation services such as Super Shuttle should be used whenever available. The use of taxi cabs is reimbursable. Receipts are required for any transportation costs over $5 per transport. . 6. Parking - Actual costs of parking are reimbursable with receipts. Parking meter fees and toll charges do not require receipts but a log showing the name and location must be submitted to receive reimbursement. B. Hotel/Lodging - The actual cost will be reimbursed when supported by a hotel receipt. Reservations should be made at the lowest rate available. If a guest accompanies an employee the incremental difference charged above the single occupancy rate is non-reimbursable. Lodging provided by family/friends is non-reimbursable. Meals, groceries, or gifts for people providing lodging to City employees is non-reimbursable by the City. C. Meals - Meals are reimbursable on a per diem basis. Under the per diem method, travelers will be reimbursed $38 per day for all meal and meal-related costs including gratuities. Partial per diem will be $8 per day for breakfast, $10 per day for lunch, and $20 per day for dinner. The maximum average daily rate of $38 is increased to $48 ($10 breakfast, $13 lunch, $25 dinner) for the following metropolitan areas: Boston, Massachusetts Chicago, Illinois New York City, New York Los Angeles, California San Diego, California San Francisco, California Washington, D.C. D. Registration - Registration fees for local and out-of-town conventions, conferences and workshops are eligible expenses. These must be supported by receipts which shall include the agenda or program identifying all activities that are included in the registration fee. E. Telephone and Other Business Communications Expenses for telephone, telex, overnight mail, and fax for City business are reimbursable. The validity of these expenses must be supported by an itemized bill or receipt. Personal calls (one arrival and one departure call) may be reimbursed up to a maximum of $5 for each call. F. Tips/Gratuities - Gratuities for meals are included in the per diem rate. Actual cost of gratuities for purposes other than meals, such as porters or bellhops may be allowed up to a maximum of $10 per day, limited to the day of arrival and/or departure of business trip. G. Spouse/Companion Attendance - Spouses/Companions travel at their own expense. Generally the difference between a single and double room rate is reimbursable to the City. No travel costs, whether for transportation, lodging, meals or cost of attendance to events, for spouses/companions are reimbursable by or chargeable to the City. III. ACCOUNTING FOR TRAVEL EXPENSES A. Advances - A cash advance of up to one hundred fifty ($150) dollars per day may be requested. Should an advance be requested it must be made on the standard form, "Travel Advance Request, " (Attachment A) and must allow for a five (5) working day processing time. 6.1/Travel/12-1-99 Page 3 of 5 v An employee may be denied a travel advance if he/she: * Requests the advance less than five (5) working days before the advance is needed; * Has not submitted an expense report or previously completed travel; * Has not reimbursed the City for a travel advance which exceeded the actual cost of travel that has been completed; * Consistently submits the travel expense report late (more than five (5) days after travel is completed) . If the trip is canceled, the advance check must be returned immediately by the employee to the department. The department must void the check by clearly marking "VOID" on the check in ink and return it to the Controller's Office within five (5) working days. The check should not be held for later use. B. Expense Reporting - Upon returning to the City, the employee must personally complete and sign the standard form, "Travel Expense Report." The original report must be submitted to Accounting, along with the required documentation, within five (5) working days from the date of return. If a refund is due the City, the employee must submit a copy of the completed expense report along with remittance of the funds to Central Collections. The original expense report and a copy of the receipt of funds from Central Collections must be submitted to Accounting. The employee may indicate on the expense report that a payroll deduction is preferred. If reimbursement of funds are due to the employee, the employee must submit the completed expense report to Accounting. A reimbursement check should normally be issued with the next regular accounts payable check cycle. C. Approval - Department directors will approve travel requests for their respective divisions. Expense reports will be reviewed by Finance for compliance with this policy. The property owner has been unable to sell the subject property for commercial uses. The "West