The Pledge of Allegiance was led by Mayor Neild. -000- Mayor Neild issued one proclamation : Lamar University' s "Howdy Week in Beaumont" - August 26 - September 1 , 1984. -000- The following Consent Agenda items, were considered: Approval of the Minutes of the regular City Council session held August 7, 1984 ; Resolution 84-286 authorizing purchase of flanges, tees and tapping saddles for water line maintenance from Municipal Pipe and Fabricating Company at $2, 030. 68, Golden Triangle Pipe and Water Supply at $1 , 172 .75 and Western Pipe and Supply Company at $1 , 043. 00; Resolution 84-287 authorizing purchase of a riding lawnmower from Rayon' s at $1 , 270. 00; and Resolution 84-288 awarding a bid for acoustical tile ceilings to A-1 Acoustics in the amount of $2, 622 . 00 for installation in the Administra- tion Building, Signal Shop and in the Sign Shop in preparation of the Urban Transportation Traffic Division ' s move to the north facility on Concord Road. The Consent Agenda was approved on a motion made by Councilman Brumley and seconded by Councilman Moore. Question : Ayes : All Nayes : None ­000- An ordinance changing the zoning from R­3 (Modified Two Family and Multi- ple Dwelling) to NC (Neighborhood Commercial ) for an area referred to as the Gladys Avenue/7th Street Rezoning Study was considered: -1251 August 14, 1984 AN ORDINANCE ENTITLED AN ORDINANCE AMENDING CHAPTER 30 OF THE CODE OF ORDINANCES OF BEAUMONT , TEXAS , AND IN PARTICULAR THE BOUNDARIES OF THE ZONING DISTRICTS AS INDICATED UPON THE ZONING MAP OF BEAUMONT, TEXAS, BY CHANGING THE ZONING FROM R-3 (MODIFIED TWO FAMILY AND MULTIPLE DWELLING) DISTRICT TO NC (NEIGHBORHOOD COMMERCIAL) DISTRICT ON PROPERTY LOCATED ON THE WEST SIDE OF 7TH STREET AT GLADYS AVENUE; PROVIDING FOR SEVERABILITY; PROVIDING FOR REPEAL AND PROVIDING A PENALTY. Question : Ayes : All Nayes : None -000- Ordinance No. 84-98 changing the zoning from RS (Residential Single Family) to RM-M (Residential :Multiple Family - Medium Density) on property 122 feet west of -the 500 Block of Langham Road and 40 feet north of the Southern Pacific Railroad (requested by Ron Fittz , engineer for owner for new residential development ) was considered : ORDINANCE NO. 84-98 ENTITLED AN ORDINANCE AMENDING CHAPTER 30 OF THE CODE OF ORDINANCES OF BEAUMONT, TEXAS, AND IN PARTICULAR THE BOUNDARIES OF THE ZONING DISTRICTS AS INDICATED UPON THE ZONING MAP OF BEAUMONT, TEXAS , BY CHANGING THE ZONING FROM RS (RESIDENTIAL SINGLE FAMILY) DISTRICT TO RM-M (RESIDENTIAL MULTIPLE FAMILY -MEDIUM DENSITY)DISTRICT ON 'PROPERTY LOCATED 122 'FEET WEST OF THE 500 BLOCK OF LANGHAM ROAD AND 40 FEET NORTH OF THE SOUTHERN PACIFIC RAILROAD; PROVIDING FOR SEVERABILITY; PROVIDING FOR REPEAL AND PROVIDING A PENALTY. The ordinance was denied on a motion made by Councilman Turner and secon- ded by Councilman Brumley. Question : Ayes : All Nayes : None Councilman Turner again requested further study of the Home Occupation Ordinance for greater flexibility "so long as the appearance and the integrity of the residential neighborhood is not breached upon . " -000- _ request for a one-month delay by Mr . Johnny Conn for consideration of an ordinance changing the zoning from RM-H (Residential Multiple Family-High Density) to GC-MD (General Commercial--Multiple Dwelling) at 6395-6425 Highway 105 and an ordinance granting a Specific Use Permit for storage warehouses at 6395-6425 Highway 105 was considered. After a brief discussion, Council agreed to defer the items for one week pending receipt of a letter from Mr. Conn indicating his reasons for the request for delay. -127- August 14 , 1984 Ordinance No . 84-99 changing the zoning from RS (Residential Single Family) to RM-H (Residential Multiple Family-High Density) in the 1900 .Y Block of Dowlen Road (Requested by Carl Kohler, engineer for the owner, M. J. Campbell) was considered: ORDINANCE NO. 84-99 ENTITLED AN ORDINANCE AMENDING CHAPTER 30 OF THE CODE OF ORDINANCES OF BEAUMONT, TEXAS, AND IN PARTICULAR THE BOUNDARIES OF THE ZONING DISTRICTS AS INDICATED UPON THE ZONING MAP OF BEAUMONT, TEXAS, BY CHANGING THE ZONING FROM RS (RESIDENTIAL SINGLE FAMILY) DISTRICT TO RM-H (RESIDENTIAL MULTIPLE FAMILY-HIGH DENSITY) DISTRICT ON PROPERTY LOCATED IN THE 1900 BLOCK OF DOWLEN ROAD; PROVIDING FOR SEVERABILITY; PROVIDING FOR REPEAL AND PROVIDING A PENALTY. Ordinance No . 