E . Platt Asst . City Manager Kenneth Wall City Attorney -000- The Invocation was given by Reverend Tom Foster , Associate Minister of the New Life Tabernacle . The Pledge of Allegiance was led by Councilman Lord . -000- The following items on the Consent Agenda were considered : Approval of Minutes of the Regular Session held by City Council on August 18, 1981 . R-81 -341 authorizing Doris McCauley to sign Municipal Court checks . R-81 - 342 authorizing payment in the amount of $1112 . 60 to General Indicator Corporation for repairs to the Civic Center scoreboard . R-81 -343 rescinding the bid awarded to East Texas Service Corporation , (Resolution 81 -243 passed by Council June 23 , 1981 ) , for furnishing various brass pipe fittings in the amount of $7210. 00 , and awarding the bid to Rohan Company in the amount of $9860 . 00. R-81 -344 authorizing payment of $2325 . 00 to Walnut Equipment Leasing Company , Inc. , for the purchase of three cash registers to be used in the Central Collections section . R-81 -345 authorizing the execution of an agreement with the South East Texas Regional Planning Commission for transportation planning funds . The Consent Agenda was approved on a motion made by Councilman Lord and seconded by Councilman Turner . QUESTION : AYES : All NAYES : None -132- AUGUST 25 , 1981 -000- Ordinance 81 -64 was considered : ORDINANCE NO . 81 -64 ENTITLED AN ORDINANCE FOR THE ISSUANCE OF A SPECIFIC USE PERMIT FOR A CHURCH AND ACCESSORY BUILDINGS IN AN RS ( RESI - DENTIAL SINGLE FAMILY ) DISTRICT ON A 5 . 8 ACRE TRACT DESCRIBED AS A PORTION OF THE H . WILLIAMS LEAGUE , ABSTRACT 56 , BEAUMONT , TEXAS , LOCATED ON THE SOUTH- EAST CORNER OF FOLSOM AND DOWLEN ROADS HEREIN DESCRIBED IN ACCORDANCE WITH A "SITE PLAN" . (North End United Methodist Church) Councilman Turner moved adoption of the Ordinance ; seconded by Council - man Lord. QUESTION - AYES : All NAPES : None -000- Ordinance 81 -66 was considered : ORDINANCE 81 -66 ENTITLED AN ORDINANCE AMENDING CHAPTER 30 OF THE CODE OF ORDINANCES OF THE CITY OF BEAUMONT BY AMENDING SECTION 30-23(b ) BY CHANGING THE SETBACK REQUIREMENTS FOR COMMERCIAL BUILDINGS IN R-3 (MODIFIED TWO FAMILY AND MULTIPLE DWELLING) DISTRICT ; PROVIDING FOR SEVERABILITY ; PROVIDING FOR REPEAL AND PROVIDING A PENALTY . (Councilman Combs arrived. ) - 133- AUGUST 25 , 1981 Councilman Turner moved adoption of Ordinance No. 81 -66 ; seconded by Councilman Lord. QUESTION : AYES : All NAYES : None -000- Resolution 81 -346 accepting the bids of Texas Emulsions , Inc . , for furnishing liquid asphalt @ $ . 66/ al ; Keown Supply Company for limestone base @ $2 . 85/ton , plus freight @ ?9 . 62/ton , and White ' s Mines , Inc . , for aggregate @ $10 . 25/ton plus freight @ $11 . 08/ton , was approved on a motion made by Councilman Combs ; seconded by Councilman Turner . QUESTION : AYES : ALL NAYES : None -000- Resolution 81 -347 accepting the bid of The Plank Company , in the amount of $10 , 268. 00 , for furnishing a complete shoring system consisting of 12 shores , bucket pump with hose and a trench box to be used by Sewer Maintenance Department, was approved on a motion made by Councilman Lord and seconded by Councilman Combs . QUESTION : AYES : All NAYES : None -000- Resolution 81 -348 approving a proposed Comprehensive Employment and Training Act Manpower Plan for fiscal year 1982 and authorizing the extension of a consortium agreement to serve the residents of the three-county South East Texas Region , was made on a motion by Council - man Combs ; seconded by Councilman Turner. QUESTION : AYES : All NAYES : None Mayor Meyers complimented Laurie Bouillion , Director of Employment and Training , South East Regional Planning Commission , for the work she did relative to the agreement. -000- Resolution 81 -349 authorizing the purchase of Parcel #24 , 2 . 743 acres out of City Tax Tract 60 , Plat RS-4 , W. B. Dyches League , from H . G . Nichols , for $32 ,916 . 00 , was approved on a motion made by Councilman Combs and seconded by Councilman Turner. QUESTION : AYES : All MAYES : None ( This parcel needed for the Chinn Road Project (82-B565-00475 ) . -000- Resolution 81 -350 authorizing the agreement to settle and compromise the case now pending in the District Court of Jefferson County , Texas , entitled Michael Phelan , et al vs . the City of Beaumont , No . B-105 ,700 , was approved on a motion made by Councilman Lord ; seconded by Councilman Turner. QUESTION : AYES : All NAYES : None - 134- AUGUST 25 , 1981 -000- Councilman. Combs spoke to Item #1 -- apologized for being late ; stated he understood that driveways were poured prior to approval of the per- mit; that he didn ' t know if this was just a particular instance or if there might be some loophole in our specific use permit procedure that allows the concrete work to b-e done prior to approval of the permit ; that if it does , it is not right and needs to be clearly defined in the permitting procedure. City Manager stated there had been a substantial amount of concrete poured -- primarily to driveways ; that there is some question as to when it is legal to proceed with pouring concrete prior to approval of the specific use permit; that the matter would be reviewed . Councilman Turner stated that on Folsom, between Crow Road and Dowlen , needed some type of rehab work ; that patching woul.d not do the job since he felt it was beyond patch-work repairs . Councilman Turner asked when work would begin on the Brooks Road Rehab project. City Manager stated it will be scheduled by the County for late fall ; that the matter had been discussed , but the County had a number of other projects in advance of this project . Councilman Combs stated that he liked doing projects with the County, but mentioned that out in his end of town , some of the roads were done rising City materials and County labor and was almost all gone in less than a year; that the level of the work wasn ' t real good and wondered if it might be cheaper for us to do the work ourselves . City Manager pointed out that the County uses a different type overlay system from the City -- it is a seal as opposed to hotmix overlay. Councilman Lord asked if future litter baskets would be purchased with tops ; suggested that the hinged-type might be better. Mayor Meyers acknowledged the information sheet distributed to those present and expressed appreciation for the sheet ; Council concurred . -000- CITIZENS Leona Seniguar , 2313 Irving Street , complained that bus drivers do not pull up to the curb and asked if the bus was not to pull up to the curbs to pick up passengers . A . T. Johnson , 1408 Johns Street , complained of trash being strewn in the area of Johns and Royal Streets for as long as three and four months at a time ; stated he had reported trash conditions with little or no results . -000- There being no further business , Mayor Meyers recessed the regular meeting to reconvene for the Work Session . -000- I , Myrtle Corgey , City Clerk of the City of Beaumont , certify that the foregoing is a true copy of the minutes of the Regular City Council session held August 25 , 1981 .
