City Attorney Myrtle Corgey City Clerk -000- The Invocation was given by the Reverend James C. LeBlanc , Miracle Deliverance Tabernacle. The Pledge of Allegiance was led by Mayor Neild. -000- The following proclamations were issued : "National Nutrition Month in Beaumont" - March, 1983 and "Young Audiences Week in Beaumont" - March 20-26, 1983 . -000- The following Consent Agenda items were considered : Approval of the Minutes of the regular City Council session held March 1 , 1983 , as amended; Resolution 83-92 authorizing the withdrawal of $390, 000. 00 in securities pledged by Texas Commerce Bank of Beaumont as collateral for city bank deposits (total pledged - $47 , 145, 000. 00) ; Resolution 83-93 authorizing payment of $1 , 155. 06 to the Enterprise and Journal for publication of the ordinance calling the special election on drainage bonds ; Resolution 83-94 authorizing acquisition of 507. 5 square foot easement from Gulf States Utilities Company for the Lawrence Drive Force Main Project , Contract 9 of EPA Grant #C-481254 ; Resolution 83-95 accepting a 20-foot wide drainage easement in the H. Williams, Jr . , Survey from John and Patricia Riddle; and Resolution 83-96 accepting a sewer line easement from HJB (Howard John- son' s Motor Lodge) . The Consent Agenda was approved on a motion made by Councilman Cox and seconded by Councilman Turner. Question : Ayes : All Nayes : None -000- Ordinance No . 83-23 granting a specific use permit for a landscaping ser- vice and retail nursery business at 8155-8255 Gladys in an RM-H District (requested by Gerald Clark) was considered : -37- March 15, 1983 ORDINANCE NO. 83-23 ENTITLED AN ORDINANCE ISSUING A SPECIFIC USE PERMIT TO ESTABLISH A LANDSCAPING SERVICE AND RETAIL NURSERY IN AN RM-H (RESIDENTIAL MULTIPLE DWELLING - HIGH DENSITY) DISTRICT. The Planning Commission recommended approval of this request with a prohi- bition of access to all other streets other than Gladys . Councilman Cox made a motion to approve the ordinance without restricting access to Gladys ; motion was seconded by Councilman Lord . Question : Ayes : Mayor Nei_ld Nayes : Councilman Turner Councilman Cox Councilman Lord Councilman Deshotel -000- Resolution 83-97 accepting the work performed under a contract with S & S Enterprises for construction of the radio transmitter building and auth- orizing payment to the contractor in the amount of $24 , 894 . 90 ($424 . 00 above original amount due to variations in plan and actual quantities) was approved on a motion made by Councilman Lord and seconded by Council- man Cox. Question : Ayes : All Nayes : None -000- Resolution 83-98 authorizing the purchase of approximately 1 , 000 tons of limestone rock asphalt for street maintenance from Azrock Industries, Inc . , at $24 . 08 per ton was approved on a motion made by Councilman Turner and seconded by Councilman Lord . Question : Ayes : All Nayes : None -000- A motion to defer a resolution letting contracts for furnishing a year ' s requirement of steel conduit and accessories for the Department of Urban Transportation was made by Councilman Lord and seconded by Councilman Turner. Question : Ayes : All Nayes : None -000- Resolution 83-99 authorizing execution of a contract with D & S Barricad- ing for installation of foundations PVC conduit for traffic signals in the amount of $57 , 293 . 50 was approved on a motion made by Councilman Cox and seconded by Councilman Deshotel . Question : Ayes : Mayor Neild Abstained : Councilman Councilman Cox Turner Councilman Lord Councilman Deshotel -000- Resolution 83-100 granting in-principle approval for a project to widen a section of 23rd Street between Calder and Laurel with property owner - City participation on a 1/3-1/3-1/3 basis and authorizing development of preliminary plans, cost estimates and contracts was approved on a motion made by Councilman Turner and seconded by Councilman Cox. Question : Ayes : All Nayes : None -000- Resolution 83-101. supporting the general recommendations of the Govenor ' s Traffic Safety Task Force for new traffic safety legislation aimed princi- pally , but not exclusively , with getting drunk drivers off the road was approved on a motion made by Councilman Lord and seconded by Councilman Cox. Question : Ayes : All Nayes : None -38- March 15, 1983 i Resolution 83-1.02 authorizing and ratifying the exercise of the City ' s option to purchase Tract 3 of the former Jefferson County Tuberculosis Hospital property pursuant to an agreement with the County dated October 7 , 1980 was approved on a motion made by Councilman Deshotel and seconded by Councilman Turner . Question : Ayes : All Nayes : None -o0o- PUBLIC HEARING Public Hearing to consider a Section 108 loan guarantee application under a CDBG budget amendment was held : MAYOR NEILD: At this time , I ' d like to call a public hearing as it relates to the Section 108 loan guarantee application from CDBG budget amendment . Hugh, are you the one that ' s going . . . . . . ? HUGH EARNEST, ACTING CITY MANAGER : Yes , sir. If I may , for Council ' s information , this is the end of a long and difficult process that we ' ve all been through identifying a funding source that is still available to the City for our pro rata share of the overall development cost involved in a very crucial project for downtown Beaumont and that is Market Place . A presentation was made to the Citi- zens Advisory Committee appointed by this Council and , as you know, a unanimous recommendation has come forward from them recommending that our existing Section 108 loan agreement that we had formerly gotten for sup- port of the downtown hotel be amended to include now our participation in public improvements in Market Place . And , with that , of course , has come a recommendation that will be attached to the Section 108 loan show- ing how the City will repay Community Development Block Grant funds from anticipated revenues from the Tax Increment Zone itself . MAYOR NEILD : At this time , if there' s anyone that would like to speak in behalf of the public hearing or the Section 108 , certainly feel free to do so by coming to the podium and giving your name and address. Is there anyone that would like to speak in opposition? If not , I will declare the public hearing closed. Question : Ayes : Mayor Neild Nayes : Councilman Deshotel Councilman Cox Councilman Lord Councilman Turner -o0o- Councilman Lord asked for a written explanation on the change in the smoking ordinances - what the State ordinances say and any Attorney Gener- al ' s opinions on the subject . She noted several phone calls , pro and con , on allowing smoking in the Civic Center and asked the rationales - why it has been allowed , how it ' s working and how some City departments feel about the change . -000- -39- March 15 , 1983 Vallee Couch , 1620 Glendale ; Howard Cameron , 210 Rosine ; Larry McAnulty , 2045 Briarcliff ; Sue Brobry , 1530 5th Street , Port Arthur ; and Laverne Grimes , 660 Woodrow; addressed Council to request establishment of a committed on community ethics and moral standards . Mr . Joe B.
