The Pledge was led by Mayor Neild. -000- One proclamation was issued: "Muscular Dystrophy Fill the Boot Days in Beaumont" - August 31 - September 2, 1984. -000- The following Consent Agenda items were considered: ''Approval of the Minutes of the regular City Council session held August 21 , 1984 ; Resolution 84-302 appointing Clyde Vincent and Katie Lane Duff to the Parks- and Recreation Advisory Committee with terms expiring on June 30, 1986; Resolution 84-303 authorizing payment of $4 , 520.65 to Hodges Plumbing for emergency installation of a new gas line at the Health Department ; Resolution 84-304 accepting water improvements in Lots 1-28, Block 1 ; Lots 1-20, Block 2 and Lots 1-18, Block 3 and street improvements for Wooded Creek Drive from Hidden Valley Drive approximately 275 feet east to and including the cul-de-sac ; Pleasant Bend Drive from Hidden Valley Drive approximately 255 feet west to and including the cul-de-sac and east approximately 825 feet to Enchanted Avenue; San An,selmo from Pleas- ant Bend Drive approximately 488 feet south to Guess Road; Hidden Valley Drive from Pleasant Bend Drive, approximately 1130 feet in a northeasterly direction to Enchanted Avenue and Enchanted Avenue from Pleasant Bend Drive approixmately 380 feet north in the Hidden Valley Estates for City maintenance; Resolution 84-305 authorizing payment of $1 , 223. 00 to Efficient Systems for the emergency installation of an air conditioning unit in the Street Division facility; Resolution 84-306 authorizing purchase of a 3500 GE Hale 3500-watt genera- tor for Engine No. 10 at the Fire Department from Casco Industries, Inc. at $1 , 360. 00 -134- August 28, 1984 i CORRECTED MINUTES Resolution 84-307 authorizing an annual subscription for manuals from the areas of Banks and Finance, Industrial , Public Utilities and Trans- portation to Moody' s Investor Service for the Library system at $1 ,085.00; Resolution 84-308 authorizing execution of a construction permit and a right-of-way agreement with the Lower Neches Valley Authority for the Willow Bend Drive Participation Project which crosses two (2) canals, the Tillery and the Tyrrell Laterals ; and Resolution 84-309 authorizing purchase of a data processing printer for the Health Department from MicroAge Computer at $1 , 995. 00. The Consent Agenda was approved on a motion made by Councilman Samuel and seconded by Councilman Deshotel . Question : Ayes : All Nayes: None -000- Ordinance No. 84-107 changing the zoning from R-3 (Modified Two Family and Multiple Dwelling) to NC (Neighborhood Commercial ) for property on the west side of 7th Street at Gladys was considered: ORDINANCE NO. 84-107 ENTITLED AN ORDINANCE AMENDING CHAPTER 30 OF THE CODE OF ORDINANCES OF BEAUMONT, TEXAS, AND IN PARTICULAR THE BOUNDARIES OF THE ZONING DISTRICTS AS INDICATED UPON THE ZONING MAP OF BEAUMONT, TEXAS, BY CHANGING THE ZONING FROM R-3 (MODIFIED TWO FAMILY AND MULTIPLE DWELLING DISTRICT) TO NC (NEIGHBORHOOD COMMERCIAL DISTRICT) ON PROPERTY LOCATED ON THE WEST SIDE OF 7TH STREET AT GLADYS AVENUE ; PROVIDING FOR SEVERABILITY; PROVIDING FOR REPEAL AND PROVIDING A PENALTY. The ordinance was approved on a motion made by Councilman Weisbach and seconded by Councilman Moore. Question : Ayes : All Nayes: None -000- Ordinance No . 84-108 granting a Specific Use Permit to establish a church in an LI (Light Industrial ) district in the 1500 Block of Grand (requested by the East Congregation of Jehovah' s Witnesses) was considered : ORDINANCE NO. 84-108. ENTITLED AN ORDINANCE ISSUING A SPECIFIC USE PERMIT FOR A CHURCH IN AN LI (,LIGHT INDUSTRIAL DISTRICT) LOCATED IN THE 1500 BLOCK OF GRAND AVENUE. The ordinance was approved on a motion made by Councilman Brumley and seconded by Councilman Samuel . Question: Ayes: All Nayes: None -000- Ordinance No. 84-109 granting a Specific Use Permit to establish a church and accessory activities building in an RS (Residential Single Family) district at 7750 Highway 105 (requested by Jesse Eastep for Northwest Church of Christ ) was considered : ORDINANCE NO. 84-109 ENTITLED AN ORDINANCE ISSUING A SPECIFIC USE PERMIT FOR A CHURCH AND ACCESSORY ACTIVITIES BUILDING IN AN RS (RESIDENTIAL SINGLE FAMILY DISTRICT) LOCATED ON PROPERTY LOCATED AT 7750 HIGHWAY 105. The ordinance was approved on a motion made by Councilman Moore and secon- ded by Councilman Brumley. Question : Ayes : All Nayes : None -135- August 28, 1984 Ordinance No. 84-110 abandoning a 20-foot alley in Block 60, Van Wormer Addition by retaining the tract as a general utilities easement (requested by M. R. Andrus, Jr. ) was considered : ORDINANCE NO. 84-110 ENTITLED AN ORIDNANCE VACATING AND ABANDONING A 20-FOOT ALLEY LOCATED IN BLOCK 60, VAN WORMER ADDITION, BEAUMONT, JEFFERSON COUNTY, TEXAS A14D PROVIDING FOR RETENTION AS A UTILITY EASEMENT. The ordinance was approved on a motion made by Councilman Brumley and seconded by Councilman Moore. Question : Ayes : All Nayes : None -000- The first reading of an ordinance amending the franchise with Liberty TeleCommunications, Inc. was held: AN ORDINANCE AN ORDINANCE AMENDING THE FRANCHISE GRANTED TO BEAUMONT CABLEVISION, INC. PREDECESSOR OF LIBERTY T.V. CABLE, INC. ON NOVEMBER 25, 1975, BY INCREASING THE PAYMENTS TO BE MADE THEREUNDER AND BY EXTENDING THE TERM THEREOF. The ordinance was passed to its second reading on a motion made by Council- man Turner and seconded by Councilman Weisbach. Question : Ayes : All Nayes : None -000- Resolution 84-310 authorizing execution of agreements with the appraisal firms of Cook and Associates and Jack C. Aulbaugh, Inc. to furnish appraisals of property necessary for the College Street T. I .P. Project rat a cost to the City not to exceed $18 , 500 for each contract was approved on a motion made by Councilman Brumley and seconded by Councilman Turner. Question : Ayes : All Nayes: None -000- Resolution 84-311 authorizing award of a contract with E. R. Dupuis Concrete Company for the paving of Willow Bend Drive from Walden Road south, a distance of 3 , 300 feet at $321 ,627. 93 was approved on a motion made by Councilman Turner and seconded by Councilman Brumley. Question : Ayes : All Nayes : None -000- Resolution 84-312 authorizing award of a contract with E. R. Dupuis Concrete Company for the paving of Whitson' s Way from Washington Boule- vard, approximately 615 feet southeasterly at $76, 008. 00 was approved on a motion made by Councilman Weisbach and seconded by Councilman Moore. Question : Ayes : All Nayes: None -000,- Public Hearing to consider the proposed 1984-85 budget for the City of Beaumont was held. Mr. Harold D. Idlebird, 2164 Pope Street , addressed Council to request elimination of all potholes and protrusions in all the streets in the City; for materials and labor to repair dilapidated, substandard houses occupied by indigent citizens and to clean up and develop all wooded areas inside the city limits. -136- August 28, 1984 Mrs. Delia Harrington, 815 Willow, addressed Council to request that two (2) houses be demolished, one located in the 500 Block of Center and the other at the corner of McFaddin and Center. Mr. W. H. Mellen, 4645 Highland, addressed Council in opposition to the transfer of funds from the Water Fund to the General Fund which necessi- tates raising water rates. Mrs. Sharon Eaves, 5550 Scenic Drive, addressed Council to compl=iment the staff ' s hard work in trimming the budget . The Reverend Timothy M. Hunley, 1698 LaSalle, addressed Council to urge concentration on the rehabilitation of the downtown section of the City. There being no one else to address Council , the Public Hearing was closed. -000- Councilman Samuel requested construction of a sidewalk or bridge in the 5200 Block of Helbig Road to correct a very hazardous traffic situation. Councilman Deshotel questioned minority participation in the process of choosing appraisers for the College Street T. I .P. project . Councilman Moore mentioned ditching work done on Virginia and said that he had been told of possible piping and covering of these ditches. He said this is a program he would like to see continue. -000- Mr . Ray Winfield, owner of the East Texas Metro News, addressed Council to request reinstatement of the issuance of "press passes" by the Police Department . Mr. Paul Brown, 4370 Cartwright , addressed Council to complain about poor attitudes of police personnel in making arrests and requested better communications and relationships between the Police Department and the public. -000- There being no further business , the meeting was recessed before continu- ing with the City Council Workshop Session . -000- I , Myrtle Corgey, City Clerk of the City of Beaumont , Texas, certify that the above is a true copy of the Minutes of the regular City Council ses- sion held August 28 , 1984 .