Oakland/Pear Orchard" Neighborhood Plan designates the area between Eleventh Street and the Santa Fe Railroad for commercial uses. The City plans to build new homes south of Waverly and west of Eleventh Street, thus it is important to consider any zone changes to surrounding property. The US Army Corps of Engineers will contribute 50% of the cost or $3.48 million and the remaining $3.48 million will be paid with a local match among governmental entities. The feasibility study will be conducted by the Corps of Engineers over a four-year period. The feasibility study will commence after the Feasibility Cost Sharing Agreement has been executed and Federal and sponsors' funds are made available to the Corps of Engineers - Galveston District. The City of Beaumont would pay the $300,000-$500,000 in year four of the study which is anticipated to be in FY 2003. A range is proposed because of the uncertainty of the amount of financial contributions from the other governmental agencies and industry. BACKGROUND The Federal Government has a completed reconnaissance study that concluded channel enlargement is potentially feasible and it is in the interest of the Federal Government to conduct a more detailed feasibility study of the Sabine Neches Waterway. Three deepening alternatives with three incremental widths for a total of nine different plans will be analyzed at a level of detail sufficient to determine the recommended plan. The feasibility study will be conducted by the Corps of Engineers. The Navigation District has pledged $550,000 toward the feasibility study. Jefferson County and the Port of Beaumont are projected to fund $500,000 each. The Lower Neches Valley Authority as well as Port Arthur and mid-county cities have not pledged any funding as of this time although they are considering a contribution. A Nederland industrial business is committing $100,000 towards the study. The County Judge established a Deepening and Widening Committee to develop local industry support for the feasibility study. Based on recent discussions with various groups, it does not appear that local industry will provide significant financial support toward the study. Congested traffic conditions on the Sabine Neches Waterway are a major problem. Relatively narrow channel widths and the lack of passing areas to accommodate movement of two large deep- draft vessels cause arrival and departure delays. The restrictions of vessel movements result in economic penalties that are costly to the shipper, to the ports, and in turn to the ultimate customer. A completed project, which improves navigation, would lead to tremendous economic growth, a larger tax base, and jobs. BUDGETARY IMPACT Depending on the funding level approved by Council, the City would budget a pro rata share in fiscal years 2001, 2002 and 2003 to ensure funds are available in the fourth year of the study. PREVIOUS ACTION On Tuesday, November 2, 1999, City Council discussed in a work session the financing issue of the feasibility study. SUBSEQUENT ACTION None. Sabine-Neches Waterway, Texas Project Study Plan In the late seventies the federal government did a study on enhancing navigation of the Neches River. The study was completed in the early eighties at about the same time as the crash in the oil.business. There has been a remarkable change in the world economy since then. Refineries and chemical plants have much more competition world wide from companies operating with much less stringent environmental rules, which makes production less costly. Shipping has also undergone major change since the 1970's. Ships are larger making it impossible for some of them to use the Neches River. Since we currently have only one way traffic, ships sometime have to wait days to navigate the river causing demurrage charges of$25,000 a day. Congress decided to address these problems by passing the W.R.D.A. Act, (Water Resources Development Act). The legislation among other things authorizes deepening and modification projects at the nation's ports. Improving navigation infrastructure generates economic returns at the local, regional, and national levels; and also contributes to the national defense. Current projects include the Columbia River in Oregon, Ports of Baltimore, MD, Oakland, CA, Savannah & Brunswick, GA, Jacksonville and Tampa, FL. Within the state of Texas, a deepening project is underway at the Port of Houston. Also, Corpus Christi is conducting a feasible study to make channel improvements. Our area is already behind the competition making it critically important to complete a project study plan at once. The government, at its expense, has completed a reconnaissance study that concluded channel enlargement is potentially feasible and it is in the interest of the Federal Government to conduct a more