The term would commence October 12, 1999 and expire October 11, 2001. (Councilmember Becky Ames) Don Vallier would be appointed to the Library Commission. The term would commence October 12, 1999 and expire October 11, 2001. (Councilmember Bobbie Patterson) Marie Carter would be appointed to the Parks and Recreation Advisory Committee. The term would commence October 12, 1999 and expire October 11, 2001. (Councilman Andrew Cokinos) A) Approve a contract for the purchase and installation of carpet at the Tyrrell Historical Library Administration recommends approval of a contract with Porter's Carpets of Beaumont in the amount of$34,389.80 for the purchase and installation of carpet at the Tyrrell Historical Library. New carpet will be installed on the main level and second floor level of the Library. The carpet is worn and in several areas has become detached from the floor. Funds for this expenditure are provided through the oil, gas and mineral lease revenues specifically dedicated to the Tyrrell Historical Library. A copy of the staff memorandum is attached for your review. B) Approve a contract for the purchase of lubricants to be used by City departments for maintaining equipment Administration recommends approval of a six-month contract for purchasing lubricants to Pumpelly Oil Company of Sulphur, Louisiana at the unit costs reflected in Exhibit"A", attached hereto, with an estimated total expenditure of$27,063.40. The contract specifies that the successful bidder shall provide approximately 9,055 gallons of various lubricants at fixed unit costs. The sales tax impact analysis was applied to the local vendor's bid,but did not alter the bid standings. A copy of the staff report is attached for your review. C) Approve the purchase of properties for the Concord Road Improvement Project 1) Property at 3383 Concord Road (0.049 acre out of Lot 5 of the Comstock Addition) would be purchased from Mr. and Mrs. James C. Young for the appraised value of$18,000. 2) Property at 2381 Delaware Street (0.018 acre out of Lot 1, Block 1 of the Cousins Second Addition and out of Lot A-1,Babe Moore Addition)would be purchased from Mr. and Mrs. Wilson Isadore, Jr. in the amount of$7,598. 3) Property at 2365 Delaware Street (0.011 acre out of Lot 4, Block lof the Cousins Addition) would be purchased from Marian J. Tatum in the amount of$9,006. The properties were appraised by Bishop Real Estate Appraisers, Inc. A copy of the staff report is attached for your review. Y RECOMMENDATION Administration recommends award of a bid for furnishing and installing new carpet at the Tyrrell Historical Library to Porter's Carpets in the amount of$34,389.80. BACKGROUND Three bids were received for removing the old carpet from the main level and second floor level of the Library and installing new carpet. The carpet was installed in 1989 when the Library was renovated. The carpet is worn and in several areas has become detached from the floor. A 41 oz. carpet manufactured by Patcraft with an Everbond cushion backing designed for heavy traffic use was specified. The successful contractor will be responsible for moving the furniture during installation. Work will be performed after hours and on weekends so as not to interfere with patrons utilizing the Library. The Contractor will also provide a one (1) year warranty on all materials and workmanship. BUDGETARY IMPACT Funds for this expenditure are provided through the oil, gas and mineral lease revenues specifically dedicated to the Tyrrell Historical Library. RECOMMENDATION Administration recommends award of a six (6) month contract for purchasing lubricants to Pumpelly Oil Company at the unit costs reflected in Exhibit "A", attached hereto, with an estimated total expenditure of$27,063.40. Nineteen (19) vendors were notified with four (4) submitting bids. The specifications for products bid by Pumpelly Oil Company have been reviewed by Fleet Management Division personnel and meet requirements set forth in the bid. The sales tax impact analysis was applied to the local vendor's bid, but did not alter the bid standings. BUDGETARY IMPACT The contract provides for the vendor to furnish approximately 9,055 gallons of lubricants at fixed costs as reflected in Exhibit "A". Owner: Marian J.Tatum Administration recommends authorization to acquire these properties. BACKGROUND Parcel 55 is in Phase II with a total of 53 parcels. Parcels 100, 100A and 103 are in the Draina e portion of Phase II of the Concord Road Improvement Project which has 16 parcels. g BUDGETARY IMPACT This project is funded under the Capital Improvement Program. PREVIOUS ACTION There are thirty-four parcels acquired in Phase