WHEREAS, on May 13, 2003, the City Council of the City of Beaumont, Texas
awarded a contract to Brystar Contracting, Inc., in the amount of $1,824,683.85 for the
Twenty-Third Street Pavement Improvement Project; and,
WHEREAS, Change Order No. 1 in the amount of($73,474.28) is required due to
the decrease in construction item quantities used during performance of the project thereby
decreasing the contract amount to $1,751,209.57;
NOW, THEREFORE, BE IT RESOLVED BY THE
CITY COUNCIL OF THE CITY OF BEAUMONT:
THAT the City Manager be, and he is hereby authorized, to execute Change Order No.
1 to the Twenty-Third Street Pavement Improvement Project in the amount of($73,474.28)
due to the decrease in construction item quantities used during performance of the ro e

thereby decreasing the contract to $1,751,209.57. The project, as stated above, be and
the same is herein accepted and the City Manager be and he is hereby authorized to make
final payment in the amount of$87,560.54 to be paid to Brystar Contracting, Inc.