detailed feasibility study of the Neches River. Three deepening alternatives with three incremental widths for a total of nine different plans will be analyzed at a level of detail sufficient to determine the recommended plan. A completed project, which improves navigation, could lead to tremendous economic growth, a larger tax base, and jobs. Several hundred million federal dollars would be invested in the project making our area one of the leading transportation centers in the nation. We have 1-10, the nations longest freeway connection, four rail lines, and we would have an improved deep-water channel with inland protection from hurricanes. If the plan is to go forward we must come up with '/2 the cost of the study which would amount to around $3.48 million dollars. One half of this could be "in kind" contributions such as direct contracts with engineering services and local universities for part of the study. The fee would be paid to the government over a four-year period. Many feel the project could lead to economic development similar to the Houston ship channel, or Bush Intercontinental and DFW airports. The downside is if we do not go forward we could lose some of our industries•to more cost-effective locations and the jobs they produce. County Judge Carl Griffith has appointed a Ship Channel and Navigational Improvement Committee chaired by C. L. Sherman, Jr. and members of area Chambers G/:GOVir-.y of Commerce, the Jefferson County Navigation District, Ports of Beaumont, Orange, Port Arthur, and Sabine Pass, economic development groups and area industries. The Beaumont Chamber of Commerce has passed a resolution endorsing the concept of enhancing the navigability of the ship channel and strongly urges business, economic development and government entities and industry to make commitments to fund the study. Strong support has been offered by the Navigation District, the Port of Beaumont, and Jefferson County. The committee will soon be contacting others for financial commitments to complete the study. The project is being maintained at its authorized depth of 40 feel: and includes about 65 miles of deep-draft channel. This area is about 75 miles northeast of Galveston, Texas, and borders the southeastern end of the state of Louisiana. The :study area is shown as Figure 1. A reconnaissance study was undertaken to determine whether commercial navigation benefits produced by enlarging the Sabine-Neches Waterway are sufficient to offset the costs and environmental consequences of the enlargement:. The reconnaissance study also identified existing water resource problems and needs through coordination with Federal and State agencies, area residents, waterway users, and the project sponsor. Most of the identified problems are not unique to this area but are common to many of the bays and estuaries in Texas. The reconnaissance study concluded that channel enlargement is potentially feasible and that it is in the Federal interest to conduct more detailed, feasibility-level studies. The feasibility study is scheduled to begin in April 1999, after the Feasibility Cost Sharing Agreement (FCSA) has been executed and Federal and sponsor's funds for Fiscal Year (FY) 1999 are made available to the District. This Project Study Plan (PSP) presents the activities required to accomplish the feasibility study and submit a feasibility report to Congress for authorization. The cost of the feasibility study will be shared equally between the Corps and the study sponsor, Jefferson County Navigation District. The schedule for the feasibility study phase can be found in Section VI of this document. STUDY TEAM The PSP for feasibility studies to be conducted on the Sabine-Neches Waterway, Texas Project, was prepared by the District's study team in cooperation with the study sponsor. All team members contributed toward the identification of work to be accomplished, the necessary funding, and an acceptable schedule which complies with District and sponsor work plans, budgets and manpower constraints. The endorsement page, required by EC1105-2-208, is provided as Attachment 1. 