H since June 1998 and authorization for eminent domain has been approved for one parcel. On the Drainage Phase, three parcels have been acquired since July 1999, two parcels have been foreclosed on by the County and Council has granted authority of eminent domain for these parcels. SUBSEQUENT ACTION Three offers are pending on Phase II and the owners of five parcels have accepted the appraised value. Jefferson County has foreclosed on the owners of five parcels. By law the property must be condemned to be able to acquire a portion of the lots for the right-of-way. On Phase II of the Drainage Phase, seven offers are pending and the owners of four parcels have accepted the appraised value for their property. RECOMMENDED BY City Manager, Public Works Director and City Engineer. Sherman to the Jefferson County Appraisal District Board of Directors. RECOMMENDATION Mayor David Moore requested that this item be placed on the agenda for consideration. The Administration recommends approval of the nomination of Mr. Sherman. BACKGROUND The terms of the current Board members expire on December 31, 1999. All governmental entities within Jefferson County have an opportunity to submit nominations for the Board of Directors. Entities wishing to do so must adopt a resolution making the nomination and file it with the Jefferson County Appraisal District prior to October 15. BUDGETARY IMPACT None. PREVIOUS ACTION C.L. Sherman currently serves on the Board of Directors. He was nominated by the City Council to the Board in 1997 and was elected to a two-year term which began January 1, 1998. SUBSEQUENT ACTION Before October 30, each entity entitled to vote will be mailed a ballot listing all nominees. Each entity will then cast its votes, again by resolution adopted by the governing body, and submit the resolution back to the Jefferson County Appraisal District before November 15. Before October 15 By resolution adopted by the governing body, each entity submits nomination to the Chief Appraiser (with exception of conservation and reclamation districts). An entity may submit a nomination for each of the five positions on the Board. Before October 30 Chief Appraiser prepares a ballot and delivers a copy to the presiding officer of each entity entitled to vote. RECOMMENDATION Administration recommends award of annual contract for purchasing fittings, pipes and couplings to vendors at the unit costs reflected on the attached tabulation, with an estimated total annual expenditure of $252,656.03. BACKGROUND Bids were requested for an annual contract for couplings, brass fittings, plastic tubing and other water-related materials for use by the Water Utilities Department. The materials are used in the repair of existing water lines, installation of new water service lines, and in the maintenance of existing water mains and meters. The materials are utilized to maintain adequate water service throughout the City. Fifty-one (51) vendors were notified, with five (5) responding with bids. Specifications stated that the contract would be awarded to the low bidder per item. The sales tax impact analysis was applied to local vendors' bids and altered the bid standings in six (6) instances. The low bidders for each item are identified in Exhibit "A", attached hereto. The estimated annual expenditure to each vendor under the contract is as follows: $51,514.88 to Coburn Supply, $136,106.75 to Golden Triangle Pipe, $4,873.00 to Hughes Supply, and $60,161.40 to SPI Municipal Supply. RECOMMENDATION Administration recommends award of an annual contract for purchasing corrugated polyethylene pipe to Coburn Supply at the unit costs reflected in Exhibit "A", attached hereto, with an estimated total expenditure of$85,718. BACKGROUND The contract specifies that the successful bidder shall provide approximately 17,000 feet of various size corrugated polyethylene pipe at fixed unit costs for one (1) year from date of award for use by the Public Works Department, Streets and Drainage Division. The pipe is utilized by the Streets and Drainage Division to replace driveway pipe during cleanout of City ditches. Existing pipe which is damaged, improperly sized, or not set at correct grade is replaced as needed. Thirty-one (31) vendors were notified with seven (7) submitting bids. The product bid by Coburn Supply has been utilized previously and meets specifications set forth in the bid. BUDGETARY IMPACT The contract provides for the vendor to furnish approximately 17,000 feet of corrugated polyethylene pipe at fixed costs as reflected in Exhibit "A". The total estimated expenditure is $85,718 for the one (1) year contract period. Funds are available for this expenditure in the Public Works Department's operating budget. BUDGETARYIMPACT None PREVIOUS ACTION None SUBSEQUENT ACTION None RECOMMENDED BY City Manager and Clean Community Department Director • RECOMMENDED MOTION Approve/deny authorization for the Clean Community Department to apply for and receive grant funding from the South East Texas Regional Planning Commission for FY2000 Solid Waste Implementation Projects. 