CITY COUNCIL - CITY OF BEAUMONT
HELD SEPTEMBER 6, 1983
BE IT REMEMBERED that the City Council of the City of Beaumont , Texas, met
in regular session this the 6th day of September, 1983 , with the following
present :

The Invocation was given by the Reverend Terry Pierce, pastor of the First
Church of the Nazarene.
The Pledge of Allegiance was led by Mayor Neild.

The following proclamations were issued : "Parent-Teacher Association Mem-
bership Days in Beaumont" - September 12-16, 1983; "Constitution Week in
Beaumont" - September 17-23 , 1983 and "Land Manor Week in Beaumont" -
September 11-17, 1983.

Items of the Consent Agenda were considered :
Approval of the Minutes of the regular City Council session held August
30, 1983;
Resolution 83-310 designating City Manager Karl Nollenberger, City Clerk
Myrtle Corgey and Finance Officer R. J. Nachlinger as signatories for the
City' s depository bank - First City Bank-Beaumont : and
Resolution 83-311 appointing Patricia Willard to fill the unexpired term
of Georgia Smith through October 30, 1984 on the Historical Landmark Commis-
sion; and reappointing Marilyn Adams, Collis Cannon and Raymond Chaison
to the CDBG Citizens Advisory Commission, terms expiring May 31 , 1985 and
Helen Kuhn to the Senior Citizens Advisory Commission, term expiring Septem-
ber 30, 1985.
The Consent Agenda was approved on a motion made by Councilman Deshotel and
seconded by Councilman Turner .

A resolution submitting an application for a $9, 500. 00 grant from the Sec-
retary of HUD' s Discretionary Fund for Technical Assistance to fund a study
of the problems posed by acquisition of a 1944 , 85-foot harbor tugboat ,
valued at $750, 000. 00 but can be acquired for $20, 000. 00, equipped with a
700-horsepower diesel engine capable of 13 knots per hour and a 1 , 000 gal-
lon-per-minute pump which can be modified to 8, 000 gpm pumping capacity when
modified for firefighting purposes, was deferred for one week for additional
information concerning operating expenses such as insurance, dry-docking
fees, personnel training, firefighting modifications, etc. , for budgetary
consideration as well as the positive aspects involved with the acquisition
for a firefighting tugboat that would be permanently docked in Beaumont .

Resolution 83-312 authorizing purchase of 151 live oak trees from Rand
Landscaping at $165. 00 each for the Parks and Recreation Department was
considered :
City Manager Nollenberger told Council that this project is funded 100%
by the Small Business Administration Jobs Bill grant in the amount of
$75, 000. 00 - up to 40% or $30, 000. 00 may be spent for the purchase of
trees ($24 , 915. 00) , landscaping materials (mulch, top soil and hand tools)
at a estimated cost of $2, 563 . 00 for a total materials cost of $27 ,478. 00
with $2, 522. 00 held for contingency. The remaining 60% of the grant would
„be used for employment of about thirty-five (35) temporary maintenance
workers to plant the trees.
The resolution was approved on a motion made by Councilman Deshotel and se-
conded by Councilman Lord.

Resolution 83-313 authorizing a contract with Schaumburg & Polk, Inc . ,
for engineering services in connection with preparation of construction
plans for the College Street TIP Project at a cost not to exceed $415,425.00
was approved on a motion made by Councilman Turner and seconded by Council-
man Cox.

Resolution 83-314 authorizing and ratifying intervention by the City in
Gulf States Utilities Company Dockets 5108 (a proceeding to determine how
$112 million received by GSU in a settlement of a damage claim against
United Gas resulting from its breach of a gas supply contract should be
credited to rate payers) and 5334 (a proceeding to determine what fixed
fuel adjustment factor GSU should use under a rule change that does away
with the automatic fuel adjustment ) now pending before the Public Utilities
Commission of Texas was approved on a motion made by Councilman Lord and
seconded by Councilman Cox.

Resolution 83-315 authorizing the City to apply for an amendment to its
1976 Certificate of Convenience and Necessity concerning water and sewer
services as required by the State of Texas Public Utilities Commission
was approved on a motion made by Councilman Deshotel and seconded by
Councilman Turner.

Resolution 83-316 scheduling a public hearing to be held at 1 : 15 p.m. on
September 27, 1983 to hear citizen comments on an economically depressed
area designation for the entire City of Beaumont as requested by the Cham-
ber of Commerce for industrial development bond financing eligibility was
, approved on a motion made by Councilman Turner and seconded by Councilman
Deshotel .

Councilman Lord questioned the status of development of an ordinance regu-
lating use, etc . , of helicopters within the City. City Attorney Wall re-
sponded that inquiries have been sent to other cities for similar ordi-
nances and that a review of possible conflicts with existing federal regu=
lations is being made.

Mr. Ben Rogers, 2030 Thomas Road, addressed Council to speak in opposition
to designating the City of Beaumont as an "economically depressed area. "
Mrs. Delia Harrington, 815 Willow Street , addressed Council to express her
concern for City employees' retirement benefits.
Mr. Ed Sigee, 2695 Forrest Street , addressed Council to express his concern
for personnel cuts proposed in the 1983-84 budget .

There being no further business, the meeting was recessed before continu-
ing with the City Council Workshop Session.