2 SECTION II - STUDY PROCESS AND SCOPE OF WORK This section identifies the work required by each District function during the feasibility study phase and the contribution that the study sponsor will be making toward each activity. The work effort and estimated costs are based on the following study criteria: • Three deepening alternatives with three incremental widths, for a total of nine different plans, will be analyzed at a level of detail sufficient to determine the recommended plan. The channel depths to be analyzed will be provided by the Planning, Environmental, and Regulatory Division. The channel widths will be determined by the Engineering Division based upon the design economic vessels provided by the Planning, Environmental, and Regulatory Division. The design vessel for each of the nine reaches below will be provided by the Planning, Environmental, and Regulatory Division. Only one dredged material placement plan will be developed for each of the nine alternatives at this stage. Each alternative will be divided into the following increments for quantity computations, dredged material placement plans, and cost and benefit estimating purposes: • Sabine Bank and Outer Bar Channel • Entrance (Jetty) Channel • Sabine Pass Channel and Anchorage • Port Arthur Canal and Turning Basin • Sabine-Neches Canal Neches River, Channel to Beaumont • A dredged material placement plan will be developed to contain both new work dredging and the estimated 50-year maintenance requirement. During development of the channel optimization study (the ten alternatives in paragraphs above), the dredged material placement plan developed will be preliminary in nature. Once a channel design is selected, a detailed dredge material placement plan will be developed, which will include maximizing beneficial uses of dredged material. These plans will be used to determine the recommended dredge material placement plan. • The PER will determine and furnish the design vessel sizes which will be used in channel optimization studies. • A without-project 50-year Dredged Material Management Plan (DMMP) will be developed from the existing 20-year DMMP. • The engineering studies will be performed to a level of detail as to preclude preparation of a Project Design Memorandum. An Engineering Appendix will be prepared in accordance with ER 1110-2-1150. The Engineering Appendix will consist of narrative 7 and plates required to document the engineering studies conducted and the results of those studies. 8 CESWG-PE-P 7 August 1998 SECTION 905(B) (WRDA 86) ANALYSIS SABINIrNECHES WATERWAY, TEXAS 1. STUDY AUTHORITY: This study is authorized by the Senate Committee on Environment and Public Works Resolution adopted 5 June 1997 which reads: That the Secretary shall review his previous reports on the Sabine-Neches Waterway published as Senate Document No. 80, 83 d Congress, Second Session; House Document No. 553, 87`' Congress, Second Session; and other pertinent reports to determine the feasibility of modifying the channels serving the Ports of Beaumont, Port Arthur, and Orange, Texas in the interests of commercial navigation. The District received $100,000 in Fiscal Year 1998 to conduct the reconnaissance phase. 2. STUDY PURPOSE: The purpose of this study is to determine the need for Federal navigation improvements for the Sabine-Neches Waterway, Texas. The study will also investigate opportunities for ecosystem restoration, including beneficial use of dredged material. r 3. LOCATION OF PROJECT/CONGRESSIONAL DISTRICT: The Sabine-Neches Waterway, Texas project is located (see Figure 1) in the vicinities of Beaumont, Port Arthur. Orange, and Sabine Pass in Jefferson and Orange Counties, Texas, and Cameron and Calcasieu Parishes, Louisiana. The Sabine-Neches Waterway is a 75 mile-long deep draft channel which extends from the 42-foot contour in the Gulf of Mexico through a jettied Channel to Port Arthur, to Beaumont via the Neches River Channel and to Orange via the Sabine River Channel. The study area is located in the jurisdiction of the following legislators: US Senator Phil Gramm (R) US Senator Kay Bailey Hutchinson(R) US Representative, 2nd District—Jim Turner (D) US Representative, 9`h District -Nick Lampson (D) 4. DISCUSSION OF PRIOR STUDIES REPORTS AND EXISTING WATER PROJECTS: A Draft Feasibility Report was completed on the Sabine-Neches Waterway in April 1982. The report determined that it was feasible and advisable to deepen and widen the Sabine-Neches Waterway. The selected'plan recommended a channel 52 feet deep at the Gulf Entrance and a channel 50 feet deep for the Sabine Pass Channel, Port Arthur Canal, Sabine- 1 Neches Canal, and the lower 12 miles of the Neches River Channel. The plan also included widening of the Sabine-Neches Canal, located adjacent to Port Arthur, from 400 feet to 500 feet to reduce traffic congestion and delays in this reach of the waterway which also sen-es as pan of the Gulf Intracoastal Waterway (GIWW). The selected plan was not implemented because the local sponsor withdrew their support of the project. A Reconnaissance was Report m p completed on the Channel to Orange in Februan 1994. The report showed a need and opportunity to increase the efficiency of the Channel to Orange by increasing the channel depth from 30 to 35 feet. However, the benefits were considered too speculative to warrant moving into feasibility phase. 