City Manager Kenneth Wall City Attorney Myrtle Corgey City Clerk -000- The Invocation was given by the Reverend Otis Parish, Seventh Day Adven- tist Church. The Pledge of Allegiance was led by Councilman Lord. -000- The following Consent Agenda items were considered: Approval of the Minutes of the regular City Council sessions held August 16 and 23 , 1983 ; Resolution 83-303 appointing Bradley Viator to fill the unexpired term of Doug Echols , term to expire July 30, 1984 , and Ted Blanton, Jr. , term to expire July 30, 1986 and reappointing Walter Mayer, Jr. ; Gerald White; and David Ledyard, terms expiring July 30, 1986 , to the Planning & Zoning Commission - David Ledyard to serve as Chairman and Phyllis Mitchell to serve as Vice-Chairman for one-year terms; reappointing Nell Short to the CDBG Citizens Advisory Commission, term expiring May 31 , 1985 - Herman Rogers to serve as Chairman and Suzy Juncker to serve as Vice-Chairman; and reappointing E. A. LaBauve, Jr. , to the Parks & Recreation Advisory Commission, term expiring June 30, 1985; and Resolution 83-304 authorizing payment of $2, 704. 20 to Charles Kothe and $2, 274 .47 to Preston J. Moore for fees and expenses for the firefighters arbitration for fiscal year 1982-83. The Consent Agenda was approved on a motion made by Councilman Lord and seconded by Councilman Deshotel . Question : Ayes: All Nayes : None -000- Mayor Neild called a public hearing to hear citizen comments on the pro- posed City Budget for Fiscal Year 1983-84 . Mrs. Alzie Swearingen, president of the Beaumont Chapter of Texas Senior Citizens Association, expressed concern for increases proposed in water and sewer rates and residential sanitation fees. Mr . I . D. Buckley, 1220 Georgia, thanked Council for the Homestead Tax Exemption for Senior Citizens but expressed his concern for the large increase in property valuations and taxes. Mr . Roberto C. Flores, 2425 Buchanan, urged no increase in bus rates and questioned the change in the City Manager ' s recommendation that the City operate the Convention and Visitors ' Bureau at a savings of $300, 000. 00. -132- August 30, 1983 i Mr. J. C. Leggett , 1849 Washington Boulevard, addressed Council to ques- tion proposed personnel cuts in the Police Department . Mr . J. J. Baker, 2950 W. Lucas, requested more publicity comparing last year' s budget with this year' s proposed expenditures and asked that taxes not be raised. There being no one else to address the Council , the public hearing was closed. -000- Ordinance No. 83-93 amending Chapter 2 of the Code of Ordinances - the organizational structure of the City - was considered: ORDINANCE NO. 83-93 ENTITLED AN ORDINANCE AMENDING CHAPTER 2 OF THE CODE OF ORDINANCES OF THE CITY OF BEAUMONT TO REORGANIZE AND REALIGN VARIOUS DEPARTMENTS TO CREATE A NEW DIVISION OF BUDGET AND RESEARCH; PROVIDING FOR SEVERABILITY AND PROVIDING FOR REPEAL. The ordinance was approved on a motion made by Councilman Turner and se- conded by Councilman Cox. Question : Ayes : All Nayes : None -000- Resolution 83-305 appointing Dr. Lulu Smith as Health Authority to comply with an amendment to Article 443a-1 of the Texas Civil Statutes, effective September 1, 1983 , was approved on a motion made by Councilman Lord and seconded by Councilman Cox. Question : Ayes: All Nayes : None -000- Ordinance No. 83-94 increasing the Hotel-Motel Room Occupancy Tax from 4% to 7%, effective September 1 , 1983, was considered : ORDINANCE NO. 83-94 ENTITLED AN ORDINANCE AMENDING CHAPTER 25, SECTION 25-51(A) OF THE CODE OF ORDINANCES TO INCREASE THE TAX ON HOTEL OCCUPANCY TO SEVEN PERCENT (7%) ; PROVIDING AN EFFECTIVE DATE; PROVIDING FOR SEVERABILITY; PROVIDING FOR REPEAL AND PROVIDING A PENALTY. The ordinance was approved on a motion made by Councilman Turner and se- conded by Councilman Deshotel . Question: Ayes : All Nayes : None -000- Resolution 83-306 authorizing payment of 8% wage increase retroactive to October 1 , 1982, to firefighters in accordance with the arbitration award was approved on a motion made by Councilman Deshotel and seconded by Councilman Turner. Question: Ayes : All Nayes : None -000- Resolution 83-307 dedicating approximately 2. 1 acres of the Concord Street Service Center as a portion of Fair Park was approved on a motion made by Councilman Lord and seconded by Councilman Deshotel . Question : Ayes: All Nayes : None -133- August 30, 1983 a Resolution 83-308 authorizing purchase of approximately 8 , 000 gallons of emulsified asphalt for the Street Division from Texas Emulsions, Inc . , in the amount of $0. 90 per gallon was approved on a motion made by Coun- cilman Lord and seconded by Councilman Deshotel . Question : Ayes : All Nayes : None -000- ' Resolution 83-309 authorizing purchase of a wheel tractor with a front loading utility loader for the Water Utilities Department from Hyco Equip- ment Company in the amount of $14 , 619. 00 (purchase originally awarded to Universal Tractor and Equipment in the amount of $13, 791 . 00 by Resolution 83-258 on July 19, 1983 - when delivered, tractor did not meet specifica- tions because it did not have a heavy solid front axle as required) was approved on a motion made by Councilman Deshotel and seconded by Councilman Lord. Question : Ayes: All Nayes : None -000 Councilman Lord expressed concern for recent explosions at Southern Iron and Metal with compression of junked vehicles and asked for a staff investi- gation and report concerning their operations. Mrs. Valiree Lewis, 2885 Avenue A, addressed Council to express her concern about a fallen tree from city right-of-way and requested its removal . Mr. L. C. Bowman, 1910 Ives, addressed Council to complain about the Build- ing Inspections Department and problems encountered when moving a residen- tial structure from 2620 Brickyard Road to its present location at 1910 Ives and doing his own plumbing and wiring of the structure as required by Building Inspections.
