The Pledge of Allegiance was led by Councilman Turner. -000- A moment of silence was held in memory of Rabbi Herbert Rutman, Temple Emanuel , who died Friday, August 31 , 1984. -000- Two proclamations were issued: "Grandparents Day in Beaumont" - Septem- ber 9, 1984 and "Square Dance Month in Beaumont" - September, 1984. -000- The following Consent Agenda items were copsidered: Approval of the Minutes, as corrected, of the regular City Council ses- sion held August 28, 1984 ; Resolution 84-313 appointing Bruce Irvine, term expiring May 31 , 1986 and reappointing Olivia Gonzales, Shirlene Cook and Herman Rogers, terms expiring May 31 , 1986 , to the CDBG Citizens Advisory Committee; Resolution 84-314 authorizing execution of a five-year lease agreement with the Beaumont Municipal Employees ' Credit Union at $1 . 00 per year to begin October 1 , 1984 through September 30, 1989; Resolution 84-315 authorizing the City Manager to execute a Memorandum of Understnading on Information Network Services with the Houston Area Library System for circulation and other automated network services and the Urban Library Aid contract with the Texas State Library for funds from the federal Library Services and Construction Act ; Resolution 84-316 accepting water improvements in Lots 1-7, Block 1 ; Lots 1-7 , Block 2; Lots 1-5 and 30-43 , Block 3 ; Lots 1-7, Block 4 and Lots 1-3 and 11 , Block 5 and street improvements of Sierra Circle from Tahoe Drive approximately 1 , 107 feet easterly to and including the cul- de-sac, then approximately 70 feet north; Tahoe Drive from R. F.D. Road approximately 615 feet northwest ; Raton Circle from Sierra Circle approx- imately 250 feet northwest to and including the cul-de-sac; and Durango Drive from Sierra Circle approximately 340 feet northwest and 152 feet southeast in Meadowlands Subdivision; -138- September 4 , 1984 Ordinance No . 84-111 amending Section 26-24 of the Code of Ordinances , relating to time changes for School zones was considered: ORDINANCE NO. 84-111 ENTITLED AN ORDINANCE AMENDING CHAPTER 26, SECTION 26-24 OF THE CODE OF ORDINANCES OF THE CITY OF BEAUMONT TO CHANGE TIMES FOR SCHOOL ZONES ; PROVIDING FOR SEVERABILITY; PROVIDING FOR REPEAL AND PROVIDING A PENALTY. and Resolution 84-317 authorizing execution of a release of a 10-year repur- chase agreement for the north half of the vacated 12-foot alley south of Lots 4 & 5 in Block 24 of the Jarrette Addition (authorized by Resolution 84-188, May 29, 1984 to Gilson Viator) . The Consent Agenda was approved on a motion made by Councilman Deshotel and seconded by Councilman Turner. Question : Ayes : All Nayes: None -000- The second reading of an ordinance amending the franchise with Liberty Tele-Communications , Inc . was held : AN ORDINANCE AN ORDINANCE AMENDING THE FRANCHISE GRANTED TO BEAUMONT CABLEVISION, INC. , PREDECESSOR OF LIBERTY T.V. CABLE, INC. , ON NOVEMBER 25, 1975, BY INCREASING THE PAYMENTS TO BE MADE THEREUNDER AND BY EXTENDING THE TERM THEREOF. The ordinance was passed to its third and final reading on a motion made by Councilman Weisbach and seconded by Councilman Turner . Question : Ayes : All Nayes : None -000- Resolution 84-318 authorizing award of an agreement with Beaumont Willow Creek Development Company for participation in the cost of the paving of Willow Bend Drive from Brooks Road north, approximately 1 ,650 feet at a cost to the City of $55 , 572 . 76 including engineering fees and authorizing execution of a contract with Kohler and Kohler, Consulting Engineers , for necessary engineering services (total estimated cost of the project is $158, 925. 69) was approved on a motion made by Councilman Moore and secon- ded by Councilman Deshotel . Question : Ayes : All Nayes : None -000- Resolution 84-319 authorizing award of an agreement with. Delaware Develop- ment Company for participation in the cost of paving Crow Road from 1 , 320 feet south of Folsom, a distance of 1 , 350 feet at a cost to the City of $45, 640 . 64 , including engineering fees and authorizing execution of a contract with Kohler & Kohler, Consulting Engineers , for necessary engineer- ing services (total estimated cost of the project is $130, 591 . 