5. PLAN FORMULATION a. Identified Problems: (1) -Existing Conditions: The existing 40-foot channel to Port Arthur and Beaumont a-as designed to efficiently and safely accommodate vessels of approximately 40,000 DWT Mth drafts of 36 feet. Since the authorization of the existing project, the size and draft of vessels calling on the Sabine-Neches Waterway have significantly increased to meet the competitive demand for more efficient movements of bulk commodities, particularly crude petroleum. Tankers loaded to depths greater than the designed safe operation depth of 36 feet frequently transit the waterway to industrial sites at Port Arthur and Beaumont. These vessels include tankers with deadweight tonnages ranging in size from 67,000 to 150,000 tons. Over 30% of 1996 to 1997 deep draft vessel trips consisted of vessels with beams of over 130 feet. lengths of 800 feet or more, and fully-loaded drafts in excess of 50 feel, which move on the watenvav light-loaded. Congested traffic conditions are a major problem, especially in the Sabine-Neches Canal because it also serves the through traffic of the GIWW. The larger volume of barges and shallow-draft vessels in this reach of the waterway in addition to the deep-draft traffic moving to or from Port Arthur, Beaumont, and Orange, greatly compound safety problems. and make maneuvering extremely complicated. Relatively narrow channel widths and the lack of passing areas to accommodate movement of two large deep-draft vessels cause arrival and departure delays. The restriction of vessel movements result in economic penalties that are costly to the shipper, to the ports, and in turn to the ultimate customer. In addition to the increased vessel operating costs caused by traffic delays, restricted vessel movements have also resulted in inefficient use of docking facilities, particularly at Beaumont. Vessels in port are frequently confronted with delayed departure times, and arriNin; vessels often experience long waits for the waterway to be cleared for inbound movements. (2) Expected Future Conditions: Vessel movements to Beaumont and Port Arthur «ill continue to be restricted as well as subject to navigational hazards resulting from congested traffic conditions. Without the ability to increase the efficiency of transportation, waterbome 2 commerce, particularly crude petroleum, will experience a gradual loss of efficiency and could result in local industry losing some comparability with those in other ports along the Gulf Coast. The number of vessels constrained by the dimensions of Sabine-Neches Waterway is expected to increase because of other ports that already have deeper and wider channels. The transport of commodities is expected to increase mainly due to the increase in crude petroleum from Mexico and South America. Without the increase of channel depths and widths to accommodate the increased commodity transport more vessels will need to make lighter drafting trips. (3) Concise Statements of Specific Problems and Opportunites. The major problem on the Sabine-Neches Waterway is the inefficient movement of bulk commodities by vessels which are forced to light load their cargo and/or delays in transversing the waterway. Other water resource problems and needs relate to the safety of the waterway, traffic delays, environmental quality, severe bank erosion along the Port Arthur Canal, preservation of critical fish and wildlife habitat in adjacent areas, availability of environmentally acceptable placement areas, and concerns of limited economic growth. b. Alternative plans: The likely alternative plans to be studied in the feasibility phase consist of the following depth and width combinations: - Deepen the channel to 47 feet deep at the Gulf Entrance and 45 feet on the Sabine Pass Channel, Port Arthur Canal, Sabine-Neches Canal, and the Neches River Channel; - Deepen the same reach described above to 52 feet at the Gulf and 50 feet for the inland channels; - Widen the Sabine-Neches Canal and d he Neches River Channel from 400 feet to at least 500 feet; Deepen the Channel to Orange to 35 feet; Widen the Channel to Orange to 300 feet. c. Evaluation of Alternatives: The alternative analyzed is a channel 47 feet deep at the Gulf Entrance and a channel 45 feet deep on the Sabine Pass Channel, Port Arthur Canal, Sabine-Neches Canal, and the Neches River Channel. This alternative also includes widening of the Sabine-Neches Canal from 400 feet to 500 feet. The widening of the Neches River Channel was not considered in this evaluation. The Sabine Pilots Association has stated that widening this portion of the waterway would not lift the one way traffic restriction on this portion of the waterway. Their concern is with the docks and ships that are berthed along this reach. The force created by two tankers passing each other could pull a vessel into the channel and/or damage the docks. The benefits