5 October 12, 1999 Consider an ordinance requiring Entergy/Gulf States to book and suspense revenues from the River Bend Nuclear Plant associated with the bankruptcy of Cajun Electric Co-Operative ORDINANCE NO. • AN ORDINANCE REQUIRING ENTERGY GULF STATES TO BOOK AND HOLD REVENUES FROM THE SALE OF POWER FROM THE RIVER BEND NUCLEAR STATION ATTRIBUTABLE TO THE 281 MW ACQUIRED FROM CAJUN ELECTRIC COOPERATIVE IN A SUSPENSE ACCOUNT PENDING FINAL DETERMINATION OF THE REGULATORY TREATMENT OF THAT PORTION OF RIVER BEND. WHEREAS, the City of Beaumont, Texas is a regulatory authority under Tex. Util. Code §33.001, and has original jurisdiction over the rates, operations, and services of Entergy Gulf States, Inc. (EGS) in the municipality; and, WHEREAS, on February 1, 1999, the City of Beaumont, other Cities, EGS, and other parties to EGS' rate case executed a settlement agreement which provided that the regulatory treatment of the 30% share of River Bend acquired from Cajun Electric Power Cooperative would be determined in the 2001 rate case; and, • WHEREAS, in May, 1999, the Texas Legislature enacted amendments to the Public Utility Regulatory Act (PURA) which froze rates until January 1, 2002, thus eliminating the EGS rate case contemplated in the settlement agreement of the parties in PUC Docket No. 20150, and the rate case required by the settlement agreement in the gulf States/Entergy merger case, PUC Docket No. 11292; and, WHEREAS, as a result of the legislative changes which eliminated the rate case required by the Commission's Order in Docket No. 11292 and contemplated in Docket No. 20150, the Public Utility Commission of Texas ordered EGS to address the regulatory treatment of the 30% of River Bend acquired from Cajun Electric Cooperative in its S.B. 7 implementation proceeding; and, WHEREAS, EGS or an affiliated company withheld power generated at River Bend • attributable to the 30% share from its Texas retail customers during the blackouts July 23, 1999; and WHEREAS, on July 23, 1999, EGS curtailed service to many firm distribution level customers because Entergy had insufficient power to supply its Texas retail customers. During such curtailments, power from the 30% of River Bend acquired from Cajun Electric Cooperative was sold off the Entergy system; and, WHEREAS, EGS is selling power generated at River Bend attributable to the 30% share off system; and, WHEREAS, the City Council, having considered the changes to the settlement agreement, PURA, the Public Utility Commission of Texas' orders concerning River Bend, EGS' service failures, and EGS' sale of power from the 30% of River Bend acquired from • Cajun Electric Cooperative off system, is of the opinion that the revenues from the sale of power attributable to the 30% share of River Bend should be segregated and held in a suspense account pending regulatory determination of the disposition. NOW, THEREFORE, BE IT ORDAINED BY THE CITY OF BEAUMONT Section 1. THAT EGS shall book and hold in a suspense account all revenues from the sale of River Bend power attributable to the 30% share acquired from Cajun Electric Cooperative pending regulatory determination of the appropriate regulatory treatment of such power. Such accounting shall begin with the settlement of the various lawsuits 11011 between EGS and Cajun Electric Cooperative in December, 1997 and shall include all • assets transferred to Entergy or EGS by Cajun at the price paid by Entergy or EGS for such acquisition. The booking should also reflect the value of nuclear fuel acquired from • Cajun, settlement proceeds, return of funds from the court registry, decommissioning funds, and revenues from the sale of power attributable to the 30% share of River Bend since December, 1997. The booking of revenues shall be updated monthly. Section 2. That EGS shall provide the required accounting information and underlying support in such detail and format, and with such frequency as Cities' consultants, DUCT, and attorneys, Butler, Porter, Gay & Day, request. Section 3. THAT nothing contained in this ordinance shall be construed now or hereafter as limiting or modifying in any manner, the right and power of the City under the law to regulate the rates, operations, and services of EGS. • Section 