50) was ap- proved on a motion made by Councilman Brumley and seconded by Councilman Turner. Question : Ayes : All Nayes : None -000- Resolution 84-320 accepting the Cartwright-Corley Drainage Relief Project as complete (Baytown Construction Company completed the project at a total of $1 , 141 , 763 . 38 - $14 ,439. 00 over the contract amount ; City ' s share of the project cost is $764 , 974 . 38) and authorizing final payment to Drainage District 6 in the amount of $37, 878 . 22 was approved on a motion made by Councilman Moore and seconded by Councilman Weisbach. Question : Ayes : All Nayes : None -139- September 4 , 1984 Resolution 84-321 authorizing annual contracts for the purchase of rein- forced concrete pipe with National Concrete Products for 15" RCP at $5. 09, 18" RCP at $5. 83, 21" RCP at $7. 13 , 24" RCP at $8.66, 30" RCP at $12 . 29, 36" RCP at $17. 68, 42" RCP at $25. 36 and 48" RCP at $31 . 24 and with Pyramid Concrete Pipe for 12" RCP at $4 .48 and 7 x 7 x 2 box culvert at $822. 50 was approved on a motion made by Councilman Deshotel and se- conded by Councilman Samuel . Question : Ayes : All Nayes : None -000 Ordinance No. 84-112 authorizing execution of a lease for space in the Kyle Building was considered: ORDINANCE NO. 84-112 ENTITLED AN ORDINANCE AUTHORIZING THE EXECUTION OF A LEASE WITH KYLE TOWER, LTD. FOR OFFICE AND PARKING SPACE; PROVIDING THE LEVYING AND COLLECT- ING OF A SUFFICIENT TAX TO PAY THE INTEREST THEREON AND PROVIDING A SINKING FUND; PROVIDING FOR SEVERA- BILITY AND PROVIDING FOR REPEAL. The ordinance was approved on a motion made by Councilman Turner and seconded by Councilman Deshotel . Question : Ayes : All Nayes : None -000- Resolution 84-322 authorizing restoration of the stained glass windows at the Tyrrell Historical Library by Saucier & Sons Enterprises, Inc . , in the amount of $71 ,400. 00 was approved on a motion made by Councilman Brumley and seconded by Councilman Weisbach. Mr. Milton Palmer , Director of the Department of Building and Housing Services, told Council that all the below-listed structures are in viola- tion of Article III , Section 14-50 and 14-51 of the Dangerous Structures Ordinance of the City of Beaumont , Texas, and that all notification pro- cedures have been met : 645 BLANCHETTE - W. Mrs. G. A. Reynolds , 5470 Midford, spoke in support of the staff recommen- dation to raze the structure within thirty days . Mrs . Alma Jo Langston , 5410 Midford, urged the razing of the structure located at 5270 Midford and read several letters from some of the residents of Caldwood Addition urging the razing of the structure : Carl J and Margaret Rigney , 279 Canterbury Drive; Sandy Lupo, 235 Canterbury; Doyle Lupo , 235 Canterbury; Lillian C and W. Shelton , 240 Canter- bury; Evelyn and Charles Massey, 5555 Midford; Mr. and Mrs. John J. Curtis , 5535 Midford; and Earlene Mills, 259 Canterbury. Mr. Warren Langston, 5410 Midford and Mr. Mike Denham, 5415 Midford, spoke in support of the staff recommendation for razing the structure located at 5270 Midford within 30 days . There being no one else to speak, the public hearing was closed. -000-- Ordinance No. 84-113 declaring certain dilapidated structures to be public nuisances and requiring their repair or removal was considered : ORDINANCE NO. 84-113 ENTITLED AN ORDINANCE FINDING CERTAIN STRUCTURES TO BE PUBLIC NUISANCES, AND ORDERING THEIR REPAIR OR DEMOLITION; PROVIDING FOR SEVERABILITY AND PROVIDING FOR PENALTY. The ordinance was approved on a motion made by Councilman Turner and seconded by Councilman Samuel . question : Ayes : All Nayes : None -000< Mr . Ray Winfield, 2355 Clearview, addressed Council to request that the ordinance prohibiting the installation or use of any radio tuned to the shortwave radio frequency of the Police Department or Fire Department in any, automobile or other vehicle without first having obtained permis- sion of the Chief of Police or the Fire Chief be rescinded. Ms . Jesse Cooper, 446 Georgetown, addressed Council to invite them to a freedom rally to be held September 15th in the Civic Center. Ms. Cooper said the rally is sponsored by the Freedom Council which is a grass roots organization to preserve the First Amendment rights of freedom of reli- gion , speech, assembly and redress of grievance. Mr . Wilton White, 4420 Thomas Road, addressed Council to commend them for their efforts for downtown development . Mr .
