Carter and Dorsey Watler to the Clean Community Commission for two-year terms ; Resolution 80-479 accepting State Department of Highways and Public Transportation Minute Order No. 78058 providing for the relocation of Highland Avenue in the construction of the Lamar FreeiAaN,/Spur 380 exten- sion ; Resolution 80-480 authorizing execution of a Quitclai Malleti , Sr. & wife Mildred Mallett for Lot 11 , Blockm8 ,Deed orth Addition for $500. 00 (acquired at a tax foreclosure sale held by the Jefferson County- Sheriff by virtue of tax judgment in tax suit No . 26697 styled City of Beaumont and State of Texas vs . The Consent Agenda was approved on a motion made by Councilman Combs and seconded by Councilman Turner. Question Ayes : All Nayes : None -000- A resolution authorizing purchase of a parcel of land (Tract 1 out of Tract 49, W. B. Dyches Survey - approximately 6 acres) for an appraised value of $45 , 000. 00 was considered. Councilman Combs made .a motion to approve the resolution ; Councilman Turner seconded the motion. Councilman Combs questioned the feasibility of locating Fire Station No. 13 on a portion of the new park located on Griffin Road and using the acquisition funds for development of the park. -233- DecemnAr Rn iaQn City Manager Riley responded that this would be possible but less desira- ble because of access routes through Eastex Freeway north of the Canal and distances travelled will have a big bearing on response time , which is critical . He said he did not want to give a definite "no" but that his response would probably be the same but the resolution could be de- ferred one week to give time to look at the specific request . Councilman Combs withdrew his motion to approve the resolution. The resolution was deferred one week. -000- Resolution 80-484 authorizing sale of a 60 x 120-foot lot described as Lot 695, Block 30 , Old Beaumont Townsite to the Beaumont Heritage Society for $12 , 600. 00 subject to an independent appraisal to be used for the preservation of the Sanders Home was approved on a motion made by Council- man Combs and seconded by Councilman Lord. Question : Ayes : All Nayes : None -000- Resolution 80-485 endorsing the "Goals for Beaumont" program as developed under the sponsorship of the Beaumont Junior League , Chamber of Commerce , League of Women Voters and the Southeast Texas Chapter of the American Institute of Architects was approved on a motion made by Councilman Combs and seconded by Councilman Lord. Question : Ayes : All Nayes : None -000- . Resolution 80-486 authorizing execution of a 60-month lease/purchase agree- ment with Highway Equipment Company , Inc. for a truck-mounted hydraulic excavating machine to be used by the Street Department in the ditching program at a cost of $116, 100. 00 was approved on a motion made by Council- man Turner and seconded by Councilman Combs . Question: Ayes : All Nayes : None -000- Resolution 80-487 accepting the bid of Equipment Headquarters , Inc. for furnishing an articulated four-wheel drive loader with rubber tires to be used by the Street Department at a cost of $42 ,615 . 00 was approved on a motion made by Councilman Lord and seconded by Councilman Combs . Question : Ayes : All Nayes : None -000- Resolution 80-488 authorizing execution of a 60-month lease/purchase agree- ment with Environmental Sales and Service at a cost of $43 ,368 . 60 for fur- nishing a sewer cleaner jet machine to be used by the Street Department for cleaning storm sewers was approved on a motion made by Councilman Combs and seconded by Councilman Lord. Question : Ayes : All Nayes : None -000- Resolution 80-489 accepting the bid of Equipment Headquarters , Inc . for furnishing a crawler loader with a two cubic-yard bucket at a cost of $54 , 999. 00 for the Street Department was approved on a motion made by Councilman Combs and seconded by Councilman Lord . Question : Ayes : All Nayes : None -000- A resolution accepting the bid of Bado Equipment Company , Inc. for fur- nishing a 40-ton crane was deferred to a future date. -234 December 30 , 1980 Resolution 80-490 authorizing execution of a 60-month lease/purchase agreement with R. B. Everett and Company for furnishing two FMC 4-wheel broom-type street sweepers at a cost of $148 ,690. 00 ($2 ,478 . 16 per month) was approved on a motion made by Councilman Lord and seconded by Council- man Turner . Question : Ayes : All Nayes : None -000- Resolution 80-491 accepting the bid of Tidelands International for fur- nishing one front-loader used for commercial collection at a cost of $73 ,739. 