4. That if any section, subsection, sentence, clause or phrase of this ordinance, or the application of same to a particular set of persons or circumstances should for any reason be held to be invalid, such invalidity shall not affect the remaining portions of this ordinance, and to such end the various portions and provisions of this ordinance are declared to be severable. Section 5. That all ordinances or parts of ordinances in conflict herewith are repealed to the extent of the conflict only. I talked with Mr. Shepherd and offered to meet with him to better understand his concerns. I told him I wanted Barbara Day, our attorney, present by telephone to better understand and respond to EGS' concerns. Mr. Shepherd declined to participate in the meeting and indicated that he did not intend to appear at the Council meeting next week and object although EGS has not changed its position. I offered to provide the Council with any written information that he wanted to provide to us and he also declined that offer. Mr. Shepherd and I discussed EGS' concerns and they appear to be three: 1. They believe that all parties had agreed that the 30% share of River Bend would be dealt with at a later date. 2. They objected to the use of the term "unilaterally" which was included in a clause of the proposed ordinance. (I have agreed to remove that word from the ordinance.) 3. Now is not the time to take up this issue. The detail of my reasons for requesting that this ordinance be adopted at this time are set out in the agenda itinerary which you received with agenda item no. 12 on the October 5 agenda. 0 In summary, the coalition of cities had no intention of requesting that any action be taken with reference to the 30% share of River Bend until we discovered, when we met with EGS to talk about the black-outs, that on the same day that they were turning off the electricity for customers Mayor and City Council Page 2 October 8, 1999 in Beaumont, they were selling 281 megawatts of power from the River Bend Nuclear Plant (power related to the Cajun Electric Co-operative bankruptcy) outside the service area. Had that power been used in the EGS system, many outages could have been avoided since the 281 megawatts represented approximately 30% of the total load deficiency of 900 megawatts. The ordinance in question merely directs the company to account for the revenues associated with the 30% share of River Bend received from Cajun Electric Co-op. It does not direct how these revenues should be allocated nor how they should be reported, merely that they be captured and accounted for accurately. This is a reasonable request and, given that the company knows that it will have to account, at some point, for revenues associated with this portion of River Bend, this ordinance merely directs the company to do something it is already doing or should be doing. Bonczek, City Manager PREPARED BY: Lane Nichols, City Attorney MEETING DATE: October 12, 1999 AGENDA MEMO DATE: September 21, 1999 REQUESTED ACTION: Ordinance requiring Entergy/Gulf States to book and suspense revenues from the River Bend Nuclear Plant associated with the bankruptcy of Cajun Electric Co-Operative RECOMMENDATION Because Entergy/Gulf States (EGS) believes that it may sell 30% of the power from River Bend as it it were unregulated, the Steering Committee of cities that oversee electric maters for EGS recommends that cities pass an ordinance requiring EGS to book those revenues so they can be held in a suspense account pending a regulatory determination of their disposition. The PUC has agreed to address this question at a later date. The administration agrees with the Steering Committee and recommends that the ordinance attached to this request be adopted by the City Council. BACKGROUND On September 8, 1999, EGS filed its third fuel surcharge case since 1998. Those filings were as follows: 1. In December, 1998, the PUC approved a fuel surcharge of One-Hundred and Twelve- Million ($112,000,000) Dollars without any inquiry to the reasonableness of the amount under a law that allows such a surcharge every six months. The cost associated with the $112,000,000 covered the period July 1, 1996 through June 30, 1998. These costs are being collected on bills at this time. 2. They filed a reconciliation case this year which was designed to determine the reasonableness of the $112,000,000 surcharge obtained in the December, 1998 filing. However, EGS is asking for an additional Thirty-Million ($30,000,000) Dollars in this reconciliation case. That request covers the period July 1, 1996 to February 28, 1999. 