The Pledge of Allegiance was led by Mayor Meyers . -000- Mayor Meyers issued the following proclamation : "Week of the Young Child in Beaumont" - March 27 - April 2 , 1982. -000- The following Consent Agenda items were considered : Resolution 82-101 authorizing withdrawal of $235 ,000.00 in securities pledged as collateral for city bank deposits by Texas Commerce Bank of Beaumont ($47,400 ,000. 00 total pledged) ; Resolution 82-102 appointing Jerry Brocato and Ben F. Hughes to the Senior Citizens Advisory Commission ; Resolution 82-103 approving a list of the numbered ballots to be issued to polling places for the April 3rd election ; Resolution 82-104 granting an underground electrical distribution ease- ment to Gulf States Utilities for an underground electric power line across property in Magnolia Park to provide service to the new bath house ; and Resolution 82-105 authorizing a six-month contract for furnishing five (5) sack ready mix cement at $54. 95 per cubic yard (add or deduct cement at $4.00 per sack) and Type III high early cement at $57. 95 per cubic yard from Cowboy Concrete Corporation. The Consent Agenda was approved on a motion made by Councilman_ Lord and seconded by Councilman. Turner. Question: Ayes : All Nayes : None -000- Ordinance No. 82-26 changing the zoning from RS to GC-MD for about 0. 73 of an acre north of the centerline of Calder about 360 feet west of Major Drive was considered: ORDINANCE NO. 82-26 ENTITLED AN ORDINANCE AMENDING CHAPTER 30 OF THE CODE OF ORDINANCES OF BEAUMONT, TEXAS, AND IN PARTICULAR THE BOUNDARIES OF THE ZONING DISTRICTS AS Ir?DICATED UPON THE ZONING MAP OF BEAUMONT, TEXAS , BY CHANGING PROPERTY DE- PICTED ON EXHIBIT "A" FROM RS (RESIDENTIAL SINGLE FAMILY) -45- March 23, 1982 DWELLING TO GC-MD (GENERAL COMMERCIAL - MULTIPLE DWELLING) DISTRICT; PROVIDING FOR SEVERABILITY; PROVIDING FOR REPEAL AND PROVIDING FOR A PENALTY. The ordinance was approved on a motion made by Councilman Lord and seconded by Councilman Turner. Question : Ayes : All Nayes : None -000- An ordinance changing the zoning from RS to RM-H and GC-MD for property at the intersection of Old Voth Road and RFD Road was considered : AN ORDINANCE ENTITLED AN ORDINANCE AMENDING CHAPTER 30 OF THE CODE OF ORDINANCES OF BEAUMONT, TEXAS , AND IN PARTICULAR THE BOUNDARIES OF THE ZON- ING DISTRICTS AS INDICATED UPON THE ZONING MAP OF BEAUMONT, TEXAS, BY CHANGING THE ZON- ING FROM RS (RESIDENTIAL SINGLE FAMILY) DIS- TRICT TO GC-MD (GENERAL COMMERCIAL - MULTIPLE DWELLING) DISTRICT AND RS (RESIDENTIAL SINGLE FAMILY) DISTRICT TO RM-H (RESIDENTIAL MULTIPLE DWELLING-HIGH DENSITY) DISTRICT ON PROPERTY LOCATED AT THE INTERSECTION OF RFD ROAD AND OLD VOTH ROAD; PROVIDING FOR SEVERABTLITY; PROVIDING FOR A PENALTY; AND PROVIDING FOR REPEAL. Councilman Lord made a motion to table action for one week to obtain further information ; motion was seconded by Councilman Turner. Question : Ayes : All Nayes : None -000- Ordinance No. 82-27 abandoning a general utility easement across property in Lots 6 and 7 of Anderson Estates Addition at 5555 Dellwood was con- sidered : ORDINANCE NO. 82-27 ENTITLED AN ORDINANCE ABANDONING A 15--FOOT UTILITY EASEMENT LOCATED IN LOTS 6 AND 7 , BLOCK 2 , ANDERSON ESTATES ADDITION, JEFFER- SON COUNTY, TEXAS . The ordinance was approved on a motion made by Councilman Turner and se- conded by Councilman Lord. Question : Ayes : All Nayes : None -000- Ordinance No. 82-28 amending Section 30-4 B. 17 of the City Code by chang- in; the definition of Two-Family Dwelling was considered: ORDINANCE NO. 82-28 ENTITLED AN ORDINANCE AMENDING SECTION 30-4B OF THE CODE OF ORDINANCES OF THE CITY OF BEAU- MONT BY REDEFINING A TWO-FAMILY DWELLING; PRO- VIDING FOR SEVERABILITY; PROVIDING= FOR REPEAL AND PROVIDING A PENALTY. The ordinance was approved on a motion made by Councilman Lord and secon- ded by Councilman Turner. Question : Ayes : All Nayes : None -000- -46-- March 23, 1982 Ordinance No. 82-29 adopting a Community Development Plan including revi- sions of the Citizens Participation Plan for the Community Development Block Grant Program was considered : ORDINANCE NO. 82-29 ENTITLED AN ORDINANCE AMENDING CHAPTER 2 OF THE CODE OF