attributable to project improvements were estimated based on recent historical tonnage levels and the current fleet of vessels using the waterway. In addition, published forecasts for the major commodity groups were� y g p e reviewed to identify general long-term-term trends g g for deep-draft movements to the U.S. Gulf Coast ports. Crude petroleum imports currently 3 comprise about 80 percent of the deep-draft tonnage total. The reconnaissance level benefits for deepening the channels to Port Arthur and Beaumont were calculated using 1996 and 2010 tonnage levels. The forecasted trade route and shipment distributions used to calculate the 1996 and 2010 crude petroleum benefit estimates reflect a larger percentage of shipments from Mexico and South America and a higher percentage of lightering, lightening, and transhipping than the 1996 Port Arthur and Beaumont records did. Therefore, the benefit estimates reflect a more conservative estimation of the transportation savings than would have been obtained from direct application of the 1996 port specific distributions. It should be noted that the deepening benefits do not reflect consideration of depth constraints at the foreign ports of origin or destination; however, benefits were only calculated for tonnages which are currently shipped in vessels with design'drafts of 40 feet or more. The benefits for widening the Sabine-Neches Canal from 400 to 500 feet were estimated utilizing 1996 and 1997 transit records obtained from the Sabine Pilots Association and the 1996 annual trip statistics from ocean going vessels derived from the Waterborne Commerce of the U.S. Presently, the Pilots guidelines only allow for daylight traffic and do not permit meetings between vessels with combined beam widths in excess of 200 feet to meet in the Sabine-Neches Canal. Vessels with combined beams greater than 200 feet are allowed to meet during daylight hours in the portions of the waterway which are at least 500 feet wide. The Pilots said that widening of the 12-mile long Sabine-Neches Canal from 400 feet to 500 feet would not result in a change in the daylight only limitations. The "with project" condition .vas, therefore, calculated based on a scenario which, all things being equal, would allow unrestricted daylight passages from the offshore entrance channel to the mouth of the Neches River. Based on 1996 traffic levels, the analysis showed that an easement of current meeting restrictions would result in annual savings of $370,000. Vessel safety issues and the cost associated with minimizing potentially dangerous conditions would be addressed during feasibility. The annual benefits for deepening and widening improvements assessed in this reconnaissance for the 50-year project life are estimated to be in excess of S23,000.000. The costs associated with this scenario are due to the initial new work dredging of approximately 60,690,000 cubic yards of dredged material, the lowering of 65 pipelines, and the raising of 14 upland placement areas. The first year cost for all new work is S260,270,000. This is equivalent to $19,160,000 average annualized cost. It is assumed that the same dredging cycle will continue over the 50-year project life. The average annualized cost for maintenance dredging including levee construction is $2,940,000. The annual costs for deepening and widening improvements assessed in this reconnaissance for the 50-year project life are estimated to be approximately $22,100,000. For the purpose of comparison, a deepening-only alternative was considered. The alternative analyzed the same channel dimensions as the previous scenario without widening the Sabine- Neches Canal. The average annualized benefits are equivalent to $22,600,000 and the average annualized costs are $19,000,000. The Sabine-Neches Waterway runs through extensive salt marsh wetlands up to the Neches River and brackish to fresh water wetlands along the Neches River. The present navigation 4 project has impacted these wetlands by allowing higher salinity water to migrate upstream in greater volumes than was possible before the project was constructed. Sediments flowing down the Neches River have been collected that would normally have been transported over the river banks to nourish the marshes during floods. Due to a lack of new sediments and land subsidence, the marshes are declining, particularly along the lower Neches River. A deepening project may have additional salinity intrusion impacts on surrounding wetlands. These impacts and associated wave erosion impacts will have to be assessed in any future studies. Widening the channel by 100 feet along the Sabine-Neches Canal may not add to wetland impacts since very little marsh remains in this reach. The National Environmental Policy Act regulations require coordination