City Manager Lane Nichols Acting City Attorney -000- The Invocation was given by the Reverend Lee Wineinger, Washington Boule- vard Christian Church. The Pledge of Allegiance was led by Mayor Neild. -000- One proclamation was issued: "Texas Public Schools Week in Beaumont" - March 5-9, 1984. 000 The following Consent Agenda items were considered: Approval of the Minutes of the regular City Council session held February 21, 1984; Resolution 84-71 appointing James Massey to the Airport Advisory Committee, term expiring on May 31 , 1985; Resolution 84-72 approving an amendment to the contract with. Bell , Klein & Hoffman for planning and consultant work on the Tyrrell Historical Library to provide an increase in the hourly rate to $70.00 per hour for principals and $50. 00 per hour for associates; Resolution 84-73 authorizing purchase of a 36" and 62 hydraulic rescue rams for the Fire Department from Texas Fire Fighters in the amount of $2405. 23 ; Resolution 84-74 authorizing purchase of a 72" Sony projection television screen for the Fire Department from Suburban TV in the amount of $1 ,950.00; and Resolution 84-75 authorizing execution of an agreement with. Neches Title Company for title opinions and policies related to the Highland Avenue Project in an amount not to exceed $2,500. 00. The Consent Agenda was approved on a motion made by Councilman Cox and seconded by Councilman Moore. Question : Ayes : All Nayes: None -000- -34- February 28, 1984 I Ordinance No. 84-34 changing the zoning from R-3 (Modified Two Family and Multiple Dwelling to RS (Residential Single Family) , NC (Neighborhood Commercial) , and GC-MD (General Commercial - Multiple Dwelling) for an area referred to as the Delmar/Dixie Rezoning Study was considered: ORDINANCE NO. 84-34 ENTITLED AN ORDINANCE AMENDING CHAPTER 30 OF THE CODE OF ORDINANCES OF BEAUMONT, TEXAS, AND IN PARTICULAR THE BOUDNARIES OF THE ZONING DISTRICTS AS INDICATED UPON THE ZONING MAP OF BEAUMONT, TEXAS, BY CHANGING THE ZONING FROM R-3 (MODIFIED TWO FAMILY AND MULTIPLE DWELLING) DISTRICT TO RS (RESIDENTIAL SINGLE FAMILY) , NC (NEIGHBORHOOD COMMERCIAL) , AND GC-MD (GEN- ERAL COMMERCIAL - MULTIPLE DWELLING) DISTRICTS FOR AN AREA REFERRED TO AS THE DELMAR/DIXIE REZONING STUDY; PROVIDING FOR SEVERABILITY; PROVIDING FOR REPEAL AND PROVIDING A PENALTY. The ordinance was approved on a motion made by Councilman Deshotel and seconded by Councilman Cox. Question : Ayes : All Nayes : None -000- An ordinance changing the zoning from RS (Residential Single Family) to RM-H (Residential Multiple Family-High Density) on property in the 2500 Block of West Lucas , ease side (requested by Joe Guarnere for new apart- ment construction) was considered: AN ORDINANCE ENTITLED AN ORDINANCE AMENDING CHAPTER 30 OF THE CODE OF ORDINANCES OF BEAUMONT, TEXAS, AND IN PARTICULAR THE BOUNDARIES OF THE ZONING DISTRICTS AS INDICATED UPON THE ZONING MAP OF BEAUMONT, TEXAS , BY CHANGING THE ZONING FROM RS (RESIDENTIAL SINGLE FAMILY) DISTRICT TO RM-H (RESIDENTIAL MULTIPLE FAMILY - HIGH DENSITY) DISTRICT ON PROPERTY LOCATED IN THE 2500 BLOCK OF WEST LUCAS (EAST SIDE) ; PROVIDING FOR SEVERABILITY; PROVIDING FOR REPEAL AND PROVIDING A PENALTY. The ordinance was denied on a motion made by Councilman Deshotel and seconded by Councilman Cox. Question : Ayes : All Nayes : None -000- An ordinance changing the zoning from RM-H (Residential Multiple Family- High Density) to NC (Neighborhood Commercial) on property at 4312 and 4316 Treadway (a sewing shop and retail sewing machine sales business in operation in a converted residence which was previously granted a specific use permit for a beauty shop) was deferred at the request of the applicant , Frances Shackelford. -000- An ordinance amending a Specific Use Permit to sell alcoholic beverages in a GC-MD (General Commercial-Multiple Dwelling) district at 5905-E Phelan, by expanding the hours of operation (requested by Rick Steffler for the Magic Lounge) was considered: AN ORDINANCE ENTITLED AN ORDINANCE ISSUING A SPECIFIC USE PERMIT TO SELL ALCOHOLIC BEVERAGES IN A GC-MD (GENERAL COMMERCIAL-MULTIPLE DWEL- LING) DISTRICT LOCATED AT 5905-E PHELAN BOULEVARD. -35- February 28, 1984 I i The ordinance was denied on a motion made by Councilman Deshotel and seconded by Councilman Cox. Question : Ayes : All Nayes : None -000- Ordinance No. 84-35 issuing a Specific Use Permit to establish an adver- tising agency in an R-3 (Modified Two Family and Multiple Family) district at 2635 McFaddin (requested by Hoyt & Paula Bothe) was considered: ORDINANCE NO. 84-35 ENTITLED AN ORDINANCE ISSUING A SPECIFIC USE PERMIT FOR AN ADVERTISING AGENCY OFFICE IN AN R-3 (MODIFIED TWO FAMILY