WHEREAS, Ohmsted Ltd. has requested the City of Beaumont to allow them to
encroach on the City's right-of-way on North Pearl, Hazel and North Streets, as shown
below and depicted on Exhibit "A" attached hereto and made a part hereof for all
purposes, to install three (3) groundwater monitoring wells:
PMW-22 encroaching onto the City's right-of-way, two
hundred (200) feet west of the intersection of Hazel Avenue
and North Main Street and five (5) feet south of the edge of
pavement of Hazel Avenue.
PMW-23 encroaching onto the City's right-of-way, sixty (60)
feet east of the intersection of North Pearl Street and North
Street and five (5)feet north of the edge of pavement of North
Street.
PMW-17 encroaching onto the City's right-of-way,two hundred
twenty five (225) feet south of the intersection of Harrison
Avenue and North Pearl Street and ten (10) feet west of the
back of curb of North Pearl Street.
and,
WHEREAS City staff has expended considerable time and effort in investigating
the effect of such encroachment upon the City and utilities serving the same; and,
WHEREAS, it appears that it would be equitable to allow such encroachment at
this time;
NOW, THEREFORE, BE IT RESOLVED BY THE
CITY COUNCIL OF THE CITY OF BEAUMONT:
THAT the City Manager is hereby authorized to execute a License to Encroach to Ohmsted
Ltd. on the City's right-of-way on North Pearl, Hazel and North Streets, as shown above
and depicted on Exhibit "A", for a one-time fee of Five Hundred Dollars ($500).
PASSED BY THE CITY COUNCIL of the City of Beaumont this the 25th day of
January, 2005.