with State and Federal resource agencies to minimize adverse impacts to wetlands and other resources of concern. It will also be necessary to identify potential beneficial uses for the new-work material dredged from the channel. Impacts to Federal-listed threatened or endangered species are expected to be minimal. However, sea turtles may be affected by hopper dredge work during offshore project deepening. Additional surveys will be required to complete the inventory of historic properties that may be affected by the project. It appears that none of the significant Confederate-era sites and shipwrecks in the vicinity of Sabine Pass will be affected by the project as envisioned at this time. Remote-sensing marine surveys of the Sabine-Neches Canal and the Neches River Channel must be conducted to determine if shipwrecks are present that could be impacted by the proposed new work. Terrestrial impacts to historic properties are expected to be minimal. Upland impacts should be limited to the construction of placement and beneficial use areas, and may require additional surveys. The navigation channel passes through a highly urbanized area with a large concentration of petrochemical plants and associated industries located along the banks. Hazardous, Toxic, and Radioactive Waste (HTRW) problems exist in the area in the form of several known industrial waste sites and at least one Superfund site near the navigation channel. Due to industrial waste sites and unauthorized waste disposal activities, the probability exists for encountering an unknown waste site during project construction. Therefore, future studies of project impacts will assess current water quality condition, update baseline HTRW information, identify potential waste sites, and assess relative risks for HTRW problems that may be encountered in the project. The specific land requirements for this project are not yet available, however generally speaking the material from the proposed improvements to the navigation channel will be contained in existing upland placement areas, except in the offshore reach where the material will be removed to open water placement areas. Since many of the existing upland sites were acquired with temporary or revocable easements there is a high probability that a significant number of new permanent easements will be required. Given the industrial development of the project area, real estate acquisition will represent a significant financial commitment on the part of the local sponsor. Along with the acquisition of new easements over the upland sites, the local sponsor will be required to provide access road and dredge pipeline routes to the various sites. Although the mitigation features of the project are presently unknown it is highly likely that 5 riiiiigation for a project of this scope may require acquisition of a significant amount of land. There are approximately 65 pipelines that will constitute obstructions to the new channel template. Privately-owned facilities that are obstructions to federal channels are subject to navigation servitude and to Section 10 permit restrictions. Removal of such obstructions is usually at the owner's expense. 6. FEDERAL INTEREST: This preliminary analysis shows that deepening and widening the Sabine-Neches Waterway has greater benefits than costs. Further study during the Feasibility Phase has the potential to identify additional benefits from various deepening and N idening combinations, as well as potential environmental restoration alternatives. 7. PRELLNfINARY FINANCIAL ANALYSIS: In a letter dated August 1998 (copy attached), the Jefferson County Navigation District; --- expressed an intent to, "act as (joint) local sponsor on this project." The (joint) local sponsor have reviewed and accepted this analysis as submitted. 8. RECOMMENDATIONS: Based on these findings, I recommend this analysis be certified as being in accordance with current policy and that the feasibility study be conducted. 9. POTENTIAL ISSUES EFFECTING INITIATION OF FEASIBILITY PHASE: There are no apparent issues at this time that impact on implementation of the feasibility phase. 