M?;. NIHITAKER, Chief Planner for the Planning Department: The City participates in the Federal Emergency Management Admi ni. =_.trati on" s, Flood Insurance Program. This means that residents of Be:aumont are eligible for federally-subsidized flood insurance whether they live in a flood hazard area or not. One of the conditions that the Federal Government places on the City in order for people here to participate in ' the Flood Insurance Program is that the City adopt a building permit system that prevents construction in flood-prone areas.. We' ve been using a Federal Flood Map for the last few w •'r.ars that was prepared in 1975. In 1982, we were presented with a preliminary version of a new revised Flood h'l;:a.p. We felt there were some errors in this map resulting from parts of the City that weren' t studied and we went through a process of appealing the map that lasted a couple of years and we' ve had some substantial changes made - some of the flood plains have been shrunken. We" ve cot a new map that the Federal Government has said we need to adopt by December the 4th. As of December the 4th, this map goes into effect for Flood Insurance purposes. The City has been told that we .also must adopt the maps and adopt a new flood ordinance that references the new maps and takes into account some of the changes on the maps. Th-;r=; current series of maps we have sets one base flood elevation which is ?.:.t';re minimum elevation at which a. structure can be built for the entire City and that' s set at 15 feet. Under the new system of maps, we !.>:i l l have different flood elevations for each drainage way, for each major- watcrshed and major drainage ditch. We will also have. the i ood w;1 in divided into two (2) parts. The term " 100-year Fl ood Plain" that is used on the maps refers to an area where there is a one percent chance of a flood i n any given '.gar-. The most critical part of that 100-year Flood Plain is called "Fl oodwa•.: " . We haven' t had a f 1 oodway before on our old maps. Under the nee.•:, ordinance, we would not be able to issue a building permit for permanent structure that would obstruct flood water from using the l �,r;,_ wa^;- t•o drain out of the City. - The second part of the Flood Plain is called the "Fl oodway Fringe" . This area will have some restrictions on development but there can be new constructions. Essentially, any structure built in the f I oodway. fringe would have to be one foot above the base flood elevation. This could be done by elevating on pilings or with dirt, with fill . With commercial structures, there is one exception to this flood elevation reaui rement. A commercial structure in the 100-year Flood Plain could be built in a flood-proof manner where it was impervious to flood waters. Also, within the f 1 oodway fringe, any construction that occurs cannot increase the base flood elevation in the watershed substantially and "substantially" is defined by the Federal Government is a one-foot increase in the base flood elevation. :h^-,.ps were shown and discussed. ) There being no citizens to address City Council , the hearing was closed. oc yo_ Resolution 84-429 authorizing purchase of two (^) tractors from International oral. After" a discussion, Councilman Moore made a motion to approve the r-esclution with an amendment to defer action for the tractor with r ctary mower; motion was seconded by Councilman Deshotel . Ouesti _ern: Ayes: All Nayes: None -'-i.88" November 20, 1984 - Ordinance No. 84-149 authorizing abandonment of a 2-foot portion of Libertv Street right-of-way (from Janes to Willow) located adjacent to Lots 1-3, Block 20, Calder Addition was considered: ` ORDINANCE NO. 84-149 ENTITLED AN ORDINANCE VACATING AND ABANDONING A 2-FOOT PORTION OF LIBERTY STREET RIGHT-OF-WAY. The ordinance was approved on a motion made by Councilman Weisbach and