City Attorney -000- The Invocation was given by the Reverend Richard N. Phillips , Roberts Avenue United Methodist Church. The Pledge of Allegiance was led by Councilman Lord. -000- Mayor Meyers issued the following proclamations : "Christmas Seals Month in Beaumont" - December , 1981 and "Beaumont Symphony Orchestra Week in Beaumont" - November 30 - December 6, 1981 . -000-- The following Consent Agenda items were considered : Approval of the Minutes of the regular City Council session held Novem- ber 17, 1981 ; Resolution 81-477 authorizing the purchase of 20 trash receptacles from Century Paper, Inc. at .a cost of $2 , 981 . 00; Resolution 81-478 authorizing the purchase of plastic water pipe for use by Water Distribution from SPI Municipal Supply Company of Lafayette, Louisiana at a cost of $1 , 320. 40; Resolution 81-479 authorizing payment of $1 , 790. 00 for business services provided for the Library by Standard and Poor ' s Corporation; and Resolution 81-480 appointing Mrs . Ida Mae Bouligny to the Senior Citizens Advisory Commission for a three-year term expiring September 30, 1984. The Consent Agenda was approved on a motion made by Councilman Williams and seconded by Councilman Lord. Question : Ayes : All Nayes : None -000- An ordinance changing the zoning from RS to PUD for a 105 acre tract southwest of the intersection of Comstock Road and the Santa Fe rail- road right-of-way and approving a general land use and density plan was considered : AN ORDINANCE ENTITLED AN ORDINANCE AMENDING CHAPTER 30 OF THE CODE OF ORDINANCES OF BEAUMONT, TEXAS, AND IN PARTICULAR THE BOUNDARIES OF THE ZONING DISTRICTS AS INDICATED UPON THE ZONING MAP OF BEAUMONT, TEXAS, BY CHANGING PROPERTY DESCRIBED UPON EXHIBIT "A" FROM $S (RESIDENTIAL SINGLE FAMILY) DISTRICT TO PUD (PLANNED UNIT DEVELOPMENT) DISTRICT; AND APPROVING A GENERAL LAND USE AND DENSITY PLAN. -183- November 24 , 1981 LANE NICHOLS , ASST. CITY ATTORNEY: Immediately prior to the meeting, the Mayor was served an injunction enjoining the Council from considering or taking any action today on this matter. A hearing is set for December 3rd and we would not have any further comment on it until we 've had a chance to look at the petition for injunction. -000- Ordinance No. 81-92 changing the zoning from R-3 to RS for 19 acres along Concord Road between the Santa Fe railroad crossing and Redwood Drive was considered : ORDINANCE NO. 81-92 ENTITLED AN ORDINANCE AMENDING CHAPTER 30 OF THE CODE OF ORDINANCES OF BEAUMONT, TEXAS, AND IN PARTICULAR THE BOUNDARIES OF THE ZONING DISTRICTS AS INDICATED UPON THE ZONING MAP OF BEAUMONT, TEXAS BY CHANGING PROPERTY DESCRIBED AS THE CONCORD ROAD REZONING STUDY, SECTION II AND PRESENTLY ZONED R-3 (MODIFIED TWO FAMILY AND MULTIPLE DWELLING) DISTRICT TO RS (RESIDENTIAL SINGLE FAMILY) DISTRICT; PROVID- ING FOR SEVERABILITY; PROVIDING FOR REPEAL; AND PRO- VIDING A PENALTY. The ordinance was approved on a motion made by Councilman Combs and se- conded by Councilman Turner. Question : Ayes : All Nayes : None -000- Ordinance No. 81-93 granting a specific use permit for offices on a seven- acre tract in the 3500 Block of Delaware zoned RM-H was considered : ORDINANCE NO. 81-93 ENTITLED AN ORDINANCE FOR THE ISSUANCE OF A SPECIFIC USE PERMIT TO BUILD PROFESSIONAL OFFICES IN AN RM-H (RESIDENTIAL MULTIPLE DWELLING - HIGH DENSITY) DISTRICT ON PROPERTY DESCRIBED AS 7. 0 ACRES LOCATED IN THE 3500 BLOCK OF DELAWARE AVENUE, BEAUMONT, TEXAS . The ordinance was approved on a motion made by Councilman Combs and se- conded by Councilman Williams. Question : Ayes : All Nayes : None -000- Ordinance No. 81-94 abandoning a utility easement across property in Block 11 , French Heights Addition was considered : ORDINANCE NO. 81-94 ENTITLED AN ORDINANCE ABANDONING A 15-FOOT UTILITY EASEMENT LOCATED IN BLOCK 11 , FRENCH HEIGHTS ADDI- TION, BEAUMONT, TEXAS. The ordinance was approved on a motion made by Councilman Lord and secon- ded by Councilman Williams . Question: Ayes : All Nayes : None -000- -184- November 24 , 1981 Ordinance No. 81-95 abandoning a 200-foot section of Corley Avenue right- of-way between Interstate 10 and Hillebrandt Bayou was considered : ORDINANCE NO. 81-95 ENTITLED AN ORDINANCE VACATING AND ABANDONING A PORTION OF CORLEY STREET FROM I-10 WEST TO HILLEBRANDT BAYOU AS DESCRIBED HEREIN. The ordinance was approved on a motion made by Councilman Turner and seconded by Councilman Lord. Question : Ayes : All Nayes : None -000- Resolution 81-481 authorizing eminent domain proceedings to acquire three parcels of right-of-way for the Dowlen Road Extension Project (Parcels #3 at $1 , 628 . 00; #4 at $1 ,630. 00; and #11 at $34 ,554 . 00) was approved on a motion made by Councilman Turner and seconded by Councilman Lord. Question : Ayes : All Nayes : None -000- Resolution 81-482 authorizing execution of a contract for remodeling of the Central Park Community Center (UPAAR grant ) with Watkins Construction Company at a cost of $133,400. 00 was approved on a motion made by Council- man Combs and seconded by Councilman Lord. Question : Ayes : All Nayes : None -000- Resolution 81-483 authorizing execution of a contract for Roberts Park improvements (UPAAR grant ) with J. R. Plake , Inc. at a cost of $47 ,975. 00 was approved on a motion made by Councilman Combs and seconded by Council- man Turner . Question : Ayes : All Nayes : None -000- Ordinance No. 81-96 amending Section 28-39 of the Code of Ordinances set- ting landfill hauling permit fees was considered : ORDINANCE NO. 81-96 ENTITLED AN ORDINANCE AMENDING SECTION 28-39 OF THE CODE OF ORDINANCES OF THE CITY OF BEAUMONT TO PROVIDE FOR INSPECTION AND DUMPING PERMIT FEES FOR EACH CONVEYANCE TO BE USED BY ANY AP- PLICANT; PROVIDING FOR SEVERABILITY; PROVIDING FOR REPEAL AND PROVIDING A PENALTY. The ordinance was approved on a motion made by Councilman Combs and seconded by Councilman Turner. Question : Ayes : All Nayes : None -000- Resolution 81-484 authorizing the sale of Parcel #3 (19, 992. 58 square feet of land out of S. portion of City Tax Tract 1 , Plat "Q" , David Brown League) to Earnest Handnot , Sr. at $10, 500. 00 and Lot 1 , Block 6, Eastwood Addition to Archie Perkins , Jr. at $1 , 200. 00 and authorizing rejection of bids re- ceived for Parcel #1 for City Tract 19-A, Plat "M" , David Brown League and Parcel #2 for 16, 958 . 39 square feet of land out of the N. portion of City Tax Tract 1 , Plat "Q" , David Brown League was approved on a motion made by Councilman Lord and seconded by Councilman Combs. Question : Ayes : All Nayes : None -000- -185- November 24, 1981 Resolution 81-485 authorizing execution of a contract with H. B. Neild & Sons , Inc . in the amount of $1 ,697, 000. 00, including Alternate #l , for the construction of Riverfront Park subject to approval by state and fed- eral agencies involved in grant assistance for this project was approved on a motion made by Councilman Williams and seconded by Councilman Lord . Question : Ayes : Al]_ Nayes : None -000- Resolution 81-486 authorizing Change Order No. 5 to the contract with Signal Engineering Company for a computerized traffic signal system (in- creasing contract by $15 , 001 . 00 to provide for the replacement of the existing Honeywell Controllers and RIU' s with Multisonic ' s 111-G control- lers) was approved on a motion made by Councilman Williams and seconded by Councilman Combs. Question : Ayes : All Nayes : None -000- Resolution 81-487 authorizing an amendment to the City ' s Community Devel- opment Block Grant application to include a Section 108 loan guarantee for land acquisition for the proposed hotel in the Central Business Dis- trict in the amount of $1 , 050, 000. 