ORDINANCES TO CHANGE THE SIZE AND THE TERMS OF THE COMMUNITY DEVELOPMENT ADVISORY COMMITTEE ; ADOPTING A COMMUNITY DEVELOPMENT PLAN INCLUDING REVISIONS AND AN UPDATE OF THE CITIZENS PARTICIPATION PLAN FOR THE COMMUNITY DEVELOPMENT BLOCK GRANT PROGRAM ; REPEALING ORDINANCE 79-3 AND OTHER ORDINANCES IN CONFLICT HEREWITH; PROVIDING FOR SEVERABILITY AND PRO- VIDING FOR REPEAL. The ordinance was approved on a motion made by Councilman Turner and se- conded by Councilman_ Lord. Question : Ayes : All Nayes : None -000- Resolution 82-106 approving the notice of sale of $15 million in waterworks and sewer system prior lien revenue bonds and authorizing distribution of the notice of sale on April 20, 1982 was approved on a motion made by Councilman Lord and seconded by Councilman Turner. Question : Ayes : All Nayes : None -000- Resolution 82-107 authorizing advertisement for bids on construction of the Dowlen Road TIP Project , No. 82-B562--00477, was approved on a motion made by Councilman Turner and seconded by Councilman Lord. Question. : Ayes : All Nayes : None 000- Resolution 82-108 rejecting all bids received on construction of the service center and authorizing readvertisement of the project based on revised plans and specifications was approved on a motion made by Coun- cilman Lord and seconded by Councilman Turner. Question : Ayes : All Nayes : None -000- Resolution 82-109 accepting the work performed under a contract with Excavators and Constructors , Inc. for paving and utility improvements in the Hebert Neighborhood, Census Tract 23 , Project 46-13-305-08718 , and authorizing final payment of $102 , 308. 15 to the contractor (total of the project including C. 0. #1 & 2 - $1 ,750 ,763 . 25) was approved on a motion made by Councilman Turner and seconded by Councilman Lord. Question : Ayes : All Nayes : None -000- Ordinance No. 82-30 amending Chapter 11 of the City Code to allow the sale of packaged frozen dairy products on the street from refrigerated vehicles was considered: ORDINANCE NO. 82-30 ENTITLED AN ORDINANCE AMENDING CHAPTER 11 OF THE CODE OF ORDINANCES OF THE CITY OF BEAUMONT PROVIDING FOR THE SALE OF PACKAGED FROZEN DAIRY FOOD PRODUCTS UPON THE CITY STREETS FROM REFRI- GERATED VEHICLES ; PROVIDING FOR SEVERABILITY; PROVIDING FOR REPEAL AND PROVIDING A PENALTY. The ordinance was approved on a motion made by Councilman Turner and se- conded by Councilman Lord. Question : Ayes : All Nayes : None -47- March 23 , 1982 Resolution. 82-110 authorizing purchase of four tracts of right--of-way for the Phelan Boulevard TIP Project Extension (#7-A from John Snell & Jamie Carter At $18,600. 00; #13 from West End Baptist Church at $24,400.00; #24 at $7, 870. 00 from Viola Stagg; #. 25 from Margaret & Moody Clampitt at $7,986. 00) was approved on a motion made by Councilman Turner and seconded by Councilman Lord. Question : Ayes : All Nayes : None -000- Resolution 82-111 accepting a $50 , 000. 00 donation from Mrs. Martha Klein to be used for the development of the new 26-acre multipurpose community park in northwest Beaumont in the southeast corner of the intersection of Griffin- and Walker Roads and naming the park "Klein Park" was approved on a motion made by Councilman Lord and seconded by Councilman Turner. Question : Ayes : All Nayes : None -000- Mayor, Meyers asked that the Traffic and Transportation Department study the continued need for -the school zone in the 1700 Block of College Street and if the need is still valid that better/clearer markings be established for motorists . Mr. Doyle Doyle Owens addressed Council to stress the importance to our local airport the "Community Air Service Act of 1982, HR 5717, " introduced by Congressman Gene Snyder, the Minority Leader of the House Aviation Com- mittee, which would save Joint Air Fares for another six years. Mr. Owens asked that Council direct correspondence which would support this legislation. -000-. Mr- La'Fayette Spivey, Jr. , 6010 Chandler Drive , addressed Council in opposition to the proposed site for relocation of the Landfill. Mr. Albert Harrison , 1163 Evalon , told Council he was in attendance for a dilapidated structures hearing. The hearing is scheduled for March 30th.
