Question: Ayes : All Nayes: None -000- Ordinance No. 84-115 changing the zoning from R-3 (Modified Two Family and Multiple Dwelling) to RM-H (Residential Multiple Family - High Density) at 3875 Major Drive was considered: ORDINANCE NO. 84-115 ENTITLED AN ORDINANCE AMENDING CHAPTER 30 OF THE CODE OF ORDINANCES OF BEAUMONT, TEXAS, AND IN PARTICULAR THE BOUNDARIES OF THE ZONING DISTRICTS AS INDICATED UPON THE ZONING MAP OF BEAUMONT, TEXAS, BY CHANGING THE ZONING FROM R-3 (MODIFIED TWO FAMILY AND MULTIPLE DWELLING DISTRICT) TO RM-H (RESIDENTIAL MULTIPLE FAMILY- HIGH DENSITY DISTRICT) ON PROPERTY LOCATED AT 3875 MAJOR DRIVE; PROVIDING FOR SEVERABILITY; PROVIDING FOR REPEAL AND PROVIDING A PENALTY. Question: Ayes: All Nayes : None -000- An ordinance changing the zoning from RS (Residential Single Family) to NC (Neighborhood Commercial) at 5040 Bigner (request made by Shirley Pryor to open a thrift shop) was deferred at the request of the applicant on a motion made by Councilman Moore and seconded on a motion made by Councilman Deshotel . Question : Ayes : All Nayes : None -000- Ordinance No. 84-117 granting HC (.Historical-Cultural) district overlay zoning at 800 Pearl Street (requested by R. M. Warchol for the former King Edward Hotel) was considered: -150-- September 25, 1984 ORDINANCE NO. 84-117 ENTITLED AN ORDINANCE AMENDING CHAPTER 30 OF THE CODE OF ORDINANCES OF BEAUMONT, TEXAS, AND IN PARTICULAR THE BOUNDARIES OF THE ZONING DISTRICTS AS INDICATED UPON THE ZONING MAP OF BEAUMONT, TEXAS, BY ESTABLISHING AN H-C (HISTOR- ICAL-CULTURAL) OVERLAY ZONE FOR PROPERTY LOCATED AT 800 PEARL STREET, BEAUMONT, JEFFERSON COUNTY, TEXAS ; PROVIDING FOR SEVERABILITY; PROVIDING FOR REPEAL AND PROVIDING A PENALTY. The ordinance was approved on a motion made by Councilman Brumley and seconded by Councilman Moore. These ordinances were approved on a motion made by Councilman Brumley and seconded by Councilman Deshotel . Question : Ayes : All Nayes: None -000- An ordinance granting a Specific Use Permit to establish a lounge in a GC-MD (General Commercial-Multiple Dwelling) district at 2900 Blanchette. (requested by Anthony Holmes, prospective leasee) was withdrawn at the request of the applicant . -000, Ordinance No . 34-120 ;ranting a Specific Use Permit to build a garage apartment in an RS (Residential Single Family) district at 490 Norvell (requested by Felipe Iglesias) was considered: ORDINANCE NO. 84-120 ENTITLED AN ORDINANCE ISSUING A SPECIFIC USE PERMIT FOR A GARAGE APARTxIENT ON PROPERTY' LOCATED AT 490 NORVELL. -151- September 25 , 1.984 The ordinance was approved on a motion made by Councilman Deshotel and seconded by Councilman Samuel . Nayes : None -000- An ordinance granting a Specific Use Permit to establish a lounge in a GC-MD (General Commercial-Multiple Dwelling) district at 2930 S. 11th Street (requested by Ralph Massey, prospective leasee) was considered: AN ORDINANCE ENTITLED AN ORDINANCE ISSUING A SPECIFIC USE PERMIT FOR A LOUNGE ON PROPERTY LOCATED AT 2930 S . 11TH. Councilman Weisbach made a motion to deny the ordinance because all eight (8) conditions necessary for the issuance of a Specific Use Permit had not been met by the applicant . Motion was seconded by Councilman Deshotel . Question : Ayes : All Nayes : None -000 Ordinance No . 