AND MULTIPLE FAMILY) DISTRICT LOCATED AT 2635 MCFADDIN. The ordinance was approved on a motion made by Councilman Cox and seconded by Councilman Deshotel. Question : Ayes : All Nayes : None -000 Ordinance No. 84-36 granting an HC (Historical-Cultural) district overlay zoning on property at 1645 Orange (requested by Robert LeJeune; structure an example of 20th Century Classic Revival architecture in Texas) was considered: ORDINANCE NO. 84-36 ENTITLED AN ORDINANCE AMENDING CHAPTER 30 OF THE CODE OF ORDINANCES OF BEAUMONT, TEXAS, AND IN PARTICULAR THE BOUNDARIES OF THE ZONING DISTRICTS AS INDICATED UPON THE ZONING MAP OF BEAUMONT, TEXAS, BY ESTABLISHING AN H-C (HIS- TORICAL-CULTURAL) OVERLAY ZONE FOR PROPERTY LOCATED AT 1645 ORANGE, BEAUMONT, JEFFERSON COUNTY, TEXAS; PROVIDING FOR SEVERABILITY; PROVIDING FOR REPEAL AND PROVIDING A PENALTY. The ordinance was approved on a motion made by Councilman Deshotel and seconded by Councilman Moore. Question : Ayes : All Nayes : None -000- The first reading of an ordinance amending commercial closed container sanitation franchises was held: AN ORDINANCE ENTITLED AN ORDINANCE AMENDING THE FRANCHISE HERETOFORE GRANTED TO REM WASTE CONTROL, INC. , BROWNING FERRIS INDUSTRIES, INC. , AND WASTE EXPRESS, INC. , THE SAME BEING ORDINANCES 83-155, 83-156, AND 83-157 WHICH GRANTED THE RIGHT TO OPERATE COMMERCIAL CLOSED CONTAINER GARBAGE COLLECTION SERVICE IN THE CITY OF BEAUMONT; TO AMEND THE BOND REQUIREMENT AND THE INDEMNITY AGREEMENT AND PROVIDING FOR SEVERABILITY. The modifications are: a 5-year, $500,000 performance bond to an annual bond of $250,000 and an Hold Harmless Agreement , completely relieving the City of Beaumont of liability for damages to franchisee's property resul- ting from City negligence anywhere in the area to an Hold Harmless Agree- meet limited to occurrence at the City landfill. The ordinance was passed to its second reading on a motion made by Coun- cilman Moore and seconded by Councilman Deshotel. Question : Ayes : All Nayes : None -36- February 28, 1984 i Resolution 84-76 authorizing execution of a five-year lease with the Beau- mont Art League from February 28, 1984 to February 27, 1989 for the facil- ity located on Fair Park property was approved on a motion made by Coun- cilman Moore and seconded by Councilman Cox. Question : Ayes: All Nayes : None -000- Resolution 84-77 authorizing purchase of Fire Department uniforms : 485 shirts from Martin' s Uniforms at $6,232.25 and 281 trousers from Tyler Uniform Company at $3 , 356. 00 was approved on a motion made by Councilman Deshotel and seconded by Councilman Moore. Question : Ayes : All Nayes : None -000- Ordinance No. 84-37 calling an election to change Washington Boulevard to M. L. King, Jr. Boulevard was considered: ORDINANCE NO. 84-37 ENTITLED AN ORDINANCE AMENDING ORDINANCE 84-20, THE GENERAL MUNICIPAL ELECTION ORDINANCE TO PROVIDE FOR THE SUBMISSION OF A PROPOSITION CONCERNING CHANGING THE NAME OF WASHINGTON BOULEVARD TO MARTIN LUTHER KING, JR. BOULEVARD; PROVIDING FOR NOTICE AND PROVIDING FOR SEVERA- BILITY. The ordinance was approved on a motion made by Councilman Deshotel and seconded by Councilman Moore. Question : Ayes : All Nayes : None -000- A resolution authorizing execution of an annual contract for petroleum products was deferred one week by the City Manager. -000- Resolution 84-78 authorizing award of bids for the demolition and removal of 10545 Black Lane and storage building to Trax Enterprises at $2 ,000.00 and 3436 Edmonds at $400. 00, 1550 Fulton at $1 ,200.00, 2433 Neches at $3, 500. 00 and 1405 Wallace at $800. 00 to Ace Clark Construction Company and 2251 Liberty at $3,495. 00 to Speedway Service Company was approved on a motion made by Councilman Deshotel and seconded by Councilman Cox. Question : Ayes : All Nayes : None -000- Mrs. Delia Harrington, 815 Willow Street , addressed Council to complain about the driving of City Bus #7508 and a near collision and also about the rudeness of a City trash crew. Mr. Larry Keith, president of Local 399, International Association of Firefighters, and Mr. Rick Gonzales , Union representative, addressed Council to say that 4, 700 signatures have been collected on the petition concerning City employees' residency requirement and requested that the issue be placed on the ballot of the April 7th General Municipal Election. -000- There being no further business , the meeting was recessed before continu- ing with the City Council workshop session. -000- I , Rosemarie Chiappetta, Deputy City Clerk of the City of Beaumont , Texas, certify that the above is a true copy of the Minutes of the regular City Council session held February 28, 1984.
