BACKGROUND The City Charter states"there shall be one or more magistrates of said Municipal Court known as City Magistrates, one of whom shall be designated Chief Magistrate." City Magistrates receive compensation of$250 per session. PREVIOUS ACTION None. SUBSEQUENT ACTION None. RECOMMENDED BY City Council. RESOLUTION NO. BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF BEAUMONT: THAT Craig Lively be reappointed a Magistrate of the City of Beaumont for a two- year term. Compensation shall be $250 per session. Richardson, Planning Manager MEETING DATE: February 1, 2005 AGENDA MEMO DATE: January 25, 2005 REQUESTED ACTION: Council consider a request for a specific use permit to allow a beauty/barber shop,property management office and meeting facility in an RCR (Residential Conservation and Revitalization) District at 2406 North Street. RECOMMENDATION The Administration recommends approval of a specific use permit to allow a beauty/barber shop and property management office only in an RCR(Residential Conservation and Revitalization)District at 2406 North Street subject to the following conditions: Limit the uses to a three chair beauty/barber shop and a property management office. Install a 8' tall wood screening fence along the north property line. Pave the remainder of the parking lot in the rear with asphalt, directing drainage onto North Street. Modification to the landscaping requirements along the north property line(no 10'landscape strip required) and to the landscaping/screening requirements along the east and west property lines (no 8'tall wood screening fence or 10'wide landscape strip required). BACKGROUND Keith Broussard, the applicant and property owner, is requesting a specific use permit to allow a beauty/barber shop, property management office and meeting facilities at 2406 North. In August, 2004,Aereon Productions received a specific use permit to allow the use of the subject property as a film and production facility. That use appears to have fallen through. Mr. Broussard has stated that the beauty/barber shop would house 2 or 3 chairs. The property management office would employ 1 person and the office would be open from 8 a.m. to 5 p.m. He also states that he would lease the metal building for small meetings. The Zoning Ordinance requires that for a beauty/barber shop there be one parking space for each chair and one space for each employee. Office uses require one parking space for each 300 sq. ft. of gross floor area. A meeting facility with a maximum meeting capacity of 130 persons would require a minimum of 33 parking spaces. At maximum capacity, a total of forty parking spaces would be required. The site plan shows only ten parking spaces. When the property was used as the Postal Union facility, staff received numerous complaints concerning the number ofcars parking on-street. The parking,as shown,could only accommodate a three chair beauty/barber shop and the property management office. BUDGETARYIMPACT None. PREVIOUS ACTION At a Joint Public Hearing held January 24, 2005, the Planning Commission voted 7:0 to approve a specific use permit to allow a beauty/barber shop and property management office in an RCR District at 2406 North Street subject to the following conditions: Limit the uses to a three chair beauty/barber shop and a property management office. Install a 8' tall wood screening fence along the north property line. Pave the remainder of the parking lot in the rear with asphalt,directing drainage onto North Street. Modification to the landscaping requirements along the north property line(no 10'landscape strip required) and to the landscaping/screening requirements along the east and west property lines (no 8' tall wood screening fence or 10'wide landscape strip required). SUBSEQUENT ACTION None. RECOMMENDED BY Planning Commission, City Manager, Public Works Director and the Planning Manager. ORDINANCE NO. ENTITLED AN ORDINANCE GRANTING A SPECIFIC USE PERMIT TO ALLOW A BEAUTY/BARBER SHOP AND PROPERTY MANAGEMENT OFFICE IN AN RCR (RESIDENTIAL CONSERVATION AND REVITALIZATION) DISTRICT LOCATED AT 2406 NORTH STREET IN THE CITY OF BEAUMONT, JEFFERSON COUNTY, TEXAS. WHEREAS, the City Council for the City of Beaumont desires to issue a specific use permit to Keith Broussard to allow a beauty/barber shop and property management office in an RCR (Residential Conservation and Revitalization) District located at 2406 North Street, being Lot 24 and the W. Y of Lot 25, Block 30, Averill Addition, City of Beaumont, Jefferson County, Texas, containing 0.5 acres, more or less, as shown on Exhibit "A" attached hereto; and, WHEREAS, the City Council is of the opinion that the issuance of such specific use permit is in the best interest of the City of Beaumont and its citizens, subject to the hereinafter described conditions; NOW, THEREFORE, BE IT ORDAINED BY THE CITY OF BEAUMONT: Section 1. That a specific use permit to allow a beauty/barber shop and property management office in an RCR (Residential Conservation and Revitalization) District located at 2406 North Street, being Lot 24 and the W. Y of Lot 25, Block 30, Averill Addition, City of Beaumont, Jefferson County, Texas, containing 0.5 acres, more or less, as shown on Exhibit"A"attached hereto, is hereby granted to Keith Broussard, his legal representatives, successors and assigns, subject to the following conditions: Limit the uses to a three chair beauty/barber shop and a property management office. Install an 8' tall wood screening fence along the north property line. Pave the remainder of the parking lot in the rear with asphalt, directing drainage onto North Street. 0 Modification to the landscaping requirements along the north property line (no 10' landscape strip required) and to the landscaping/screening requirements along the east and west property lines (no 8' tall wood screening fence or 10' wide landscape strip required). Section 2. That the specific use permit herein granted is expressly issued for and in accordance with each particular and detail of the site plan attached hereto as Exhibit "B" and made a part hereof for all purposes. Section 3. Notwithstanding the site plan attached hereto, the use of the property herein above described shall be in all other respects subject to all of the applicable regulations contained in Chapter 30 of the Code of Ordinances of Beaumont, Texas, as amended.
