Question : Ayes : All Nayes : None -000- Resolution 83-132 authorizing execution of a contract with Southwestern Bell Telephone Company for collection services by the City at 20� per processed bill to be paid to the City was approved on a motion made by Councilman Turner with the added provision that all uncollectable checks be the responsibility of Southwestern Bell Telephone Company; motion was seconded by Councilman Deshotel . Question : Ayes : All Nayes : None -000- Ordinance No. 83-32 abandoning Cheek Street from East Virginia to Colorado and retaining a utility easement (requested by Lamar University) was con- sidered : ORDINANCE NO. 83-32 ENTITLED AN ORDINANCE VACATING AND ABANDON- ING CHEEK STREET FROM EAST VIRGINIA TO COLORADO STREET . The ordinance was approved on a motion made by Councilman Deshotel and seconded by Councilman Cox. Question : Ayes : All Nayes : None -000- Ordinance No. 83-33 amending Paragraphs (C) , (D) and (E) of Section 13-15 of the City Code relating to modification requirements in abatement of public nuisances involving junked motor vehicles was considered: ORDINANCE NO. 83-33 ENTITLED AN ORDINANCE AMENDING PARAGRAPHS (C) , (D) , AND (E) OF SECTION 13-15 OF THE CODE OF ORDINANCES TO PROVIDE FOR THE GIVING OF NOT LESS THAN TEN (10) DAYS NOTICE TO THE LAST KNOWN REGISTERED OWNERS OF JUNKED MOTOR VEHICLES AND ALL LIENHOLDERS OF RECORD OF JUNKED MOTOR VEHICLES; PROVIDING FOR SEVERABILITY; PROVIDING FOR REPEAL AND PROVIDING A PENALTY. Question : Ayes : Councilman Cox Abstained : Mayor Neild Councilman Deshotel Councilman Turner -000- Ordinance No . 83-34 amending Chapter 26 of the City Code so as to revise certain provisions of the electrical code was considered: ORDINANCE NO. 83-34 ENTITLED AN ORDINANCE AMENDING ARTICLE IV OF CHAPTER 6 OF THE CODE OF ORDINANCES OF THE CITY OF BEAUMONT TO REMOVE REFERENCES TO LIMITED ELECTRICIAN (ELEVATOR) AND OUT- SIDE ELECTRICIAN; PROVIDE REGULATIONS SO THAT TESTING FOR ELECTRICIAN' S LICENSES MAY BE DONE BY THE SOUTH EAST TEXAS REGIONAL ELECTRICAL EXAMINATION BOARD; INCREASING PERMIT FEES; ALLOWING THE USE OF ARMOR CABLE; PROVIDING FOR SEVERABILITY; PROVIDING FOR RE- PEAL AND PROVIDING A PENALTY. The ordinance was approved on a motion made by Councilman Deshotel and seconded by Councilman Turner . Question : Ayes : All Nayes : None -000- Ordinance No . 83-35 approving city participation in a standardized testing and certification program for electricians developed by the SETRPC and other area cities in cooperation with Lamar University was considered : ORDINANCE NO. 83-35 ENTITLED AN ORDINANCE APPROVING AGREEMENT AND BY-LAWS OF SOUTH EAST TEXAS REGIONAL ELECTRICAL EXAMINING BOARD AND AUTHORIZING THE CITY MANAGER TO EXECUTE SUCH AGREEMENT AND BY-LAWS ON BEHALF OF THE CITY OF BEAUMONT; PROVIDING FOR SEVERABILITY AND PROVIDING FOR REPEAL. The ordinance was approved on a motion made by Councilman Deshotel and se- conded by Councilman Turner. Question : Ayes : All Nayes : None -000- PUBLIC HEARING Mayor Neild called a public hearing for consideration of a Beaumont Multi-. Family Housing Finance Corporation proposal to issue bonds to finance a residential development for low and moderate income persons , known as the Folsom Project . KENNETH WALL, CITY ATTORNEY: Following the action of the Council two or three weeks ago amending the Articles of Incorporation of both Housing Finance Corporations, the Beau- mont Multi-Family Housing Finance Corporation agreed to finance a residen- tial development for low and moderate income persons on Folsom Road, con- taining approximately 152 units - the total amount of bonds to be issued in the amount of $4, 600, 000. 