City Attorney Myrtle Corgey City Clerk Absent : Joseph D. Deshotel Councilman, Ward III -000- The Invocation was given by the Reverend Eugene Thompson , Pioneer Pres- byterian Church. The Pledge of Allegiance was led by Mayor Neild. -000- The following proclamations were issued : ''Catholic Schools Week in Beau- mont" - February 6-12 , 1983; ''Beaumont Sales Month" February, 1983 and "Vocation Education Week in Beaumont"' - February 6-12 , 1983. --000- The following Consent Agenda items were considered : Resolution 83-40 authorizing Change Order No. 4 to the contract with Nash Construction Company for the Service Center , increasing the total by $1,`122. 00 by adding the installation of an underground 2-inch fiber rein- forced plastic pipe and fittings from the overflow pipe on the diesel emer- gency generator fuel day tank to a separage opening in the underground tank (_total cost of project - $2 , 546, 561 . 00) ; Resolution 83-41 authorizing the purchase of a 20-foot wide easement for the Lawrence Drive Force Main , Contract 9A of the EPA Grant #C-481254 from Lois McNeill , William Alan McNeill , Frances Ann McNeill and Nina McNeill Christian in the amount of $1 , 986. 64 ; Resolution 83-42 approving the purchase of parcel #158 of right-of-way for Calder-Major Drive intersection improvements (0. 1392 acre tract from John & Willie Rae Dollinger for $7 , 064. 00) ; and Resolution 83-43 authorizing the purchase of one (1) NEMA type traffic sig- nal controller tester to be used in repairing traffic signals from Trans- Tronics , Inc. of Fort Worth, Texas in the amount of $2 ,495. 00. The Consent Agenda was approved on a motion made by Councilman Lord and seconded by Councilman Turner. Question : Ayes : All Nayes : None -000- Ordinance No. 83--11 calling an election for March 22 on a $16 million drainage bond issue was considered : ORDINANCE NO. 83-11 ORDINANCE CALLING BOND ELECTION -16- February 1 , 1983 PROPOSITION SHALL THE CITY COUNCIL OF THE CITY OF BEAUMONT, TEXAS BE AUTHORIZED TO ISSUE AND SELL AT ANY PRICE OR PRICES THE BONDS OF SAID CITY IN THE AMOUNT OF $16,000, 000, MATURING SERIALLY WITHIN 25 YEARS FROM THEIR DATE OR DATES, AND BEARING INTEREST AT SUCH RATE OR RATES, NOT TO EXCEED THE MAXIMUM INTEREST RATE NOW OR HEREAFTER AUTHORIZED BY LAW, AS SHALL BE DETERMINED WITHIN THE DISCRETION OF SAID CITY COUNCIL, AT THE TIME OF ISSUANCE, FOR THE PURPOSE OF CONSTRUCTING PERMANENT PUBLIC IMPROVEMENTS IN AND FOR SAID CITY, TO-WIT : DRAINAGE IMPROVEMENTS, AND TO LEVY TAXES UPON ALL TAXABLE PROPERTY WITHIN SAID CITY ANNUALLY SUFFI- CIENT TO PAY THE INTEREST ON SAID BONDS AS IT ACCRUES AND TO CREATE A SINKING FUND TO PAY THE PRINCIPAL OF SAID BONDS AS IT MATURES? The probable period of usefulness of the improvements for which the bond funds are to be expended is more than 25 years. The ordinance was approved on a motion made by Councilman Turner and se- conded by Councilman Lord. Question : Ayes: All Nayes : None -000- An ordinance changing the zoning from RM-H to GC-MD for property in the 2600 Block of Coast at Plum was considered: AN ORDINANCE ENTITLED AN ORDINANCE AMENDING CHAPTER 30 OF THE CODE OF ORDINANCES OF BEAUMONT, TEXAS, AND IN PARTICULAR THE BOUNDARIES OF THE ZONING DIS- TRICTS AS INDICATED UPON THE ZONING MAP OF BEAU- MONT, TEXAS, BY CHANGING PROPERTY PRESENTLY ZONED RM-.H (RESIDENTIAL MULTIPLE DWELLING - HIGH DENSITY) DISTRICT TO GC-MD (GENERAL COMMERCIAL - MULTIPLE DWELLING) DISTRICT; PROVIDING FOR SEVERABILITY; PROVIDING FOR REPEAL AND PROVIDING A PENALTY. A motion to approve the ordinance was made by Councilman Cox and seconded by Mayor Neild. Question : Ayes : Mayor Neild Nayes : Councilman Lord Councilman Cox Councilman Turner The ordinance failed to carry. -000- Resolution 83-44 accepting the work performed under a contract with Shackelford Roofing Company for the reroofing of the generator building at the Water Treatment Plant and authorizing final payment to the con- tractor in the amount of $6, 800. 