seconded by Councilman Moore. Question: Ayes: Councilman Abstained: Mayor Deshotel Neild Councilman Turner Councilman Weisbach Councilman Brumley Councilman Samuel Councilman Moore -o0o- Ordinance No. 84-150 authorizin g a zone change from RM-H to GC-MD and Ordinance No. 84-151 authorizing the issuance of a Specific Use Permit to establish a drinking place at 4290 Pradice (requested by Ananais Prejean ) were considered: ORDINANCE NO. 84-150 ENTITLED AN ORDINANCE AMENDING CHAPTER 30 OF THE CODE OF ORDINANCES OF BEAUMONT, TEXAS, AND IN PARTICULAR THE BOUNDARIES OF THE ZONING DISTRICTS AS INDICATED UPON THE ` ZONING MAP OF BEAVMONT, TEXAS, BY CHANGING ` THE ZONING FROM RM-H (RESIDENTIAL MULTIPLE FAMILY - HIGH DENSITY DISTRICT) TO GC-MD (GENERAL COMMERCIAL - MULTIPLE DWELLING DISTRICT) ON PROPERTY LOCATED AT 4290 PRADICE; PROVIDING FOR SEVERABILITY; PROVIDING FOR REPEAL AND PROVIDING A PENALTY. ORDINANCE NO. 84-151 ENTITLED AN ORDINANCE ISSUING A SPECIFIC USE PERMIT FOR DRINKING PLACE ON PROPERTY LOCATED AT 4290 PRADICE. `Councilman Deshotel made a motion to approve Ordinance No. 84-150 changing the zoning from RM-H to GC-MD for the property located at 4290Pradice. The motion was seconded by Councilman Samuel* ' Quest�on: Ayes: Councilman Nayesm Mayor Neild Deshotel Councilman Councilman Turner Weisbach Councilman Councilman Brumley Samuel Councilman Moore Councilman Moore made a motion to approve Ordinance No. 84-151 with an amendment to the Site Plan of the ordinance specifying operating hours for the business to be 10: 00 a. m. to 4: 00 p. m. for School Days. The motion was seconded by Councilsman Deshotel . Question: Ayes Councilman Nayes: Mayor Neild Deshotel Councilman Councilman Turner Weisbach Councilman Councilman Brumley Samuel Councilman Moore -189- November 20, 1984 � ` Resolution 84-430 awarding Sprott Park trail system and site work contract to Baytown Construction at $83, 850. 00 (0. 6 miles of trail surface, 16-station exercise system, benches, signs, drinking fountain and extensive site grading and landscaping, $37, 500 to be funded through a grant from the Texas Local Parks, Recreation and Open Space Fund and the balance of $46, 350 to be funded through the Community Development Block Grant fund) was approved on a motion made by Councilman Moore and seconded by Councilman Turner. ` Question: Ayes: All Nayes: None -coo-- An ordinance changing a street name - College Street - in honor of Dr. Martin Luther King, Jr. was considered: ' ` ' AN ORDINANCE ENTITLED AN ORDINANCE AMENDING CHAPTER 3 OF THE CODE OF ORDINANCES OF THE CITY OF BEAUMONT, TEXAS AND IN PARTICULAR THE NAME OF THAT CERTAIN STREET AS INDICATED UPON THE OFFICIAL STREET MAP OF BEAUMONT, TEXAS BY CHANGING THE NAME OF COLLEGE STREET TO "M. L. KING DRIVE" . Councilman Samuel made a motion to approve the ordinance; motion was seconded by Councilman Deshotel . ^ A discussion was held and the question called. Question: Ayes: All Nayes: None -o0o- ' Mayor Neild called an Executive Session, pursuant to Section II of the Texas Opening Meetings Act, to be held immediately following the City Council Workshop Session. -o0o- ' Mrs. Carol Flatten, 6360 Arrowhead Street, representing the Spare Beaumont Committee of the Beaumont Heritage Society, addressed Council ' to urge that the rehabilitation of the Tyrrell Historical Library be given a top City priority. Mr . Paul Brown, 4370 Cartwright; the Reverend Albert Haynes, 2620 Burgandy Place; Mr. Ed Sigee, 2695 Forrest; the Reverend Edward Brown, 2950 Waco Street; and the Reverend Timothy M. Hunley, 1698 LaSalle; addressed Council in opposition to action taken today that defeated the street name change from College Street to Dr. Martin Luther King, Jr. Drive. Mr. Alan McNeill , 479 Pine Street, addressed Council to urge further support for the location of the proposed Naval installation in our area.