3. The third case filed September 8th of this year seeks an additional Thirty-Four ($34,000,000) Dollars surcharge, once again without any determination of whether the amount is accurate or not. These "pancake" filings are troublesome because this third filing includes the period of electric curtailment which occurred on July 23, 1999. For example, on that day, Entergy was forced to pay up to Twenty-five Hundred ($2,500) Dollars per megawatt hour to purchase power (compared to a cost on their system to produce such power of Twenty-five to Thirty ($25 to $30) Dollars per megawatt hour). On that same day, EGS was selling Two- Hundred Eighty-one (281) megawatts of power from its River Bend Nuclear Plant off system. This is an approximate 30% share of that plant which Gulf States obtained when Cajun Electric Co-Operative was declared a bankrupt. EGS in a unilateral decision treated that power as completely unregulated and decided to keep revenues from the sales of such power for its shareholders even though they were required to curtail power throughout their system and purchase power at an exorbitant rate. Had that power been used in the EGS integrated system, obviously some outages could have been avoided and expensive purchases could have been curtailed. All of these additional costs are being requested for recovery in the pending fuel cases. Through the law firm of Butler, Porter, Gay and Day who represents the coalition of cities (the Steering Committee) in the Entergy service area, we are monitoring and participating in these fuel cases. BUDGETARY IMPACT Any success in these cases will lower electric costs for the city. An exact reduction cannot be determined at this time. PREVIOUS ACTION Council authorized intervention in the fuel cases in 1998. SUBSEQUENT ACTION None. Bonczek, City Manager Kyle Hayes, Executive Assistant to the City Manager Date: October 8, 1999 Subject: Texas State Veterans Home The City Manager and I have been working with the Beaumont Chamber of Commerce and Jefferson County on preliminary work necessary for Jefferson County to make a proposal for a Texas State Veterans Home in Beaumont. A Texas State Veterans Home is a home established for veterans disabled by age, disease, or otherwise, who by reason of such disability are incapable of earning a living. It also includes a home which furnishes care for such veterans. There are currently four Texas State Veterans Homes in Texas. The Texas Veterans Land Board is in the process of securing funding from the U.S. Department of Veterans Affairs (VA) for the construction of seven new Veterans Homes. We anticipate the Texas Veterans Land Board sending out requests for proposals in November of this year to interested governmental entities around the State. Approximately 45 entities are on the mailing list. A list of criteria for site selection is attached for your review. One specific requirement is that at least 20 acres must be donated or legally committed for long-term use. We would like for the Council to consider donating 20 acres which are currently a part of Fair Park (approximately 60 acres). The property has adequate water and sewer, access to public transportation, and is within five minutes from St. Elizabeth and Baptist Hospitals. In our opinion, a Veterans Home located in Beaumont at Fair Park would meet the site selection criteria. The construction of the 160 bed facility is projected at $10 million resulting in 50 permanent jobs with an estimated payroll of$5 million. Beaumont and Southeast Texas have a large veteran population and this type of facility and investment would be a tremendous asset. The property would be committed to the Texas Veterans Land Board at such a time not to interfere with the YMBL and the South Texas State Fair. The YMBL and the South Texas State Fair are planning to move to the Southeast Texas Entertainment Complex . The YMBL is currently negotiating with the County but as of this date has not reached an agreement. Additional information which was used for the first round of site selections a few years ago is attached for your review. The term "Texas State Veterans Home" means a home established for veterans disabled by age, disease, or otherwise, who by reason of such disability are incapable of earning a living. It also includes a home which furnishes care for such veterans. • Who establishes a Texas State Veterans Home? In 1997, the Texas legislature authorized the Texas Veterans Land Board to extend its operation and bond authority to include "...the construction, acquisition, ownership, operation, maintenance, enlargement, improvement, or furnishing or equipping of veterans homes...." • How does the U.S. Department of Veterans Affairs (VA) participate with a