00. The purpose of the hearing today is for the Council to hear comments , pro and con , on the project and then to ap- prove or disapprove the issuance of the bonds. The interest on the bonds will be tax exempt . The bond holders will be protected by Federal Savings and Loan Insurance Corporation Insurance and twenty percent (20%) of the -53- April 5 , 1983 MR. WALL continued: units will be set aside for persons of low income . That is defined as per- sons whose annual income is eighty per cent (80%) or less of the median in- come in the area as determined by HUD in connection with the Section 8 Pro- gram. Currently, for four-person families , that income limit is $18 ,600 a year. Twenty per cent (20%) of the units in the development would be set aside for those persons. Those speaking in favor of the issuance of revenue bonds were : Messrs. Steve Peyton, 3795 Heatherwood, Beaumont , and Tom Key, 10404-A Golden Meadow, Austin , and partner in the firm of Stanley P. Smith Company of Bastrop , Texas. Those speaking in opposition were : Messrs. Frank Dover, 1215 Sandwood ; Sam C. Parigi , Jr. , 645 Kennedy Drive; and Paul Brown , 4370 Cartwright . The public hearing was closed. -000- Resolution 83-134 approving the issuance of $4 , 600, 000. 00 Multi-Family Housing Revenue Bonds (Victoria Federal Savings and Loan Association Certificate of Deposit Program, Series 1983) was approved on a motion made by Councilman Turner and seconded by Mayor Neild. Question : Ayes : Mayor Neild Nayes: Councilman Cox Councilman Turner Abstained: Councilman Deshotel -000- PUBLIC HEARING DILAPIDATED STRUCTURES Public Hearing to consider dilaaidated structures was called. Mr. George Gardner , Director of Urban Rehabilitation Division , told Coun- cil that all the below-listed structures are in violation of Article III , Sections 14-50 and 14051 of the Dangerous Structures Ordinance of the City of Beaumont , Texas, and that all notification procedures have been met . 4570 CARNIEGE - James P. Fahey, owner (19 violations) , recommendation to raze within 30 days; 1193 GLADYS - Aubrey Dixon , owner (19 violations) , recommendation to raze within 30 days; 3434 GLENWOOD - A. Edward and Elnora Hawkins, owners (18 violations) , recommendation to raze within 30 days ; 2244 and 2246 PENNSYLVANIA - Jasper J . Lovoi , owner (10 viola- tions) , recommendation to raze within 30 days ; 1805 PLUM STREET - Madelyn Lombardo , Trustee (12 violations) , recommendation to raze within 30 days ; and 3260 ROBERTS - Rose Johnson , owner (11 violations) , recommendation to raze or repair within 30 days. No one addressed the public hearing. Public Hearing closed. -000- Ordinance No. 83-36 declaring certain dilapidated structures to be public nuisances and requiring their repair or removal was considered : ORDINANCE NO. 83-36 ENTITLED AN ORDINANCE FINDING CERTAIN STRUCTURES TO BE PUBLIC NUISANCES, AND ORDERING REPAIR OR DEMOLITION; PROVIDING A PENALTY; AND PROVIDING FOR SEVERABILITY. The ordinance was approved on a motion made by Councilman Deshotel and seconded by Councilman Turner. Question : Ayes : All Nayes : None -54- April 5, 1983 Mr. Paul Brown, 4370 Cartwright , president of the local chapter of the NAACP, addressed Council to voice his concern for the possible need to cut City work force and to again request immediate reinstatement of the Affirmative Action Plan for the City.