84-121 granting a Specific Use Permit for professional offices in an RM-H (-Residential Multiple Family-High Density) district in the 7700 Block of Gladys (requested by Mark Whiteley, engineer, for owner, Tom 0. Bailey) was considered: ORDINANCE NO. 84-121 ENTITLED AN ORDINANCE ISSUING A SPECIFIC USE PERMIT FOR PROFESSIONAL OFFICES ON PROPERTY LOCATED IN THE 7700 BLOCK OF GLADYS. The ordinance was approved on a motion made by Councilman Brumley and seconded by Councilman Moore. Question: Ayes : All Nayes : None -000- Ordinance No. 84-1.22 abandoning a 10-foot utility easement in Block 5, Lots 1 and 2 , Westfield Terrace Addition (:requested by John W. Mathews to build a carport ) was considered: ORDINANCE NO. 84-122 ENTITLED AN ORDINANCE ABANDONING A 10-FOOT UTILITY EASEMENT IN BLOCK 5, LOTS 1 AND 2, WESTFIELD TERRACE ADDITION, BEAUMONT, JEFFER- SON COUNTY, TEXAS. The ordinance was approved on a motion made by Councilman Deshotel and seconded by Councilman Turner. Question: Ayes : All Nayes: None -000- Ordinance No. 84-123 amending Section 30-4.B.24 , Home Occupation, of the City Code was considered: ORDINANCE NO. 84-123 ENTITLED AN ORDINANCE AMENDING CHAPTER 30, SECTION 30-4(B) , HOME OCCUPATION (E) , OF THE CODE OF ORDINANCES OF THE ,CITY OF BEAUMONT TO PERMIT A HOME OCCUPATION TO USE VARIOUS TYPES OF PUBLISHED MATTER TO ADVERTISE A BUSINESS; PROVIDING FOR SEVERABILITY; PROVIDING FOR REPEAL AND PROVIDING A PENALTY. -152- September 25, 1984 Section 30-4(b) , Home Occupation (e) reads : There is no on-premise advertising or any other display or storage of materials or exterior identification of the home occupation or variation . from the residential character of the main building or any accessory buildings. Ordinance No . 84-123 was approved on a motion made by Councilman Turner and seconded by Councilman Brumley. Question : Ayes : All Nayes: None -000- Ordinance No. 84-124 amending the fiscal year 1983-1984 budget was con- sidered: ORDINANCE NO. 84-124 ENTITLED AN, ORDINANCE AMENDING THE BUDGET OF THE CITY OF BEAUMONT FOR THE FISCAL YEAR COMMENCING OCTOBER 1 , 1983; REPEALING ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH; PROVIDING FOR SEVERABILITY AND PROVIDING FOR REPEAL. The ordinance was approved on a motion made by Councilman Deshotel and seconded by Councilman Turner. Question : Ayes : All Nayes: None -000- Ordinance No. 84-125 adopting the tax roll in the amount of $2, 587, 515,009. for the City of Beaumont and establishing the tax rate in the amount of $0. 78 per each $100. 00 of value for the tax year 1984 was considered: ORDINANCE NO. 84-125 ENTITLED AN ORDINANCE APPROVING THE TAX ROLL FOR THE CITY OF BEAUMONT FOR THE YEAR 1983; ESTABLISH- ING A TAX RATE; PROVIDING FOR THE LEVYING, ASSESS- ING AND COLLECTING OF AD VALOREM TAXES FOR THE TAX YEAR 1984 TO PROVIDE A GENERAL FUND AND A SINKING FUND TO MEET THE PAYMENT OF ALL BONDED INDEBTEDNESS OF THE CITY OF BEAUMONT AND THE PAYMENT OF INTEREST THEREON; PROVIDING FOR SEVERABILITY AND PROVIDING FOR REPEAL. None -000- Ordinance No. 84-127 establishing water and sewer rates: ORDINANCE NO. 84-127 ENTITLED AN ORDINANCE AMENDING CHAPTER 28, ARTICLE III OF THE CODE OF ORDINANCES OF THE CITY OF BEAUMONT TO AMEND WATER AND SEWER RATES; PROVIDING FOR SEVERABILITY; PROVIDING FOR REPEAL AND PROVIDING A PENALTY. The ordinance was approved on a motion made by Councilman Samuel and seconded by Councilman Turner. Question : Ayes: All Nayes: None -000- Ordinance No.. 84-128 regulating burglar alarms was considered: ORDINANCE NO. 84-128 ENTITLED AN ORDINANCE AMENDING CHAPTER 2-J OF THE CODE OF ORDINANCES OF THE CITY OF BEAUMONT TO