state in the construction of a State Veterans Home? Under Title 38 USC 8131-8137,the VA provides a grant of up to 65% of the cost of acquisition and construction of rew domiciliary or nursing home buildings, and/or the expansion,remodeling, or alteration of existing domiciliary,nursing or hospital care buildings, provided VA standards and regulations are met. Acquisition and renovation costs may not exceed the cost of construction of any equivalent new facility. Such cost may include architect fees, supervision, inspection, cost of final audit, and initial equipment,which is not included in the construction contract and may not exceed 14 percent of the cost of construction. The VA cannot participate in the cost of land and infrastructure. • How are construction grants awarded? The VA establishes a priority list of applications as of August 15 each year for funding the next fiscal year beginning October 1. After the appropriation for the construction grant program,projects will be funded in the order of priority on the list until federal funds are spent. First priority is accorded to feasible applications for which states have provided sufficient funds so that the project may proceed upon award of the grant. • Is there a limit on the number of beds that can be constructed with VA participation? Yes. Nursing home care beds cannot exceed 4 State Home beds per 1,000 veteran population in the state. Justification must be provided for nursing home beds in excess of 2.5 per 1,000 veteran population of a state. Domiciliary beds cannot exceed 2 beds per 1,000 veteran population in the state. • Can a building in an existing state facility be approved as a-Texas State Veterans Home? • A building or buildings in an existing facility may qualify,provided that they are established and operated as a separate entity. It is permissible to purchase services, i.e., dietetic, engineering, laundry, and professional care from an existing facility. • How will the VA assure Congress that Texas State Veterans Homes provide quality care? An annual inspection, audit, and reconciliation of records is conducted by the VA medical center of jurisdiction to assure that the minimum standards of care as prescribed by the VA are met. • Does a Texas State Veterans Home require a state license? Yes. The facility must be licensed as a nursing home by the state and fully meet the same standards established for licensing all nursing homes in the state. The facility must be in compliance with applicable federal, state, and local laws and regulations and is subject to announced and unannounced inspections by the Texas Department of Human Services and the TVLB. Under provisions of Title 38 USC 1741, the VA participates by making per diem payments of$43.92 to the Texas State Veterans Home for each Veteran residing in the home. • Can a Texas State Veterans Home assess or charge veterans for the cost of their care? Yes. The facility may establish a maintenance charge system and collect from the pension, compensation, or other income of veterans. • Is there a limit on the amount collected from veterans? No. However, income collected from veterans is subtracted from the total allowable costs during fiscal verifications. VA aid payments may not exceed this difference nor may VA aid payments exceed one-half the • aggregate cost of maintaining veterans in a home. FROM :BMT CHAMBER OF COMMERCE 409 633 6718 1999,10-07 11:51 #734 P.05/07 I TEXAS STATE VETERANS HOMES SITE SELECTION PROCESS • Step 1: Request for Proposals A Request for Proposals (RFP) is mailed to County Judges, Mayors, Chambers of Commerce, Councils of Government, and other appropriate entities within targeted regions of the state. A deadline of approximately six weeks is given for receipt of all proposals. • Step Z: RFP Review All proposals are reviewed by a team that includes the Executive Secretary of the Texas Veterans Land Board(TVLB), other TVLB staff members, and two General Land Office real estate appraisers. Each proposal is evaluated according to the proposer's ability to best demonstrate the site characteristics set by the TVLB, required by the U.S. Department of Veterans Affairs, and recommended by the States Association of Veterans Homes. A list of the site characteristics is attached • Step 3: Site Inspection All proposed sites are visited by a team that includes the Executive Secretary of the TVLB or his representative, TVLB staff members, and a staff appraiser. Each site is given the chance to demonstrate how it meets the requirements of the RFP. Step 4: Scoring The site visit teams and the TVLB Special Projects Director score each site based on the site selection criteria.