00 ($400. 00 above original bid due to additional damage) was approved on a motion made by Councilman Lord and seconded by Councilman Cox. Question : Ayes : All Nayes : None -000- Resolution 83-45 authorizing the title work by Jefferson County Title Com- pany for land acquisition for the Downtown Market Place Project was ap- proved on a motion made by Councilman Turner and seconded by Councilman Cox. Question : Ayes : All Nayes : None -000- -17- February 1 , 1983 Resolution 83-46 authorizing execution of a contract with Texas Coatings Application and Waterproofing Company for sealing of cracks and gaps around windows in the City Hall Building in the amount of $8 ,659. 00 was approved on a motion made by Councilman Lord and seconded by Councilman Cox. Question : Ayes : All Nayes : None -000- - resolution authorizing funding for the South East Texas Arts Council budget from receipts from the Hotel-Motel Room Occupancy Tax was deferred for action one week. Council requested a break-down of expenses to be covered by the $10, 000. 00 administrative line item in the budget submitted. -000- Resolution 83-47 authorizing the purchase of 5 cab/chassis for the Sanita- tion Department from Tidelands Tnternational at $263 ,240.00 was approved on a motion made by Councilman Turner and seconded by Councilman Cox. Question : Ayes : Mayor Neild Abstained : Councilman Lord Councilman Cox Councilman Deshotel -000- PUBLIC HEARING DILAPIDATED STRUCTURES The public hearing to consider dilapidated structures was called. Mr. George Gardner, Director of Urban Rehabilitation Division, told Council that all the below-listed structures are in violation of Arti- cle III , Sections 14-50 and 14-51 of the Dangerous Structures Ordinance of the City of Beaumont , Texas , and that all notification procedures have been met . 550 BROCKMAN Sam Aquilina, owner (12 violations) , recommendation to raze within 30 days; 2893 CONCORD, 3 structures , Olegario Alfaro, Irene Alfaro , Mark Anthony Alfaro, Theresa D. Alfaro Ruiz , Deloris Alfaro, Mich- ael Wayne Alfaro and Dorothy Alfaro, owners (12 violations each structure) recommendation to raze within 30 days; 1929 I'RVING - Paul Washington , owner (14 violations) recommendation to raze within 30 days; NEXT TO 4255 PINE Rising Sun Baptist Church, Revenerd Felix Haynes , Pastor, owner (16 viola- tions) , recommendation to raze or repair within 30 days ; and 745 SCHWARNER Douglas Hansel , owner (10 violations) , recommendation to raze or repair within 30 days. No citizens wished to address the hearing. It was declared closed. -000 Ordinance No. 83-12 declaring certain dilapidated structures to be public nuisances and requiring their repair or removal was considered: ORDINANCE NO. 83-12 ENTITLED AN ORDINANCE FINDING CERTAIN STRUCTURES TO BE PUBLIC NUISANCES, ORDERING REPAIR OR DEMOL- ITION FOR CERTAIN STRUCTURES; ORDERING DEMOLITION BY THE CITY UNDER CERTAIN CONDITIONS; PROVIDING A PENALTY; AND PROVIDING FOR SEVERABILITY. The ordinance was approved on a motion made by Councilman Cox and secon- ded by Councilman Turner. Question : Ayes : All Nayes : None -000- Councilman Lord requested that representatives of Liberty Cable TV be invited to a future Workshop Session to discuss their latest problems, etc. -18- February 1 , 1983 Mrs. Anita Patterson , International Union Representative for the American Federation of State, County and Municipal Employees, addressed Council to say that a request to meet with Council concerning unanswered issues had been denied by the Director of Personnel .