10. RECOMMENDATION Administration recommends approval of an annual contract with a one year renewal option beginning January 1, 2000 with Beaumont Products and Services, Inc. (BPS) for basic grounds maintenance services at City facilities and specified areas within Beaumont's Central Business District (CBD). BACKGROUND BPS has provided grounds maintenance and litter removal services for the past four (4) years. Grounds maintenance services include mowing, edging, sweeping and litter removal for the grounds at City Hall, Civic Center, Beaumont Public Library, Police Building, Julie Rogers Theatre, Tyrrell Historical Library, Delia Harrington Park, Henry Dannenbaum Transfer Facility, Riverfront Park and the CBD medians and boulevards. Mowing and edging are performed on a weekly basis during the growing season, March 1 through October 31. Biweekly mowing is required during the dormant season. At Riverfront and Delia Harrington Parks, edging and sweeping of sidewalks and paved areas are performed at the time of mowing. Sweeping of walkways around the municipal complex is performed three times per week. All other areas are swept in conjunction with mowing. Litter removal services are required three days per week for removal of trash and debris from all City facilities and parking lots. This contract is exempt from competitive bidding because the service is provided by a state certified workshop. BPS is a private-not-for-profit state certified workshop employing disabled individuals. This price includes a monthly fee of $750 for the Henry Dannenbaum Transfer Facility paid directly by Beaumont Municipal Transit, resulting in an annual net cost to the City of$102,720. Funds for the City's portion are budgeted in the Solid Waste Fund. The previous total contract price for a two (2) year period, beginning January 1, 1998, was $102,720. The increase can be attributed to increases in costs for labor, insurance and materials and twice daily litter removal from the Henry Dannenbaum Transfer Facility in lieu of once per day. Chaney & Associates, Inc. Therefore, the Administration recommends approval of a one-year renewal contract with Carolyn C. Chaney & Associates, Inc. in the amount of$53,130. The contract will be effective January 1, 2000. The contract will also include a maximum of$4,000 for reimbursable expenses. The contract amount and reimbursable expenses have remained the same as in last year's contract. The only change is that the City will pay the monthly installments at the end of each month instead of before the first of each month. The return to the City of Beaumont both in information services and help with federal funds will be monitored and evaluated over the next year if the contract is approved by Council. The Administration would use the funds for economic development purposes such as job creation and business recruitment efforts if the City Council chooses not to renew the contract or considers a reduced allocation. BACKGROUND On a yearly basis since 1980, the City has contracted with an organization to provide legislative services on the federal level. Ms. Chaney, as the City's Washington Assistant, is responsible for reviewing federal executive proposals, legislation under consideration, and proposed and adopted administrative rules and regulations which could impact the City of Beaumont's policies or programs. Consultant will organize and operate a unit to act as a Washington office for the City. Additionally, the Consultant will act as liaison with the U.S. Conference of Mayors and the National League 1 of Cities, and will furnish legislative and administrative analyses of issues; E. As Washington Assistant the Consultant will secure and furnish such detailed information as may be available on federal programs in which the City indicates an interest; F. As Washington Assistant the Consultant will review and comment on proposals of the City which are being prepared for submission to federal agencies when requested to do so by the City Manager or his designees; G. As Washington Assistant the Consultant will maintain liaison with the City's Congressional delegation and will assist the delegation in any matter which the City determines to be in its best interest in the same manner as any other member of the City's administrative staff might render assistance; H. As Washington Assistant the Consultant will counsel with the City regarding appearances by City personnel before Congressional committees and administrative agencies and will arrange for appointments and accommodations for City personnel as necessary; I. Obligations of the City of Beaumont, Texas A. To advise the Consultant of the name or names of persons other than the City Manager authorized to request service and the person or persons to be kept advised by the Washington Assistant; B. To supply the Consultant with a summary of all federal programs in which the City is participating and advise the Consultant of any new applications filed, together with pertinent details as to the substance of such applications; C. To supply the Consultant with copies of budgets, planning documents, and regular reports of the City Manager and departments, Council agenda and proceedings, newspapers and other materials which will assist the Consultant in keeping current on City policies and programs; D. The City of Beaumont, Texas and the Consultant concur that the following exclusions shall apply to this Agreement: A. The Consultant: 1.