84-100 granting a Specific Use Permit for professional offices in the 1900 Block of Dowlen Road was considered: ORDINANCE NO. 84-100 ENTITLED AN ORDINANCE ISSUING A SPECIFIC USE PERMIT FOR PROFESSIONAL OFFICES IN THE 1900 BLOCK OF DOWLEN ROAD. These ordinances were approved on a motion made by Councilman Deshotel and seconded by Councilman Weisbach. Question : Ayes : All Nayes : None -000- Ordinance No. 84-101 granting a Specific Use Permit for a garage apartment in an RS (Residential Single Family) district at 1280 East Drive (requested by Linda C. Bernard) was considered: ORDINANCE NO. 84-101 ENTITLED AN ORDINANCE ISSUING A SPECIFIC USE PERMIT FOR A GARAGE APARTMENT IN AN RS (RESIDENTIAL SINGLE FAMILY) DISTRICT ON PROPERTY LOCATED AT 1280 EAST DRIVE. The ordinance was approved on a motion made by Councilman Moore and seconded by Councilman Brurmley. Question : Ayes: All Nayes : None ­000- Ordinance No . 84-102 granting a Specific Use Permit to establish a residen- tial treatment facility for mental rehabilitation in an RM-H (Residential Multiple Family - High Density) district at 2750 South 8th (requested by Michael Muegge, agent for Mental Health Mental Retardation of Southeast Texas) was considered: ORDINANCE NO. 84-102 ENTITLED AN ORIDNANCE ISSUING A SPECIFIC USE PERMIT FOR A RESIDENTIAL TREATMENT FACILITY FOR MENTAL REHABILITATION LOCATED AT 2750 SOUTH EIGHTH. The ordinance was approved on a motion Made by Councilman Moore and secon- ded by Councilman Weisbach. Reaud) was considered: ORDINANCE NO. 84-103 ENTITLED AN ORDINANCE ISSUING A SPECIFIC USE PERMIT FOR A BEAUTY SHOP ON PROPERTY LOCATED AT 645 18TH STREET. The ordinance was approved on a motion made by Councilman Samuel and seconded by Councilman Turner . Question : Ayes : All Nayes : None -000- Ordinance No . 84-104 abandoning the southern 15 feet of a 30-foot utility easement in Lots 13 and 14 , Block 6, Fleetwood Addition (requested by Lewis Hodge for construction of a swimming pool ) was considered: ORDINANCE NO. 84-104 ENTITLED AN ORDINANCE ABANDONING THE SOUTHERN 15 FEET OF A 30-FOOT UTILITY EASEMENT LOCATED IN LOTS 13 AND 14 , BLOCK 6 , FLEETWOOD ADDITION, BEAUMONT, JEFFERSON COUNTY, TEXAS . The ordinance was approved on a motion made by Councilman Deshotel and seconded by Councilman Moore. Question : Ayes : All Nayes: None -000- Resolution 84-289 authorizing purchase of a cab/chassis mounted with a crane from Russell & Smith Ford of Houston at $52, 277. 00 to be used by the Water Utilities Department (replacement for a 1969 unit currently in service) was approved on a motion made by Councilman Weisbach and seconded by Councilman Brumley . Question : Ayes : All Nayes : None -000- Resolution 84-290 authorizing purchase of three 2-cubic yard dump trucks from Beaumont Motor Company at $33 , 894. 00 to be used by Urban Transporta- tion Drainage Division (replacement for Units No. 3102, 2047 and 3075) was approved on a motion made by Councilman Turner and seconded by Coun- cilman Deshotel . Question : Ayes : All Nayes : None -000- Resolution 84-291 authorizing purchase of 4 , 500 tons of hot mix-cold laid asphaltic concrete for the Street Division from Troy Dodson at $2 .48 per cubic foot was approved on a motion made by Councilman Turner and seconded by Councilman Deshotel . Question : Ayes : All Nayes : None ' 000- Ordinance No . 84-105 amending Chapter 26, Section 24 of the Code of Ordi- nances relating to reduced speed zones for schools was considered: ORDINANCE NO. 84-105 ENTITLED AN ORDINANCE AMENDING CHAPTER 26, SECTION 26-24 OF THE CODE OF ORDINANCES OF THE CITY OF BEAUMONT TO CHANGE TIMES FOR SCHOOL ZONES ; PROVIDING FOR SEVERABILITY; PROVIDING FOR REPEAL AND PROVIDING A PENALTY. -129- August 14 , 1984 Ordinance No . 84-105 was approved on a motion made by Councilman Deshotel and seconded by Councilman Samuel . Question : Ayes : Al !_ Nayes : None -000- Councilman Moore spoke of ditches with high weeds and urged intensification of the weed spraying program to kill weeds rather than the slower, less effective mowing method. -000- Councilman Turner' s wife, Gayle, was welcomed to today' s session . -000- Mrs. Delia Harrington, 815 Willow Street , complained about the ditches being dug too deeply and others needing cleaning. -000- The regular City Council session was recessed. After a short recess, ZD Mayor Neild reconvened. the City Council session. Councilman Weisbach made a motion to reconsider an ordinance changing the zoning from R-3 to NC for an area referred to as the Gladys Avenue/7th Street Rezoning Study that was approved at the first of the session. The motion was seconded by Councilman Deshotel . Question : Ayes : All Nayes : None After a discussion of concerns of property owners outside the 200-foot notification area, a motion to repeal action taken to approve this ordi- nance and to defer consideration for two (2) weeks was made by Councilman Weisbach and seconded by Councilman Samuel .