00 was approved on a motion made by Councilman Turner and seconded by Councilman Williams . Question : Ayes : All Nayes : None -000- Ordinance No. 81-97 authorizing the advance refunding of City of Beaumont Water Works Revenue Refunding Bonds , Series 1959, City of Beaumont Water Works System Revenue Bonds , Series 1971A, 1972A and 1978A was considered : ORDINANCE NO. 81-97 ORDINANCE AUTHORIZING ADVANCE REFUNDING OF THE CITY OF BEAUMONT, TEXAS, WATERWORKS SYSTEM REVENUE RE- FUNDING BONDS, SERIES 1959, AND CITY OF BEAUMONT, TEXAS , WATERWORKS SYSTEM REVENUE BONDS , SERIES 1971-A, SERIES 1972-A AND SERIES 1978-A. ( Issuance of $3 , 740, 000 City of Beaumont , Texas , Waterworks and Sewer System Revenue Refunding Bonds , Series 1981) The ordinance was approved on a motion made by Councilman Lord and secon- ded by Councilman Combs . Question : Ayes : All Nayes : None -000- Ordinance No. 81-98 authorizing issuance of $3 , 740,000 in City of Beaumont Water Works and Sewer System Revenue Bonds , Series 1981 was considered : ORDINANCE NO. 81-98 AN ORDINANCE AUTHORIZING THE ISSUANCE OF $3 , 740,000 CITY OF BEAUMONT, TEXAS , WATERWORKS AND SEWER SYSTEM REVENUE REFUNDING BONDS , SERIES 1981 . The ordinance was approved on a motion made by Councilman Williams and seconded by Councilman Combs . Question : Ayes : All Nayes : None -000- Mayor Meyers declared the regular City Council session recessed and de- clared the public hearing for consideration of dilapidated structures open . Mr . George Gardner, Urban Rehabilitation Administrator, told Council that all the below-listed structures are in violation of Article III , Sections 14-50 and 14-51 of the Dangerous Structures Ordinance of the City of Beaumont , Texas , and that all notification procedures have been met : -186- November 24, 1981 1850 CARTWRIGHT - Hebert L. Vatters , owner (9 violations) , recommendation to raze wtihin 30 days. Councilman Combs made a motion to approve the recommendations ; motion was seconded by Councilman Williams. Question : Ayes : All Nayes : None There being no citizens present wishing to address Council concerning the above-listed structures , the public hearing was closed. -000- Ordinance No. 81-99 declaring certain dilapidated structures to be public nuisances and requiring their repair or removal was considered : ORDINANCE NO. 81-99 ENTITLED AN ORDINANCE FINDING CERTAIN STRUCTURES TO BE PUBLIC NUISANCES , ORDERING REPAIR OR DEMOL- ITION FOR CERTAIN STRUCTURES; ORDERING DEMOLITION BY THE CITY UNDER CERTAIN CONDITIONS ; PROVIDING A PENALTY; AND PROVIDING FOR SEVERABILITY. The ordinance was approved on a motion made by Councilman Williams and se- conded by Councilman Turner. Question : Ayes : All Nayes : None -000- CITY MANAGER RAY RILEY: I ' d like to bring to Council ' s attention that the Assistant City Manager R. E. Platt has been serving the City now for 20 years and will be com- pleting his service this week and this will be his last Council meeting. Next Monday , he will commence a new career as the Chief Administrator for Drainage District 6 and I would like to recognize his years of ser- vice with the City and express our appreciation for the job that he ' s done and wish him good luck and good fortune with the Drainage District and his concerns in the future. MAYOR MEYERS : I would express feelings of Council , Ron , and the citizens of Beaumont for your dedicated service in so many different jobs through the years at the City which I think was a clear reflection of your desire to serve. Sad that you ' re leaving but pleased I think that you' re moving to an area that I think your management abilities are needed and I 'm very pleased that you ' ll be there to help them. And, so, we wish you well and wish you the best and on behalf of Council we thank you and appreciate your services for Beaumont . R E. PLATT: I appreciate the good comments from the Manager and the Council and I look forward to going to this new position and solicit your support . -187- November 24, 1981 Mrs . Delia Harrington, 815 Willow Street , addressed Council to complain of low water pressure in her area. Mr. Dan Soto, 240 Enfield, addressed Council to suggest the City construct a recreational water slide and also spoke to South Park Independent School District issues. Mr. J. C.