00 and five 29-cubic yard side-loader refuse trucks (replacing 20-cubic yard rear loaders) at a cost of $46 , 950 each or $284 ,750 total was approved on a motion made by Councilman Combs and seconded by Council- man Lord. Question : Ayes : All Nayes : None -000- Resolution 80-492 accepting the bid of Kinsel Ford, Inc . for furnishing two bobtail trash trucks at a cost of $84 , 946 . 34 and a truck with a knuckle boom loader at $58, 951 . 67 was considered : CITY MANAGER RILEY: The recommendation for the bobtail trucks would be that of Kinsel Ford, low bid in the amount of $84 , 946. 34. In the case of the truck equipped with the knuckleboom loader , the recommendation is Kinsel Ford in the . amount of $58 , 951 . 67 . There was a lower bid received that was submitted by Isaacson Sager of Houston . They proposed to furnish the truck with a Limco Hydraulic Loading Boom, whereas Kinsel was proposing to submit a Prentice Knuckleboom Loader . We currently have three of the Prentice Lnuckleboom loaders in use in the Sanitation Department and are familiar with its use . It is the more expensive of the two . We are not familiar with the Limco. We are not saying it is not an adequate piece of equip- ment -: there has not been any use of is here locally - we are not aware of the service which can be acquired. The City Purchasing and the Main- tenance Divisions recommended purchase of the knuckleboom loader from Kinsel as the preferable bid because of our experience and because of the parts inventory and the uniformity of equipment . We are not fami- liar with the Limco and feel that it would probably not be in our inter- est to purchase one and have one of it and three of the Prentice. So , the recommendation is made for what would not be the lowest but would be a preferable bid to be purchased from Kinsel Ford in the amount of $58 , 915. 67 . MAYOR MEYERS : With that , I would mention the fact that Mr. Sager of Isaacson Sager called and asked for an opportunity to speak with Council prior to Coun- cil ' s vote on this matter. Mr. Sager , we would be more than happy to offer you a few moments at the microphone understanding that if Council has any questions they ' ll direct them to you. If not , we will proceed and I believe Mr. Colley also has similarly asked for an opportunity so you are more than welcome to address Council . DAVE SAGER: Thank you . Dave Sager is my name with Isaacson Sager Crane and Equipment Company . Mayor Meyers and members of the Council , the Limco loader , of course , is the loader which we bid. Over the past three and one half (31) years , I happened to be with Gulf State Crane & Equipment Company and sold the Prentice loader to many, many cities within this Gulf Coast area. Since that time , I have started my own firm and took on the Limco loader line . The Limco loader far surpasses - far surpasses the qualities of the Prentice machine and given the opportunity through an invitation to bid on the knuckleboom loader , there was no place in that invitation to bid that said you must bid a Prentice machine and only a Prentice machine. It said specifically that a Prentice or equal could be bid . We did not bid an equal machine . We bid a machine that exceeded specifi- cations in every single respect - not only through the loader but through -235- December 30, 1980 DAVE SAGER continued : the truck. I was very disturbed just after the invitations were opened on the 10th to find out that Kinsel Ford was going to be awarded the bid. I called Mrs. Denmon ; I called Bill Ferrell and I asked why and I never got a straight answer . I got an answer something to the effect that we feel it is in our best interest , David, because Kinsel Ford is a local operation. . Kinsel Ford is supplying nothing other than a truck; the loader , and Don Colley can correct me , is being purchased through Gulf State Crane in Houston. The truck that we are providing , the body that we are providing, the _loader that we are providing is all through one firm - not through two firms - not through three firms , but one firm - Isaacson Sager Crane and Equipment Company. I had the opportunity to speak to Bill Ferrell . I had the opportunity to speak to Ray Riley , Mr . Platt , Maurice Meyers, in referenct to the fact that we want your business so bad - we 've earned your business , we feel . We can not only make this machine a super machine for the City of Beaumont but , based on the opportunity to have a machine of this nature placed in the City of Beaumont , not only the City of Beaumont will