City Manager Kenneth Wall City Attorney Myrtle Corgey City Clerk (*Councilman Williams arrived during the public hearing portion for dilapidated structures . ) -000- The Invocation was given by Rabbi Herbert Rutman , Temple Emanuel. The Pledge of Allegiance was led by Councilman Turner. -000- Mayor Meyers welcomed Rabbi Rutman to Beaumont . He has recently moved from Baltimore with his wife Lois and two sons. The following proclamations were issued : "Texas Flag Day in Beaumont" March 2 , 1982 ; and "Scout Day in Beaumont" - March 6 , 1982 . -000- Councilman Lord ' s daughter Victoria Guedry was welcomed to today' s meeting. -000- Resolution 82-69 awarding a contract for furnishing and delivering a high- service pumping unit and motor starter equipment for expansion of the Loeb pumping station from Peabody Floway, Inc . at a cost of $87 , 035 . 00 was ap- proved on a motion made by Councilman Turner and seconded by Councilman Combs. Question: Ayes : All Nayes : None -000- Ordinance No. 82-14 calling the City General Election was considered : ORDINANCE NO. 82-14 ENTITLED AN ORDINANCE ORDERING A GENERAL MUNICIPAL ELECTION; ORDERING THE GENERAL MUNICIPAL ELECTION TO BE HE LD IN THE CITY OF BEAUMONT , TEXAS , ON THE 3RD DAY OF APRIL, 1982 , AS PROVIDED BY THE CHARTER OF BEAUMONT , AND THE STATUTES OF THE STATE OF TEXAS , FOR THE PURPOSE OF ELECTING A MAYOR AND FOUR COUN- CILMEN; NAMING THE PRECINCTS AT WHICH THE ELECTION SHALL BE HELD ; APPOINTING OFFICERS TO PRESIDE OVER SAID ELECTION ; APPOINTING A CANVASSING BOARD FOR ABSENTEE VOTING ; APPOINTING A MANAGER AND JUDGE OF THE CENTRAL COUNTING STATION; PROVIDING FOR NOTICE THEREOF; PROVIDING FOR A JOINT ELECTION WITH THE BEAUMONT INDEPENDENT SCHOOL DISTRICT AND THE SOUTH PARK INDEPENDENT SCHOOL DISTRICT; AND PROVIDING FOR SEVERABILITY. -28- February 23 , 1982 The ordinance was approved on a motion made by Councilman Combs and se- conded by Councilman Lord . Question : Ayes : All Nayes : None -000- Resolution 82-70 authorizing a contract with the South East Texas Regional Planning Commission for utilization of funds available under Section 8 of the Urban Mass Transportation Act ( $17 , 000 available to be used for analy- sis for alternate funding and the goals and the performance of the system to develop the most efficient route system, central transfer point and other specifics related to the system to try to increase the ridership and to keep expenses at the minimum based on the volume of riders) was approved on a motion made by Councilman Lord and seconded by Councilman Turner. Question : Ayes : All Nayes : None -000- Resolution 82-71 authorizing an agreement for a Fire Department reserve pumper , #6 - 160 Seagraves 750 gpm. pumper , to be leased to ICI Americas , Inc. Bayport Site for $1, 000 per month (for approximately two months awaiting arrival of their unit ) was approved on a motion made by Council- man Lord and seconded by Councilman Combs. Question : Ayes : All Nayes : None -000- Resolution 82-72 authorizing one--year contract for furnishing liquid chlorine for the waterworks from Jones Chemical , Inc . , in the approximate amount of $213 . 00 per ton was approved on a motion made by Councilman Combs and seconded by Councilman Turner . Question: Ayes : All Nayes : None -000- Resolution 82-73 authorizing a six-month contract for parts and service for International Trucks from Tidelands International , Inc . , was approved on a motion made by Councilman Combs and seconded by Councilman Lord . Question : Ayes : All Nayes : None -000- Resolution 82-74 authorizing acquisition of five parcels (#4-A from Alfred C. Wehner at $2 , 655 . 00 ; #5-C from Joseph E. Winston at $109 . 00 ; #6 from Don Streety Enterprises , Inc . , at $6 ,850 . 00 ; #6-B from Dorset Ray Johnson at $1 , 521. 00 and #6-D from Stephen Randolph Streety at $4 , 650 . 00 - 18 of 25 parcels still needed) of right-of-way needed for the Phelan Boulevard TIP Project was approved on a motion made by Councilman Turner and secon- ded by Councilman Lord . Question: Ayes : All Nayes : None -000- The regular City Council session was recessed so that a public hearing concerning dilapidated structures could be held . Mr. George Gardner , Urban Rehabilitation Administrator , told Council that all the below-listed structures are in violation of Article III , Sections 14-50 and 14-51 of the Dangerous Structures Ordinance of the City of Beau- mont , Texas , and that all notification procedures have been met. Mr . Gardner said the first structure to be considered was 1163 Evalon , Mr. Albert B. Harrison , owner of record , and that there are 15 violations against the structure , with staff recommendation that it be razed within 30 days. Mr. Harrison addressed Council to say that because of incarceration in the Jefferson County Jail , notification of the proceedings was not received until release on February 3rd . He told Council he was financially unable to make the necessary corrections and had not had sufficient time to seek financial aid. -29- February 23 , 1982 In answer to questions , Mr. Harrison told Council he was living in the structure. Mr. Gardner told Council that all utilities have been discon- nected and that extensive deterioration and vandalism have taken place . Council. agreed to defer action for thirty days to allow Mr. Harrison time to remove trash and debris from the structure, complete boarding windows and doors to prevent entrance , and to have the utilities reconnected to show that proper effort is being made to make the structure habitable . (Councilman Williams arrived during this portion of the public hearing . ) 1054 Liberty - Charles Glass , owner (11 violations) , recommendation to raze within 30 days ; 3425 Pine - Ed Seale , owner ( 24 violations) , recom- mendation to raze within 30 days ; and 2192 Southerland - William A. Newman owner (11 violations) , recommendation to raze within 30 days . A motion to approve the recommendations was made by Councilman Lord and seconded by Councilman Turner. Question: Ayes : All Nayes : None The public hearing was declared closed and the regular City Council ses- sion was reopened. -000- Ordinance No. 82-15 declaring certain dilapidated structures to be public nuisances and requiring their repair or removal was considered : ORDINANCE NO. 82-15 ENTITLED AN ORDINANCE FINDING CERTAIN STRUCTURES TO BE PUBLIC NUISANCES , ORDERING REPAIR OR DEMOL- ITION FOR CERTAIN STRUCTURES; ORDERING DEMOLITION BY THE CITY UNDER CERTAIN CONDITIONS ; PROVIDING A PENALTY; AND PROVIDING FOR SEVERABILITY. The ordinance was approved on a motion made by Councilman Combs and se- conded by Councilman Turner . Question: Ayes : All Nayes : None -000- Mr. Charles Moon, 1090 Bingman, addressed Council to request permission to fence city right-of-way adjacent to his residence or to purchase the pro- perty if it is surplus.