PROVIDE FOR THE PAYMENT OF FEES BY ALARM USERS FOR EXCESS ALARMS; PROVIDING FOR SEVERABILITY; PROVIDING FOR REPEAL AND PROVIDING A PENALTY. The ordinance was approved on a motion made by Councilman Deshotel and seconded by Councilman Moore. Question : Ayes : All Nayes : None -000. Resolution 84-341 authorizing execution of a contract with Russ Miller Construction Company in the amount of $204, 798.41 for construction of Shelby Drive from 135 feet south of Doty, a distance -of 330 feet to a point 140 feet north of Gross and storm drainage along Riggs Street from Calhoun to Drainage District 6' s drainage ditch was approved on a motion made by Councilman Brumley and seconded by Councilman Samuel . Question : Ayes: All Nayes : None -000 Resolution .84-342 authorizing Change Order No. l to the contract with John Bankston Construction and Equipment Rental for the Longfellow Interceptor Sanitary Sever Project in the amount of a net reduction of $64, 760. 00 was approved on a motion made by Councilman Weisbach and secon- ded by Councilman Deshotel . Question: Ayes : All Nayes: None --000 • Resolution 84-343 authorizing purchase of 110 gas masks from, Schneiders Police Supply in the amount of $7,466. 80; 110 filter sets in the amount of $896. 50 and 110 carrying cases in the amount of $897.90 from National Police Supply and 110 Helmets from Premier Crown Corporation in the amount of $4, 040. 30 was approved on a motion made by Councilman Moore and seconded. by Councilman Turner. Question: Ayes : All Nayes : None -000 Resolution 84-344 authorizing purchase of valve box risers, MJ valves and fittings for the Water Utilities Department from Municipal Pipe and Fabri- cating Company in the amount of $20,867. 24 was approved on a motion made by Councilman Deshotel and seconded by Councilman Brumley. Question : Ayes : All Nayes : None -154- September 25, 1984 Resolution 84-345 authorizing purchase of freeway lighting material from Westinghouse Electric, All Phase Electric, Graybar Electric and M & I Industries was approved on a motion made by Councilman Turner and seconded by Councilman Deshotel . Question : Ayes : All Nayes : None -000- Resolution 84-346 authorizing purchase of a track-type bulldozer from Mustang Tractor Company at $85, 527.00 was approved on a motion made by Councilman Samuel and seconded by Councilman Deshotel . Question: Ayes : All Nayes None -000- Resoluiton 84-347 authorizing rental of a bulldozer from Speedway Service Company at $50. 00 per hour with operator was approved on a motion made by Councilman Weisbach and seconded by Councilman Turner. Question: Ayes : All Nayes : None -000- Resolution 84-348 authorizing purchase of a personal computer from Calistar Computers at $4, 397. 00 for use by the City Clerk's Office was approved on a motion made by Councilman Brumley and seconded by Councilman Deshotel . Question : Ayes: Mayor Neild Abstained: Councilman Councilman Deshotel Moore Councilman Turner Councilman Weisbach Councilman Brumley Councilman Samuel -000- Councilman Weisbach stated: "I would like to go on record as being opposed to the initiation of the fees for the treatment of the venereal disease and ask that this area be monitored closely. " Councilman Moore reported concern of a resident at 3295 Westmoreland about high weeds growing in what may be an abandoned canal and the many snakes coming from the area. He asked that responsibility for the area be deter- mined and that the weeds be cut . ..