enjoy the pres- tige and service of this machine but so many cities will follow that I have previously sold Prentices and now will see a better machine than the Prentice machine in the Gulf Coast area. I might add that the Limco loader . . . there are loaders that have been sold in Nacogdoches and the Lufkin area. There are loaders that have been sold in Louisiana, Georgia, Florida, North Carolina, South Carolina -- all through the South, but Prentice has geared itself to a specific market through a qualified distributor in the South , Gulf State Crane & Equipment , who I was employed with at one time. And, I ' d say through those past five years when Gulf State represented the Prentice machine , I did my best as Don knows, as Jerry Colley who owns the company knows , to represent that Prentice well . So , Prentice is all over the Gulf Coast area and I can truthfully say that I sold a good many of them. Now, I 've got a better machine to sell - the Limco loader will not only do the job but do a fantastic job. Like I said, it exceeds specifications in every respect - every respect . I beg of you the opportunity to provide the City of Beaumont with the Limco loader and the Ford truck which exceeds every specification . We were low bid, I might add. Thank you. DON COLLEY : Thank you, Mr. Mayor and Council . You will have to pardon me. My voice is about to quit on me . All I would like to say is that we have provided Prentice machines in the State of Texas - in the area for some six years . I believe we will be starting our seventh year in January and have been a Prentice dealer and have provided the City of Beaumont , I believe , with three. The City of Houston has in the neighborhood of ten , twelve , fif- teen , I really don ' t know. San Antonio runs fifteen to twenty. Cities throughout the Gulf Coast -- Baytown , Port Arthur, Wharton , Bay City, have been provided Prentice loaders over the years and they are a proven piece of equipment . I cannot tell you anything about the Limco loader. I got my information - what little I have - from Limco. When I inspected the bids there was a flyer in there from the Limco and it had a phone number on there to call and it said no salesman needed, buy direct . So I called it and the man told me that he has no dealers in the United States , that he sells direct . You bring the truck to him and he will put the loader on there and you bring it home and we are a full line service dealer with parts and service, with parts available in Houston . -236- December 30, 1980 DON COLLEY continued : I think we ' ve shown over the years the service we can provide not only to the City of Beaumont but to the other municipalities in the State and if we haven ' t shown a lot to the City , then I 'm sure the other people that are furnishing like Kinsel Ford and Wheeler Truck Body have shown good service to the City of Beaumont , too , and whatever decision ya' 11 make here today , I thank you for the time and whatever decision you make , I 'm sure it will be in the best interest of the City of Beaumont . In answer to questions by Councilman Combs , City Manager replied that some maintenance is done in house but the major part of the service for this type of equipment is done by Wheeler Truck and Equipment and HYCO locally . In answer to questions by Councilman Williams concerning warranties , re- presentatives answered that -the Limco has 90 days on all parts uncondi- tionally on the machine as well as a lifetime warranty on the main stem itself ; and the Prentice carries six months warranty on parts , 90 days on labor . A general discussion concerning availability of parts was held and both representatives state they have no problems with supply. COUNCILMAN COMBS : I just have one other thing that I wanted to ask. I can see - you know, somebody making a bid on a $60, 000/$58/000 piece of equipment , that $1 ,400. 00 sounds like a lot of money. Somebody that operates equipment though . . . I know that when I go to buy a piece of equipment , its com- patibility with the other equipment that I use makes an awful lot of dif- ference and my mechanics ' familiarity with it even on a lot less expen- sive piece of equipment - a lot of times $1 , 000 wouldn' t make a whole lot of difference as long as my people were familiar with it - the people working on it and I was familiar with it myself . But , nevertheless , you did have a lower bid. Do you have some other people that you have per- sonally - that your company has placed this equipment with? MR. SAGER: No, not the Limco machine. Like I said, we are new distributors for the Limco. machine but I might add that Dean Christianson who owns Limco Loaders would definitely be down here , as well as myself , to go over with your mechanics - go over with your individuals who would be operating the ma- chine and thoroughly make them aware of the qualities and the ability and ease of handling of the machine - thoroughly train these people so they would understand how they operate . The machine does not operate much differently than the Prentice machine. In fact , it operates very close to the same . After further discussion , Mayor Meyers called for the motion to approve Resolution 80-492 . Councilman Turner made the motion to approve ; motion was seconded by Councilman Combs . Question : Ayes : All Nayes : None -000- Resolution 80-493 authorizing agreements with Sol L. Wisenburg Insurance Agency for general liability at a net premium of $118 , 189 and Employers Casualty Company to provide Fleet Liability at a premium of $102 , 151 and Umbrella Coverage which exceeds liability of $500, 000 per person per oc- currence or Bodily Injury and $100, 000 Property Damage up to $20 ,000, 000 and cost is $87 , 500. 00 was approved on a motion made by Councilman Combs and seconded by Councilman Lord. Question : Ayes : All Nayes : None Mr. Bill Joiner appeared on behalf of Barry Kunz of T.E. Moor & Company, a member of the Insurance Advisory Committee , and spoke to the work done by this group . -237- December 30, 1980 Resolution 80-494 accepting the bids of Kinsel Ford, Inc . for five (5) pickups at a cost of $37 , 689. 38 ; Beaumont Motor Company for nine (9) pickups at a cost of .$65, 582 . 30; and Myron Gray Chrysler Center for one ( 1 ) at $8 ,765. 80 was approved on a motion made by Councilman Combs and seconded by Councilman Williams . Question : Ayes : All Nayes : None -000- The regular City Council was recessed before calling a public hearing for dilapidated structures . Public hearing for dilapidated structures was opened. Mr. George Gardner , Urban Rehabilitation Administrator , told Council that all the below-listed structures are in violation of Article III , Sections 14-50 and 14-51 of the Dangerous Structures Ordinance of the City of Beaumont , Texas , and that all notification procedures have been met : 1626 AVENUE H - Glen Willard Williams, owner (7 violations) , recommendation to raze or repair within 30 days ; 655 BLANCHETT (A- Rear) and (B-Rear) - Reverend Albert Babrie, owner (17 violations on each structure) , recom- mendation to raze within 30 days ; 665 BLANCHETT - W. S . Dickson & Aubrey Jr. , owners ( 12 violations) , recommendation to raze within 30 days ; 3030 W. CROCKETT - Janie Bowman c/o Thelma Beverly , owner (8 violations) , recommendation to raze or repair within- 30 days ; 2815 FRANKLIN - Schlett Enterprise , owner (17 violations) , recommendation to raze within 30 days ; 1205 GILL- William McIntyre, owner (14 violations) , recommendation to raze or repair within 30 days ; 2694 MAGNOLIA (FRONT & REAR) - W. L. Wilson, owner ( 19 violations) , recommendation to raze within 30 days ; and 2360 NECHES (REAR) - Ms. Dorothy Malett Vargas , owner (22 violations) , recom- mendation to raze within 30 days . Recommendations were approved on a motion made by Councilman Williams and seconded by Councilman Turner . Question : Ayes : All Nayes ; None Public Hearing closed and regular session reopened: Ordinance No. 80-122 declaring certain dilapidated structures to be public nuisances and requiring their repair or removal was considered: ORDINANCE NO. 80-122 ENTITLED AN ORDINANCE FINDING CERTAIN STRUCTURES TO BE PUBLIC NUISANCES, ORDERING REPAIR OR DEMOLITION FOR CERTAIN STRUCTURES ; ORDERING DEMOLITION FOR CERTAIN STRUCTURES ; ORDERING DEMOLITION BY THE CITY UNDER CERTAIN CONDITIONS; PROVIDING A PENALTY; AND PROVIDING FOR SEVERABILITY. The ordinance was approved on a motion made by Councilman Combs and se- conded by Councilman Lord. Question : Ayes : All Nayes : None -000- Mayor Meyers recognized Jeff Clark, former Beaumont Journal newsman, and welcomed him to the meeting. Mr. Ben Rogers , 2010 Thomas Road, addressed Council to express his concern for final Census data; free parking on downtown streets after 10 a.m. ; and to question the workings and answerability/accountability of the new Jefferson County Taxing Agency. Mr. Richard Hatch, 4595 Arthur, addressed Council to request traffic signals west of Eastex Freeway for the Folsom/Crow area and also to complain about the poor condition of Folsom Road.
